RESOLUTION RE: APPROVE COURT SECURITY GRANT APPLICATION AND AUTHORIZE CHAIR TO SIGN - COLORADO OFFICE OF THE STATE COURT ADMINISTRATOR COURT SECURITY CASH FUND WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board has been presented with a Court Security Grant Application between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County,on behalf of the Weld County Sheriff's Office, and Colorado Office of the State Court Administrator Court Security Cash Fund, commencing upon full execution, with further terms and conditions being as stated in said grant application, and WHEREAS, after review, the Board deems it advisable to approve said grant application, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Court Security Grant Application between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Sheriffs Office, and Colorado Office of the State Court Administrator Court Security Cash Fund be, and hereby is, approved. WELD COUNTY SHERIFF'S OFFICE PROCEDURES r1�5�E r •, � " ') JAIL MANUAL COLD 1, DIRECTIVE NO: 2.2.13 EFFECTIVE DATE: April 1, 1999 TITLE: Court House Security REFERENCES: District Court Order, Judge William West, Div I, 94CV419 GUIDELINE Unless exempted, all persons entering the court house pass through the perimeter security screening. Entry to and exit from the court house is restricted to the south and east entrances. The north and west entrances are secured from outside access and are maintained as emergency fire exits with audible alarms. The security screening is intended to eliminate and control ferrous metal weapons and firearms entering the court house. The security staff are authorized to use detection, deterrence, and verbal instructions/commands. The sheriffs deputies provide further enforcement actions. DEFINITIONS: Code 4: A radio signal transmitted by personnel on scene at a"Code 5" to inform responding personnel no further assistance is required. Code 5: An emergency-in-progress radio signal resulting in armed response to the court house by sheriffs deputies. A "Code 5" signal is transmitted on the jail radio system by broadcasting "Code 5, (specific location in court house), (nature of emergency)." The person reporting an "Code 5" will provide updated information using the portable radio as circumstances allow. Weapons: 1) Firearms of any type; or, 2) Ballistic knife--any knife that has a blade which is forcefully projected from the handle by means of a spring-loaded device or explosive charge; or, 3) Blackjack, baton, club--means any billy, sand club, or other hand-operated striking weapon; or, 4) Knife--any dagger, dirk, knife or stiletto with a blade over three and one- half inches in length or any other dangerous instrument capable of cutting, stabbing, or tearing wounds including,but not limited to, marshal arts throwing stars, etc. 5) Explosives, explosive devices, including, but not limited to, timing devices with wiring, chemical compounds, or any chemical device which is not specifically designed or intended for lawful or legitimate use in the hands of its possessor; or, 6) Stun gun or chemical agent--any device capable of temporarily immobilizing a person by the infliction of an electrical charge or chemical agent including,but not limited to, CS or CN gas or oleoresin capsicum (pepper mace). Exception: Personal protection OC carried by Staff/Support personnel is not considered a weapon in this definition. Security Screening Staff: Persons assigned to follow court house security procedure and operate security screening equipment. Security screening staff will wear a uniform. Generally, security screening staff are employees of a private security agency and as such are not peace officers and have no law enforcement authority or responsibilities. Security Screening Point: Walk-through ferrous metal detector, hand-held ferrous metal detector, x-ray unit, portable radio on jail radio frequency, and security officer. Staff/Support: Judges, courthouse employees, District Attorney and Deputy District Attorneys, Public Defender's Office attorneys, Weld County Attorney's Office attorneys, Weld County Probation Officers, Weld County Buildings and Grounds employees and sheriffs deputies not in Section 2.2.13 July 31, 2008 Page 2 WELD COUNTY SHERIFF'S OFFICE PROCEDURES uniform on county business. Exempted: Sheriffs deputies in uniform and escorting prisoners or responding to an emergency in the court house. Registration: Process where a peace officer carrying any weapon defined in this directive must be identified by agency issued photo-identification, sign in and out in a log book, and display a tag issued by the security screening staff. Peace Officer: Persons certified as a peace officer by the State of Colorado and appointed by an agency as a peace officer. Restricted List: Document identifying what peace officers are appearing before the court in matters unrelated to the peace officer's duties. The document is prepared by a jail manager when a jail manager is notified by any source of such an appearance. Examples include, but are not limited to, divorce actions, civil litigation, etc. Peace officers on the restricted list are not authorized to possess any weapon, as defined by this directive, beyond the perimeter security screening point. PROCEDURE I: Court House/North Jail Complex Division VI I. With the exception of exempted persons, each individual entering the court house is screened. Only the general public entering the Division VI viewing/hearing room, however, are screened. The screening procedures are listed below. A. Exempted persons: (Sheriffs deputies in uniform and escorting prisoners or responding to an emergency in the court house)Allowed to enter without stopping at the perimeter screening point, displaying identification, or registering. B. Staff/support persons: Individual's photo-identification card (issued by their respective agency) checked to confirm their identity. Once the identity is confirmed, staff/support are directed to enter the court house without passing through the security screening equipment. C. General Public: 1. Unarmed: Large items are placed on the belt of the x-ray unit at the Court House. Pocket items are placed in a small tray, handed to the screening officer prior to walking through the arch metal detector. Section 2.2.13 July 31, 2008 Page 3 WELD COUNTY SHERIFF'S OFFICE PROCEDURES Division VI has no x-ray. Pocket items need to be secured in coin- operated lockers in the North Jail Complex Lobby. Persons step into the revolving metal detector door or press a green button and step into detector when the door begins rotating. a. X-ray images are checked passing through the x-ray unit for weapons or suspicious materials. (1) If the x-ray discloses a weapon or suspicious material, master control is notified. (2) If the items are clear of weapons or suspicious material, the items are returned when the individual is cleared through the screening process. b. If the individual does NOT set off the screening system, belongings are returned. c. If the individual sets off the screening device, a hand-held screening device is used to check for a ferrous metal weapon or firearm. 2. Armed: direct individual(s)to secure the weapon(s) in their vehicle and to reenter the line for process through the screening system. NOTE: Any individual possessing illegal weapons, failing to comply with request to secure weapon, or incidences of possible criminal activity will be immediately reported to master control. D. Peace officers Entering Court House: The photo-identification card is checked against the daily restricted list provided by the court. If the peace officer is 1. Restricted and unarmed: The officer is processed through the screening system in the same manner as the general public. 2. Restricted and armed: The officer is directed to secure the weapon in his/her vehicle or at the Sheriffs Office lobby weapons locker by the 111 door. Section 2.2.13 July 31, 2008 Page 4 WELD COUNTY SHERIFF'S OFFICE PROCEDURES 3. Not on the list and unarmed: The individual is checked against the displayed, current photo-identification card issued by their respective agency. Once the identity is confirmed, the officer is directed to enter without passing through the security screening equipment. (Process as staff/support persons) 4. Not on the list and armed: Officers are registered on a log for armed peace officers. a. Officers are required to print their name and agency in the registration log. b. The screening officer countersigns the officer's entry, affixes the current date and time, and records the number of an "A" tag. c. An "A" tag is issued and prominently displayed on the armed individual. e. Peace Officers Entering Division VI: The officer presses the master control intercom at the controlled door adjacent to the automated metal detector in the Public Lobby. I. Master control informs the officer firearms are not authorized past that point. (1) Armed officer's are directed to pass through the wood lobby door into the Probation Department area and deposit the weapon the gun lockers in the back hallway just outside the secure perimeter. (2) If the front counter is not staffed to open the lobby door to the gun locker, the officer should be directed to use the lobby telephone, call master control, and obtain the electronic lock combination. ii. Master control allows professional and peace officer access through the controlled door. PROCEDURE II: Court House Exit Exempted, Staff/Support, General Public, Unarmed Peace Officers: Unrestricted exit. Section 2.2.13 July 31, 2008 Page 5 WELD COUNTY SHERIFF'S OFFICE PROCEDURES II. Not on the list and armed: The peace officer returns the issued "A" tag to the screening officer and signs the log book. A. The screening officer verifies the number on the "A" tag is the same tag issued, countersigns, affixes current date and time, and clears the officer to depart. B. Completed logs are provided to the jail manager at the close of each business day. PROCEDURE III - Court House Admission 1. Court clerks and Court Administrator control after hour access.
