PHONE I(970) 353-6100, EXT. 3549 COLORADO FAX (970) 304-6498 December 22, 2008 Dale Butcher Conquest Oil Company 1610 29th Place, Suite 200 Greeley, CO 80634 Subject: Request of consideration for the C2 Well (USR-1033) Request of consideration for the C3 Well (2AmUSR-1198) Request of consideration for the C4 Well (AinCJSR=729)1 Dear Dale: The Department of Planning Services and Department of Public Health and Environment have reviewed your request to utilize additional tanks at each of the above referenced facilities and - have the following comments: From our perspective, the Planning Department does not view the addition of the tanks nor the modification of construction materials as a substantial change. The Department of Environmental Health and ultimately the Department of Building Inspection requests a building permit application, associated documents and site specific engineered drawings prepared as follows: Conquest will be required to submit the formal engineer designed containment system to the Department of Environmental Health for review prior to the issuance of building permits. At a minimum, the containment system should meet the following condition: A concrete secondary containment structure (floor and walls) surrounding each tank or battery of tanks shall be constructed. The volume retained by the structure shall be 150% greater than the volume of the largest tank inside this structure. A registered professional engineer shall design the structure. The structure shall prevent any release from the tank system from reaching land or waters outside of the containment area. The operator shall provide evidence from the • pi_o a3q engineer to the Weld County Department of Public Health and Environment (WCDPHE) indicating that the structure has been constructed to meet this criterion. The Department of Building Inspection will require the following information at time of application submittal. The forms are enclosed. 1.] A building permit application must be completed and two complete sets of plans including engineered foundation plans bearing a wet stamp of a Colorado registered architect or engineer must be submitted for review. A geotechnical engineering report performed by a registered State of Colorado engineer shall be required. The current codes are 2006 International and 2008 National Electrical Codes. 2.] A letter from the Fire Protection District is required prior to submittal of plans for review. A plan review shall be approved and a permit must be issued prior to the start of construction. 3.] Buildings shall conform to the requirements of the 2006 International Building, Residential, Mechanical, Fuel Gas, and Energy Conservation Codes and the 2008 National Electrical Codes and Chapter 23 of the Weld County Code. Given the determination of this office, the modifications to each of the referenced injection well sites have been deemed not a substantial change and as such no further land use permitting processes will be required. Planning Staff requests that a new Site Plan drawing be prepared and submitted to this office for the case file. If in the future, should additional modifications be proposed, please contact this office for a determination before proceeding. Thank you for your assistance. The four tanks would be placed within a new concrete berm which would be professionally engineered to hold more than 150%of the largest tank within the berm.
