1. A building permit shall be obtained prior to the construction of any new building.
2. A plan review is required for each building for which a building permit is required. Plans shall include a floor plan.
Building plans are required to bear the wet stamp of a Colorado registered architect or engineer.

Mechanical Code; 2006 International Plumbing Code; 2006 International Fuel Gas Code; and the 2005 National
Electrical Code and Chapter 29 of the Weld County Code.
4. The new building will probably be classified as a S-1 (Repair Garage).The maximum amount of indoor and outdoor
storage of nonflammable solids and nonflammable and non combustible liquids shall not exceed the amounts in
Table 414.2.4 of the International Building Code. The building including the bathrooms shall be accessible to persons
with disabilities. Fire resistance of walls and openings, construction requirements, maximum building height and
allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning
Ordinance.
5. Building height shall be measured in accordance with the 2006 International Building Code for the purpose of
determining the maximum building size and height for various uses and types of construction and to determine
compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. Building height shall be
measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and
setback requirements. Offset and setback requirements are measured to the farthest projection from the building.
6. Provide letter of approval from Platteville Fire Protection District prior to applying for a building permit.
7. There is one building permit with final status on record for this parcel.

Subject: USR-1648 Referral
Upon review of my case files and computer, an active Zoning Violation (ZCV07-01079)was noted. This
violation was initiated due to the operation of a commercial tree trimming operation and associated
commercial storage without first obtaining the necessary Weld County Zoning Permits. This case has not
been presented to the Board of County Commissioners through the Violation Hearing process.
This application if approved by the Board of County Commissioners will correct the violation. If this
application is denied, please ask the Board of County Commissioners to refer this case to the County
Attorney's Office, but to delay legal action for 30 (thirty) days in order to give them adequate time to
ensure that all storage, operations and advertisements have been removed from the property.

Environmental Health Services has reviewed this proposal for a tree trimming business
and parking of vehicles associated with the business. There are no employees
associated with the business, other than the two applicants who live on the property.
Water is supplied by Central Weld County Water District and an Individual Sewage
Disposal System (SP-96-00291) provides sewer for the site. The application states that
"minimal wood splitting operations" will occur. Noise from the wood splitting operation
should comply with noise standards as designated for the light industrial zone district
which is 70 dba from 7 a.m. to 7 p.m. The application briefly mentions maintenance of
equipment. Maintenance of equipment shall be done in such a manner as to produce
zero discharge to the environment. If the vehicle maintenance facility is equipped with a
floor drain, a Class V Injection Well permit from the Environmental Protection Agency
• (EPA) is required.
We have no objections to the proposal, however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
Environment.
2. In the event washing of vehicle will occur on site the applicant shall ensure that
any vehicle washing area(s) shall capture all effluent and prevent discharges
from the washing of vehicles in accordance with the Rules and Regulations of the
Water Quality Control Commission, and the Environmental Protection Agency.
Vehicle washing areas should be designated on the plat.
3. The applicant shall submit evidence of an Underground Injection Control (UIC)
Class V Injection Well permit from the Environmental Protection Agency (EPA)
for any vehicle maintenance facility located on the site that is equipped with a
floor drain. Alternately, the applicant can provide evidence from the EPA that
•
they are not subject to the EPA Class V requirements. (EPA rule effective
4/5/2000).
4. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
• 2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions. The facility shall be operated in accordance with the
approved dust abatement plan at all times.
4. This facility shall adhere to the maximum permissible noise levels allowed in the
Light Industrial Zone as delineated in 25-12-103 C.R.S., as amended.
5. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
6. Vehicles shall not be parked on the Individual Sewage Disposal System.
7. The facility shall utilize the existing public water supply. (Central Weld County
Water District)

• 8. If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
9. The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS AND REQUIREMENTS:
Weld County Road Classification Plan (FEW): (June 2003)
WCR 19 is a collector road and requires an 80-foot right-of-way at full build out. There is presently a 60-foot
right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning (23-1-90), the required setback is measured from the future right-of-way line.

ilistricted by zoning or subdivision regulations. Additional accesses may be approved by the Department of
Public Works or the Board of County Commissioners. This policy shall apply to all new and existing accesses
within the unincorporated areas of the County. Properties within municipalities or other counties which access
County roads are subject to this policy.
Access: Existing access will be utilized. Please close the southern most access.
A 40' radius is required on all accesses to public roads for accesses designed to accommodate truck traffic. {A
minimum effective turning radius of forty (40) feet shall be used for accesses intended to accommodate truck
traffic. (Weld County Codification Ordinance 2000-1)} Sec. 8-2-40 B. Road access design standards.
Storm Water Drainage:
The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will
reasonably preserve the natural character of the area and prevent property damage of the type generally
attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm
run-off.
The applicant must take into consideration storm water capture/quantity and provide accordingly for best
management practices.
Please provide a water quality feature to capture the water quality capture volume for buildings, drives, and
other impervious areas.
