RE: AUTHORIZATION TO WAIVE PORTION OF BUILDING PERMIT AND PLAN CHECK
FEES FOR TORNADO EMERGENCY DISASTER REPAIRS AND RECONSTRUCTION
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on May 22, 2008,multiple tornados touched down in Weld County, causing
substantial property damages to buildings that will require repair or reconstruction in order to
occupy, and
WHEREAS, on May 22, 2008, the Board declared Weld County to be in a state of
emergency disaster, pursuant to Section 24-32-2101, C.R.S., et. seq. (the "Colorado Disaster
Emergency Act of 1992"), and Title VI of PL 93-288, as amended, The Robert T. Stafford Disaster
Relief and Emergency Assistance Act, and
WHEREAS,in response to said tornado disaster emergency,the Board desires to authorize
the waiver of fees charged by the Department of Building Inspection for building permits for the
repair or reconstruction of buildings damaged by the tornado disaster, limited to fifty percent(50%)
of the normal building permit fee, with a minimum fee of$21.00, and no fee charged for the plan
check.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Department of Building Inspection be, and hereby is, authorized to
waive fifty percent(50%) of the normal building permit fee, with a minimum fee of$21.00, and no
fee charged for the plan check, for building permits for the repair or reconstruction of buildings
damaged by the tornado disaster.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 28th day of June, A.D., 2008.
