RE: APPROVAL OF SPECIAL EVENTS PERMIT ISSUED TO THE DENVER FOUNDATION,
C/O THE ROTARY CLUB OF MEAD, AND AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,The Denver Foundation, do The Rotary Club of Mead presented to the Board
of County Commissioners of Weld County, Colorado, an application for a Special Events Permit
for the sale of malt, vinous and spirituous liquors for consumption by the drink on the premises
only, and
WHEREAS,said applicant has paid the sum of TWENTY-FIVE DOLLARS($25.00)to Weld
County, Colorado, pursuant to the laws providing therefore in payment for a County Retail Permit
for the sale of malt, vinous and spirituous liquors for consumption by the drink on the premises
only,for an event scheduled for one day only on September 27, 2008,from 9:00 a.m. to 7:00 p.m.,
outside the corporate limits of any town or city in the County of Weld at the location described as
follows:
6105 Weld County Road 32, Platteville, Colorado
80651, being more fully described as the SW1/4 of
Section 18, Township 3 North, Range 67 West of the
6th P.M., Weld County, Colorado
WHEREAS, said applicant has also paid the sum of TWENTY-FIVE DOLLARS ($25.00)
to the Colorado Department of Revenue and has exhibited a State Special Events Permit for the
sale of malt, vinous and spirituous liquors for consumption by the drink on the premises only.
NOW,THEREFORE, BE IT RESOLVED that the Board of County Commissioners of Weld
County, Colorado, having examined said application and the other qualifications of the applicant,
does hereby grant Special Events Permit Number#2008-15 to said applicant to sell malt, vinous
and spirituous liquors for consumption by the drink on the premises only, only at retail at said
location; and the Board does hereby authorize and direct the issuance of said permit by the Chair
of the Board of County Commissioners, attested to by the Clerk to the Board of Weld County,
Colorado, which permit shall be effective from 9:00 a.m. to 7:00 p.m., on September 27, 2008,
providing that said place where the permitee is authorized to sell malt,vinous and spirituous liquors
for consumption by the drink on the premises only, shall be conducted in strict conformity to all of
the laws of the State of Colorado and the rules and regulations relating thereto, heretofore passed
by the Board of County Commissioners of Weld County, Colorado, and any violations thereof shall
be cause for revocation of the permit.

RE: Mead Sugarbeet Festival
Dear Commissioners,
Nick Sekich has been appointed the chair person for the 3r°Annual Sugarbeet Festival to
be hosted by The Mead Rotary Club. This event is to be held on September 271°,2008
on the Sekich property. The Mead Rotary Club will be the legal permit holder for this
event. We have applied for the necessary paperwork and we are again asking for a
deference of the performance bond listed in Section 12-1-30 of the Weld County Code
because Butch will again be cleaning up on his own property.
We have applied for insurance for the event and we will fax or email this binding of
coverage when we receive it from the agency.
We invite the Weld County Commissioners to participate in this years Festival with an
informational booth and attendance at the event. We will waive the booth fee if you want
to take part in the event.

Jennifer,
I'm sorry I should have known the differences in the 2 foundation names would be confusing. The Rotary Club of
Mead is a sub foundation of the Denver Foundation. We are working together on a water project in the cities of
Los Pinares, Miraflor& Barrio Nuevo, Nicaragua -the proceeds from our event will be used in conjunction with the
Denver Foundation funds to provide capital for the entire project.
I hope that helps-as far as something in writing, we really don't have anything more than the contract with The
Rotary Club of Mead and Agua Para La Vida the administrator of all 3 projects.
Could you please let me know if that will be sufficient or if there are other items that you would still need.

Do you have any documentation which provides the correlation the Mead Rotary Club and the Denver
Foundation?The State might ask for documentation and/or clarification. Let me know if you have anything that
could be submitted to explain the relationship.

This letter is in response to your telephone request on May 31,2002,for a copy of your organization's
determination letter. This letter will take the place of the copy you requested.
Our records indicate that a determination letter issued in January 1943 granted your organization exemption
from federal Income tax under section 501(c)(3)of the Internal Revenue Code. That letter is still in effect.
Based on information subsequently submitted,we classified your organization as one that is not a private
foundation within the meaning of section 509(a)of the.Code because it Is an organization described in sections
509(a)(1)and 170(b)(1)(A)(vi).
This classification was based on the assumption that your organization's operations would continue as stated
in the application. If your organization's sources of support,or Its character,method of operations,or purposes
have changed,please let us know so we can consider the effect of the change on the exempt status and
foundation status of your organization.
Your organization is required to file Form 990, Return of Organization Exempt from Income Tax,only if its
gross receipts each year are normally more than$25,000: If a retum is required,It must be filed by the 15th
day of the.fifih:fnonth after the end,of the organization's annual accounting period. The law imposes a penalty
of$20 a day,up to a maximum of$10,000;when a return is filed late,unless there is reasonable cause for the
delay.
All exempt organizations(unless specifically excluded)are liable for taxes under the Federal Insurance
Contributions Act(social security taxes)on remuneration of$100 or more paid to each employee during a
calendar year. Your organization is not liable for the tax imposed under the Federal Unemployment Tax Act
(FUTA).
Organizations that are not private foundations are not subject to the excise taxes under Chapter 42 of the
Code. However,these organizations are not automatically exempt from other federal excise taxes.
Donors may deduct contributions to your organization as provided in section.170 of the Code. Bequests,
legacies,devises,transfers,or gifts to your organization or for its use are deductible for federal estate and gilt
tax purposes if they meet the applicable provisions of sections 2055,2106,and 2522 of the Code.

Your organization is not required to file federal income tax returns unless it is subject to the tax on unrelated

income tax return on the Form 990-T, Exempt Organization Business Income Tax Return.-In this letter,we are
not determining whether any of your organization's present or proposed activities are unrelated trade or
business as defined in section 513 of the Code.
The law requires you to make your organization's annual return available for public inspection without charge
far three years after the due date of the return. If your organization had a copy of its application for recognition
of exemption on July 15, 1987,it is also required to make available for public inspection a copy of the
• exemption application,any supporting documents and the exemption letter to any Individual who requests such
documents in person or in writing. You can charge only a reasonable fee for reproduction and actual postage
costs for the copied materials. The law does not require you to provide copies of public Inspection documents
that are widely available, such as by posting them on the Internet(World Wide Web). You may be liable for a
penalty of$20 a day for each day you do not make these documents available for public Inspection(up to a
maximum of$10,000 in the case of an annual return).

Bruce,
I contacted Nick Sekich to request that he provide a photograph of the posted notice sign on his property, as I previously
requested when he picked up the sign, for the Special Events Permit hearing held last Wednesday(a representative did not
come to the meeting). He indicated in a phone mail message to me today that he does not have a photo of the sign, and
that the sign is no longer posted at the property, as it was removed the day of the hearing.
How do we proceed in this instance?
