RE: APPROVAL OF RECORDED EXEMPTION NO. 495 - RAYMOND AND VICTORIA
ALM
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held on
the 13th day of May, 1981 in the Chambers of the Board of County
Commissioners of Weld County, Colorado, that the division into
two parcels of land, as shown on the plat known as Recorded
Exemption No. 495, being the property of Raymond and Victoria
Alm, described as part of Section 33, Township 1 North, Range
65 West of the 6th P.M. , Weld County, Colorado, being more par-
ticularly described as follows, does not come within the purview
of the definition of the terms , "subdivision" and "subdivided
land, " pursuant to its authority under Section 30-28-101 (10) (d) ,
CRS 1973, as amended:
LOT "A"
A tract of land located in the Northeast Quar-
ter of Section 33, Township 7 North, Range 65
West of the 6th P.M. , Weld County, Colorado,
being more particularly described as follows:
Beginning at the Northeast corner at said Sec-
tion 33; thence in a westerly direction along
the North section line of said Section, 1251 .87
feet to the True Point of Beginning; thence in
a southerly direction 208. 71 feet; thence in a
westerly direction 208 . 71 feet; thence in a
northerly direction 208 . 71 feet; thence in an
easterly direction along the North section line
of said section, 208 . 71 feet to the True Point
of Beginning. Said tract contains 1.0 acres ,
more or less, and is subject to all easements
and rights-of-way now on record or indicated
on the attached plat.

All that part of Section 33 , Township 7 North,
Range 65 West, as conveyed by warranty deed
recorded in Book 668, at Reception No. 1610196

of the Southeast Quarter of said Section;

ter corner of said Section; thence in an

The above description of Lot "B" was taken
from a previously recorded legal description
with modifications to exclude Lot "A" .
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definitions of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended,
and Section 2-lA(3) of the Weld County Subdivision Regulations .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Raymond and Victoria Alm be, and hereby is,
exempt from the definition of the terms "subdivision" and "subdi-
vided land" pursuant to its authority under Section 30-28-101 (10) (d) ,
CRS 1973 , as amended.

Dear Commissioners:
The attached application, plat, and related items are in reference
to a request from Raymond and Victoria Alm for a recorded exemption.
The parcel of land on which this request has been made is described as
part of Section 33, T1N, R65W of the 6th p.m. , Weld County, Colorado.
This property is located 2 miles east and 2 mile north of Eaton, Colorado.
The property contains approximately 182.7 acres. The request is to
split the property into parcels of 181.7 acres and 1 acre.
Mr. and Mrs Alm desire to sell the improvements on the one acre because
they no longer need the house for farm laborers.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends the request
be approved for the following reasons:
1. The request conforms to the intent clause of the Recorded
Exemption Procedure (Section 9-2 of the Weld County Subdivision
Regulations) , the intent clause of the Agricultural Zone
District (Section 3.3.A. of the Weld County Zoning Resolution) ,
and the Weld County Comprehensive Plan in that the uses will be
compatible with the surrounding agricultural uses. The request
will allow agricultural and related uses to be the predominant
land uses. There will be no reduction in the amount of land
currently being used for agricultural production.
2. The Town of Eaton has no objections.
3. This request complies with the provisions of Section 9-4 A.
of the Weld County Subdivision Regulations.

To Whom it May Concern:
We are requesting your approval of a recorded exemption for the
following reasons:
We no longer need this house for a labor house , which was it' s
original use when it was built by my father.
For several years we have been renting the house on the portion
we wish to get a recorded exemption on, and we would like to have
the option to either sell the house and one acre , or, since we
have three children ages twenty-one , nineteen, and eighteen,
perhaps one of them would like to awn it.
