The Weld County Public Works Department has reviewed this proposal. This proposal falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article 2, Division 4, Section
23. Our comments and requirements are as follows:
Weld County Strategic Roadway: (December 2002) WCR 22 is classified by the County is a Strategic
Roadway, which requires a 140-foot right-of-way at full build out. There is presently a 60-foot right-of-way.
This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning
Ordinance (23-1-90), the required setback is measured from the future right-of-way line. (WCRs 7, 9.5, 11,
13, 22, 24, 27, 37, 49 and 74)
Section Line Access: (right-of-way) Section line access, WCR 33, has 60 feet of right-of-way per date
11/6/1915, Book 100/626. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (23-1-
90), the required setback is measured from the future right-of-way line.

water discharges.
The applicant is required to comply with all Colorado Oil and Gas Conservation Commission (COGCC) rules
and regulations including drill pad construction, storm water controls, and reclamation.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.

Site Specific Development Plan and an Amended Special Review Permit for Mineral Resource Development Facility
including a Oil and Gas Support and Service (Natural Gas Compressor facility in the A(Agricultural) Zone District.
1. A building permit shall be obtained prior to the construction or placement of any structure. An electrical permit will
be required for any electrical service to equipment. A plot plan shall be submitted when applying for building permits
showing all structures with accurate distances between structures, and from structures to all property lines.
• 2. A plan review is required for each building for which a building permit is required. Plans shall bear the wet stamp
of a Colorado registered architect or engineer. Two complete sets of plans are required when applying for each
permit.
3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application.
Currently the following has been adopted by Weld County: 2006 International Building Code; 2006 International
Mechanical Code; 2006 International Plumbing Code; 2005 National Electrical Code; 2006 International Fuel Gas
Code and Chapter 29 of the Weld County Code.
4. Each structure set on a foundation will require an engineered foundation based on a site-specific geotechnical
report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be
designed by a Colorado registered engineer.
5. Building wall and opening protection and limitations and the separation of buildings shall be in accordance with the
Building Code. Setback and offset distances shall be determined by the Zoning Ordinance.
6. Building height shall be measured in accordance with the Building Code for the purpose of determining the
maximum building size and height for various uses and types of construction and to determine compliance with the
Bulk Requirements from Chapter 27 of the Weld County Code. Building height shall be measured in accordance with
Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. Offset
and setback requirements are measured to the farthest projection from the building.
7. Provide a letter of approval from Fort Lupton Fire protection District prior to setting any equipment or structures.
8. There are eighteen historical building permits with final status for this parcel.

Environmental Health Services has reviewed this proposal for a mineral resource
•development facility including oil and gas support and services (Natural Gas
Compressor Facility). The application materials state that water is trucked in for
.sanitary use, however septic permit G-930165 denotes a well as the water source. The
applicant shall verify which water source is correct and update the septic permit if
necessary. We have no objections to the proposal, however, we do recommend that the
following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit evidence of an Air Pollution Emission Notice
(A.P.E.N.) and Emissions Permit application from the Air Pollution Control
Division (APCD), Colorado Department of Health and Environment. Alternately,
the applicant can provide evidence from the APCD that they are not subject to
these requirements.
2. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).

• We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to operation:
•
• 1. In the event that 1 or more acres are disturbed during the construction and
development of this site, the applicant shall obtain a stormwater discharge
permit from the Water Quality Control Division of the Colorado Department of
Public Health and Environment. Alternately, the applicant can provide evidence
from WQCD that they are not subject to these requirements.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
• 3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan".
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S., as amended.
7. Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility.
8. Bottled water shall be utilized for drinking and hand washing at the site.
9. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
10.Adequate toilet facilities (portable toilet) shall be provided during the construction
of the facility.

• 11.All potentially hazardous chemicals must be stored and handled in a safe
manner in accordance with product labeling and in a manner that minimizes the
release of hazardous air pollutants (HAP's) and volatile organic compounds
(VOC's).
12.If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
13.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.
