HomeMy WebLinkAbout20083174.tiff RESOLUTION RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION ZCV #0800218 AGAINST LYLE AND WILMA HAMILTON FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Lyle and Wilma Hamilton,ZCV#0800218,are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 9th day of December,2008,a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Lyle and Wilma Hamilton were not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board deems it advisable to refer the case back to the Department of Planning Services. No pictures were taken during this inspection. 09/23/2008 Office Visit Lyle Hamilton (303-857-2742) came into the Greeley Planning Office (as a walk-in). He said he just received my letter and said he knew who turned him. I explained that I could validate who initiated the complaint. He said Kevin Rupp called him and told him he turned him in. I again said I could not validate who initiated the complaint. He said he knew. I mentioned the derelict vehicle. He said that vehicle has current plates. I asked if it works. He said he can make it work. I said that would fix that part. He said the part I have the biggest problem with is the box. He said he brought that in when he purchased the property. I explained that in order for it to be "grand-fathered" it would have to have been there prior to 1972. He asked how some other other people have storage unit. I explained the difference between a box off of a delivery style truck and a semi trailer. I explained that it would need to remain on the wheels and maintain a current license plate. I printed out the whole Agricultural section of the Weld County Code. I also printed out the section pertaining to semi trailers as a storage unit. He said, but it"s not a semi trailer. I explained that is why the property was in violation. I explained that it would have to meet the criteria called out under the semi trailer as a storage unit section of the code in order to be able to be permitted. He said he didn"t know how he was going to do that. He walked out. I caught his attention long enough to get his phone number(303-857-2742). He said alot of good it will do you, no one is ever there. I asked about an answering machine. He said it broke. He left. 10/10/2008 Property Inspected Upon a visual inspection of the property, the following items were noted: wood, iron/metal and a box off of a box truck. Other than that the property is looking pretty good. Making progress.
