RE: CONSENT TO THE ENFORCEMENT BY THE WESTERN HILLS FIRE PROTECTION
DISTRICT OF THE 2006 INTERNATIONAL FIRE CODE,WITH AMENDMENTS,WITHIN
THE DISTRICT'S UNINCORPORATED PORTIONS OF WELD COUNTY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Section 32-1-1002(1)(d), C.R.S., provides that a fire code promulgated by a
fire district may be enforced in the unincorporated portions of a county only with the consent of the
board of county commissioners of such county, and
WHEREAS, the Western Hills Fire Protection District (the "District") has presented a
resolution and minutes, dated October 15, 2007, adopting and promising to enforce the 2006
International Fire Code, with certain amendments set forth in said resolution and minutes, within
the District's unincorporated portions of Weld County, and
WHEREAS, the Western Hills Fire Protection District Board of Directors held a public
meeting on October 15, 2007, following a seventy-two hour posting of the notice of the meeting,
at which the 2006 International Fire Code and its adoption by the District was discussed, and
WHEREAS, after review, the Board deems it advisable to consent to the enforcement by
the District of the 2006 International Fire Code, with certain amendments set forth in said
resolution, a copy of which is attached hereto as Exhibit A, within the District's unincorporated
portions of Weld County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that it hereby consents to the enforcement by the Western Hills Fire Protection
District of the 2006 International Fire Code,with certain amendments set forth in its resolution and
minutes dated October 15, 2007, within the incorporated area of such District.

RESOLUTION a. ,2007
A RESOLUTION OF THE WESTERN HILLS FIRE PROTECTION DISTRICT
ADOPTING THE INTERNATIONAL FIRE CODE,2006 EDITION.
WHEREAS,the Western Hills Fire Protection District has the responsibility of
interpreting and enforcing the International Fire Code for the protection of citizens who live
within the Authority's boundaries; and -
WHEREAS,the International Fire Code, 2006 Edition, is deemed by the Authority to be
the version of the Code that will provide the best protection to citizens.
NOW, THEREFORE,BE IT HEREBY RESOLVED BY THE WESTERN HILLS FIRE
PROTECTION DISTRICT AS FOLLOWS: I,!
1. The International Fire Code, 2006 Edition,together with Appendices B, C,E,F,
and G, included therein is hereby adopted by reference as law in the boundaries of
the Western Hills Fire Protection District. The International Fire Code and the
appendices and tables and the referenced standards are on file at the office of the
Union Colony Fire/Rescue Fire Prevention Bureau.
2. The International Fire Code,2006 Edition,is hereby amended in accordance with 1
the provision of Exhibit A, attached hereto and incorporated herein by reference.
3. This resolution shall be effective immediately upon its passage.
PASSED AND ADOPTED, SIGNED AND APPROVED THIS /5 day of October,2007.

A. Adoption of 2006 International Fire Code.
Ch. Forman reported that every third year a revised version of the
International Fire Code is adopted. After the Western Hills Board adopts
the 2006 edition,the Weld County Commissioners will ratify the decision
and it will be presented to Garden City for adoption.

8. Fire Authority Report
4.2% increase in calls 8892 calls projected.
9.2% increase in the district. 224 calls in the district year to date.
Fleet Maintenance continues to be a concern. Engine 1 has been out of service.
Currently out for bid for a new engine, authorized by the EAR Fund. Also in the proposal is
a fleet lease/purchase option. The lease purchase option is subject to approval of the City of
Greeley.
Ladder 1 will move to Station 3 this week. Ch. Forsman and Ruth Jones will be
moved to the second floor of the public safety building. Engine 1 crews will move to the
former police squad room area of the public safety building. The current Station 1 area will
be closed for approximately three months for the remodel.

Local Amendments to the 2006 International Fire Code
Western Hills Fire Protection District
101.1 Title. These regulations shall be known as the Fire Code of Western Hills Fire
Protection District, hereinafter referred to as "this code."
102.3. Change of use or occupancy. The provisions of the International Existing
Building Code this code and all currently adopted building codes shall apply to all
buildings undergoing a change of occupancy.
102.4. Application of building code. The design and construction of new buildings
shall comply with the International Building Code this code and all currently adopted
building codes. Repair, alterations and additions to existing structures shall comply
with the International Existing Building Code this code and all currently adopted
building codes.
Delete Section 102.5.
102.6 Referenced codes and standards. The codes and standards referenced in this code
shall be those that are listed in Chapter 45 except that references to National Fire
Protection Association standards shall refer to the most current edition of such
standard and all references to the ICC Electrical Code shall mean the currently
adopted electrical code. And Such codes and standards shall be considered part of the
requirements of this code to the prescribed extent of each such reference. Where the
differences occur between the provisions of this code and the referenced standards, the
provisions of this code shall apply.
103.1.1 Fire prevention bureau personnel and police. The chief and members of
the fire prevention bureau shall have the powers of a police officer to issue a
summons into court and in performing their duties under this code and shall only
extend as far as the authority set forth in Colorado Revised Statutes 1973 §32-1-
1002 as amended, or other applicable state statute. When requested to do so, the
Sheriff or the chief of police is authorized to assign such available deputies or
police officers as necessary to assist the fire department in enforcing the provisions
of this code.
105.6.30 Open Burning. An operational permit is required for the kindling or
maintaining of an open fire or a fire on any public street, alley, road, or other public or
private ground. Instructions and stipulations of the permit shall be adhered to.
Exception: Recreational fires.
108.3 Qualifications. The board of appeals shall eonsist of members who are qualified
by
experience and training to pass on matters pertaining to hazards of fire, explosions,
hazardous conditions or fire protection systems and are not employees of the
jurisdiction. Appeals Process. All appeals shall first be made in writing to the Fire
Marshal. A subsequent appeal to the Fire Marshal's decision shall be made in
writing to the Fire Chief An appeal to the Fire Chief's decision shall be made in
writing to the Union Colony Fire Rescue Authority Board. All decisions and
findings shall be rendered in writing to the appellant with a duplicate copy filed in
the Fire Prevention Bureau. Rulings by the Union Colony Fire Rescue Authority
Board shall be final.
109.3 Persons who shall violate a provision of this code or shall fail to comply with
any
of the requirements thereof or who shall erect, install, alter, repair or do work in
violation
of the approved construction documents or directive of the fire code official, or of a
permit or certificate used under provisions of this code, shall be guilty of a
misdemeanor,
punishable by a fine of not more than 1,000 dollars or by imprisonment not exceeding
one year, or both such fine and imprisonment. Each day that a violation continues after
due notice has been served shall be deemed a separate offense.
114.4 Failure to comply. Any person who shall continue any work after having been
served with a stop work order, except such work that a person is directed to perform to
remove a violation or unsafe condition, shall be liable to a fine of not less that
[AMOUNT] dollars or more than [AMOUNT] dollars guilty of a misdemeanor,
punishable by a fine of not more than $1,000 or by imprisonment not exceeding
one year, or both such fine and imprisonment.
903.2.7 An automatic sprinkler system installed in accordance with Section 903.3 shall
be provided throughout all buildings with a Group R fire area. Exception: One- and
Two-family dwellings unless otherwise required based upon fire flow,fire
apparatus access to include "gated communities", or other life safety hazard as
deemed by the fire code official.
3204.3.1.1 Location. Stationary containers shall be located in accordance with Section
3203.6. Containers of cryogenic fluids shall not be located within diked areas
containing other hazardous materials.
Storage of flammable cryogenic fluids in stationary containers
outside of buildings is prohibited except in those areas zoned
Industrial.
3403.1.4 Locations where above-ground tanks are prohibited. Storage of Class I and
II liquids in aboveground tanks outside of buildings shall be prohibited except in
those areas zoned Industrial, Commercial, Agricultural, and PUD subject to the
approval of the fire code official.
3406.3.1 Location. The location of wells shall eomply with Sections 3106.3.1.1
through
3406.3.1.3.2. oil and natural gas operations shall be in accordance with Safety
Regulations of the Colorado Oil and Gas Conservation Commission. Setbacks
contained therein shall apply to new and existing oil and natural gas operations.
Delete Sections 3406.3.1.1, 3406.3.1.2, 3406.3.1.3, 3406.3.1.3.1, 3406.3.1.3.2.
3804.3.2 Containers used to fuel structures shall be prohibited where a natural gas
utility is available for such purposes within 1000 feet of the structure.

Bruce has forwarded your request to me.
The policy of the Board of County Commissioners has been to have a short work session to discuss the
amendments you have adopted and to review the steps you have taken to notify the public of the new version of
the fire code.
To that end, we will need copies of a publication of meetings. In addition, we will need a copy of your Board's
minutes signifying both that they have adopted the code, and that members of the public within your district have
received notice of the changes and have had an opportunity to be heard.
Once I have the necessary documentation, I can set this for a work session and can put it on the agenda for the
following Board meeting.
If you have any questions, please give me a call.
