Our comments and requirements are as follows: COMMENTS: WCR 39'/2 is designated on the Weld County Road Classification Plan (FHU) as a paved road, which requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. The road is maintained by Weld County. This road is located north of WCR 64 ("O" Street) and serves industrial and commercial uses. REQUIREMENTS: • Access Approach and Internal Road System: The applicant indicated that crushed concrete was placed on the access and the internal road system throughout the stockpile/loading area including the 50-foot turnaround cul-de-sac. We are agreeable to this proposal; however, if there are dust complaints in using crushed concrete, a dust abatement alternate should be in place. Storm Water Drainage: The applicant's drainage engineer, Picket Engineering, has provided a drainage study for the site. The sedimentation basin and storm water filter system was installed with an outlet type daylighting to an open channel to the Eaton Draw Drainage System. Off-Street Loading: The off-street loading spaces shall be surfaced with gravel, asphalt, or concrete and shall be graded to prevent drainage problems. Access Width: The access width requirement for emergency equipment (fire department) is usually 20 feet. The applicant should verify and provide Public Works with the local fire department/ emergency services that the width of the access and lane is adequate for emergency response purposes. . Haul Route: The designated haul route is from the Anderson Salvage site west on State Highway 263 north on U. S. Highway 85 east on "O" Street north on WCR 39.5, and east to the railroad car loading area.. CT. 501 UNION PACIFIC RAILROAD DATE: 06/12/2008 COLORADO Environmental Health Services has reviewed this proposal for the addition of a rail car loading area to the existing facility. This Department has no objection to this proposal; however, we have concerns about original application requirements that have not been adhered to. Specifically the use of portable toilets for employees. Development standard 12 of USR-1501 states: "Adequate handwashing and toilet facilities shall be provided for employees. A conventional septic system or a permanent vaulted restroom facility (similar to a rest area or park service) shall be provided for employees." It appears that the applicant has been using a portable toilet, which is not allowed per the existing USR. County policy allows portable toilets for temporary uses, 6 months or less. This year- • round facility operates Monday through Friday from 8 am - 5 pm, with up to five individuals on the site at one time. This Department realized that employees would likely be on site for short periods of time for loading and unloading purposes. With this in mind, Environmental Health stipulated a permanent vaulted sewage disposal system with a handwash station and an audible and/or visual alarm on the vault for maintenance as an alternative to a standard septic system as a condition of USR-1501. The use of bottled water was not allowed per USR-1501. Development standard 13, of USR-1501, states: "North Weld County Water District is able and intends to provide water service to the site." Environmental Health does not support the use of bottled water as this is not a temporary use. The conditions of approval and development standards that were approved with USR- 1501 are still applicable to AMUSR-1501. We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit a dust abatement plan for review and approval, to Environmental Health Services, Weld County Department of Public Health & Environment. The plan shall include an alternative plan for crushed concrete if there are related dust complaints. • • 2. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as a condition that must be met prior to issuance of building permits: 1. A stormwater discharge permit may be required for a development/redevelopment/construction site where a contiguous or non- contiguous land disturbance is greater than or equal to one acre in area. Contact the Water Quality Control Division of the Colorado Department of Public Health and Environment at www.cdphe.state.co.us/wq/PermitsUnit for more information. We recommend that the following requirement be incorporated into the permit as a • condition that must be met within 10 days of recordation of the plat. The submission of a septic permit application will satisfy the 10 day requirement: 1. An individual sewage disposal system is required (a vault system with a handwash station is an option) and shall be installed according to the Weld County Individual Sewage Disposal Regulations. We recommend that the following requirements be incorporated into the permit as development standards. These development standards are the same items that were approved with USR-1501. 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. • 2 • 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan". 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan at all times. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in 25-12-103 C.R.S., as amended. 7. Adequate handwashing and toilet facilities shall be provided for employees. A conventional septic system or a permanent vaulted restroom facility (similar to a rest area or park service) shall be provided for employees. 8. North Weld County Water District is able and intends to provide water service to the site. 9. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control • Division. 10.The operation shall comply with all applicable rules and regulations of the State and Federal agencies and the Weld County Code. • 3 rstr;„„) Weld County Referral ' May 16, 2008 C.
