HomeMy WebLinkAbout20081528.tiff RESOLUTION RE: ACTION OF BOARD CONCERNING ORAL ARGUMENTS FOR APPEAL OF PLANNING COMMISSION DENIAL OF A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1629 FOR A MAJOR FACILITY OF A PUBLIC UTILITY OR PUBLIC AGENCY(ELECTRICAL SUBSTATION), SUBJECT TO THE PROVISIONS OF SECTION 23-4-420 OF THE WELD COUNTY CODE, IN THE A(AGRICULTURAL)ZONE DISTRICT- A. DALE SALTER TRUST B/ UNITED POWER, INC. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 21st day of May, 2008, at the hour of 9:00 a.m., in the Chambers of the Board for the purpose of hearing oral arguments for appeal of A. Dale Slater Trust B, 13433 County Road 7, Longmont, Colorado 80504, and United Power, Inc.,500 Cooperative Way, P.O. Box 929, Brighton, Colorado 80603, regarding the Planning Commission denial of a Site Specific Development Plan and Use by Special Review Permit#1629 for a Major Facility of a Public Utility or Public Agency(electrical substation), subject to the provisions of Section 23-4-420, in the A (Agricultural) Zone District, on the following described real estate, to-wit: SE1/4 of Section 28, Township 3 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board heard all of the testimony and statements of those present and reviewed the request of the appellant, and WHEREAS, pursuant to the Weld County Home Rule Charter, Article 3, Section 3-13, the concurrence of three of the members of the Board is required to approve a Resolution, and WHEREAS,the motion to deny the jurisdiction to hear the appeal based on arguments from counsel was made and seconded by Commissioners Rademacher and Garcia,with Commissioners Long and Masden opposed,which resulted in a tie vote in the absence of Commissioner Jerke, and WHEREAS, at said hearing the Board deemed it advisable to continue said matter to June 4, 2008, at 9:00 a.m., to allow adequate time for Commissioner Jerke to review the record and make a determining vote regarding the Board's jurisdiction to hear the appeal.
