HomeMy WebLinkAbout20082217.tiff RESOLUTION RE: APPROVE MEMORANDUM OF UNDERSTANDING FOR SCHOOL SUPPLY PROGRAM AND AUTHORIZE CHAIR TO SIGN - UNITED WAY OF WELD COUNTY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Memorandum of Understanding for the School Supply Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, and United Way of Weld County, commencing July 1, 2008, and ending December 31, 2008, with further terms and conditions being as stated in said Memorandum of Understanding, and WHEREAS, after review, the Board deems it advisable to approve said Memorandum of Understanding, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County,Colorado,that the Memorandum of Understanding for the School Supply Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, and United Way of Weld County be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said Memorandum of Understanding. Griego, Director, H COLORADO RE: Memorandum of Understan ng Between the Weld County Department of Human Services and Weld County United Way for the Weld County School District School Supply Program Enclosed for Board approval is the Memorandum of Understanding between the Weld County Department Human Services and Weld County United Way for the Weld County School District Supply Program. The purpose of this Agreement is to establish a collaborative effort of collecting and distributing school supplies throughout Weld County Schools. The supplies are intended for low-income children to provide the necessary items to start the school year. The MOU defines both parties responsibilities with regard to the supply program. The term of the Agreement is from July 1, 2008 through December 31, 2008. The total funding is up to $50,000 for student supplies. This Agreement was reviewed in a Work Session in May 27, 2008. Filed BM 08 18 08 s-b4.DOC Page 1 of 1 2008-2217 MEMORANDUM OF UNDERSTANDING WHEREAS,the following outlines the components of a Memorandum of Understanding (hereinafter referred to as the Agreement)between United Way of Weld County(hereinafter referred to as United Way) and Weld County Department of Human Services(hereinafter referred to as the County) regarding services for Weld County School District School Supply Program WHEREAS, each organization is independent and capable of providing to the identified community the services described in this Agreement. The organizations to this Agreement also understand that by combining their leadership, skills,and talent,that the potential to offer these needed services can be accomplished better and more effectively. NOW THEREFORE, the undersigned organizations and in good faith are resolved to execute this Memorandum of Understanding and enter into an agreement as follows: I. Purpose of Statement: The purpose of this Agreement is to: Establish a collaborative effort of collecting and distributing school supplies throughout Weld County Schools; Serve eligible low-income children/adolescents: Provide these low-income children/adolescents with the necessary school supplies to start the school year ready to learn on the first day of school which might further assist these low-income children/adolescents to graduate and minimize or eliminate their chances of remaining in a low-income household once they graduate. II. Population Served: Per the 2000 census, in Weld county - 28.6% of two parent households with children under the age of 18 have incomes that are below the poverty level. - Of the total number of single parent families with children under the age of 18, 32% live on incomes that are below the poverty level. 11.5% of all school aged children are living in poverty. The average family size is 3.25. - 93.81% of the residents have legal residency. Per the Colorado Department of Education Fall 2007 PK— 12 Free and Reduced Lunch by District document Of the PK— 12 enrollment(35,648 students) in Weld County School Districts, 41.79% (14,896 students)participate in the Free and Reduced Meal program. The average cost of school supplies per child is $40.00 per year. This does not include the cost of the calculator required by most high schools($75.00 per student),the cost of a second back pack(average $13.25/back pack)that is recommended by most middle and high schools or replacing/replenishing supplies throughout the year. Other costs to families that should be considered are lab fees and field trip fees. United Way's Responsibilities 1. Collaborate with the County to provide quality service to the identified clients. 2. Scheduling meetings with every school district within Weld County. 1 • 3. Developing the funding to support the program. 4. Working with private businesses collecting the needed supplies. 5. Working with the United Way Gifts in Kind program to gather needed supplies. 6. Purchasing needed supplies. 7. Sort and package supplies by school district and specific schools based on"Free and Reduced Meals" program. 8. Facility to have the supplies delivered. 9. Store, organize,and package the school supplies. 10. Coordinate a pick up day by school districts. 11. Respond to requests for information in a timely manner. County's Responsibilities 1. Collaborate with United Way School Supply Program to provide quality service to the identified clients. 2. Agree to coordinate services to best accomplish the outcomes listed in Exhibit A. These said outcomes would be the goal of the County as they are what is in the best interest for the families that the County is working with across the board. 3. Agree to coordinate and share appropriate information with United Way School Supply Program regarding the identified client as well as other agencies as needed. 4. Agree to contribute up to 93.81% of all funding up to$50,000 total from the County's Colorado Works funds to support the 14,896 students receiving Free and Reduced meals. It is the intent of the County to only provide school supplies to eligible Colorado Works families. Term of the Agreement The term of this agreement shall commence on July 1, 2008 and terminates on December 31, 2008. Confidentiality Standard United Way and the County shall comply with all applicable standards; rules and regulations regarding confidentiality arid treatment of clients as such may be related to their responsibilities. Termination of the Agreement This Agreement may be terminated by United Way or by the County upon 30 days'written notice in the event of the other party's failure to perform in accordance with the terms of this Agreement. 2 Assignment and Subcontracting United Way is not obligated or liable under this agreement to any party other than the County named herein. Non-Discrimination In Employment and Service Delivery The connection with the delivery of services under this Agreement, United Way agrees not to refuse to hire, discharge,promote or demote,or to discriminate in matters of compensation against any person otherwise qualified, solely because of race, creed, color, religion, sex, age, national origin, sexual orientation or ancestry. United Way further agrees not to refuse services for any person otherwise eligible, solely because of race,creed, color,religion, sex, age, national origin, sexual orientation,or ancestry. Indemnity The County shall defend, indemnify, and hold harmless United Way, its successors and assignees, and its Directors, officers,agents,and employees against any and all losses or damages to property or injuries to or death of any person or persons, including property and employees or agents of United Way and defend, release, indemnify and save and hold harmless United Way from all claims, demands, suits, losses, and expenses, direct, indirect, or consequential(including but not limited to fees and charges of attorneys and other professionals and court costs), actions or proceedings of any kind or nature, including but not limited to workers'compensation claims, resulting or arising from negligence or misconduct by the County in the performance of this Agreement. Insurance During the term of this contract, and any extension(s) hereof, United Way agrees that it will keep in force an insurance policy or policies, issued by a company authorized to do business in Colorado, in the kinds and minimum amounts specified below. In the event of cancellation of any such coverage, United Way shall immediately notify the County of such cancellation. I. Standard Worker's Compensation and Employers'Liability as required by Colorado statute, covering all employees on or off the work site,acting within the course and scope of their employment. 2. General, Personal Injury, Professional, Automobile Liability(including bodily injury,personal injury and property damage) with minimum coverage of: • Occurrence basis policy: combined single limit of$1,000,000 or Claims-Made policy: combined single limit of$1,000,000 • Annual Aggregate Limit policy: Not less than $3,000,000 plus agreement that the contractor will purchase additional insurance to replenish the limit to $3,000,000 if claims reduce the annual aggregate below$3,000,000. Authority This Agreement is upon execution a valid and binding obligation between United Way and the County, and making and performance of which has been duly authorized by all necessary corporate or official or 3 . other action,and will not constitute a violation of any law or requirement imposed by a judicial or arbitral body or governmental instrumentality, nor the charter or by-laws of statute, ordinance or regulation controlling United Way,nor a default under any agreement or instrument by which it is bound or affected. Neither the making nor performance of this Agreement requires the consent or approval of any governmental instrumentality nor, if such consent or approval is required,such has been obtained.
