It is the Department's understanding that this facility is currently in operation. A mobile home is currently on the property and is proposed for use for a full-time caretaker (G19940127). A house is also located on the property for the applicants' residence (G19939108, a Statement of Existing). All structures are in place and no new construction is proposed. The facility will employee 3 people in addition to the family. Visitors are anticipated to vary from 2 to 10 per week. Employees and visitors must have access to restroom and handwashing facilities. There was no mention of how the daily sanitation of the kennel and/or supplies (bowls, bedding, etc) are handled in the application. Either a septic system will need to be installed at the kennel or one of the • existing homes' restrooms must be made available for use. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: The following requirements are recommended to be met prior to allowing the plat to be recorded: 1. The applicant shall submit a dust abatement plan for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. 2. The applicant shall provide written evidence to the Weld County Department of Public Health and Environment that the applicant has contacted the Colorado Department of Agriculture (CDA), Division of Animal Industry. This contact shall determine if a license under the Pet Animal Care Facilities Act (PACFA), as defined under C.R.S. 35-80-101 through 117. C.R.S. is required, or provide evidence that the applicant is not subject to the PACFA requirements. 3. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: • EXHIBIT 2008-0939 8 `1 1) A list of wastes which are expected to be generated on site (this should • include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). 4. In the event the applicant intends to utilize the existing septic system at one of the homes for employee, visitor and kennel sanitation needs, the applicant shall specify which residence shall be made available for use. Additionally, that septic system shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load from the resident's occupants and employees and visitors. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. 5. Alternately to item #4 above, the applicant shall install an individual sewage disposal system for the proposed employee, visitor and kennel sanitation needs • and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 6. A stormwater discharge permit may be required for a development/redevelopment/construction site where a contiguous or non- contiguous land disturbance is greater than or equal to one acre in area. The applicant shall inquire with the Water Quality Control Division (WQCD) of the Colorado Department of Public Health and Environment at www.cdphe.state.co.us/wq/PermitsUnit if they are required to obtain a stormwater discharge permit. Alternately, the applicant can provide evidence from WQCD that they are not subject to these requirements. We recommend that the following requirements be incorporated into the permit as development standards: 1. Animal and feed wastes, bedding, debris and other organic wastes shall be disposed of so that vermin infestation, odors, disease hazards, and nuisances are minimized. Such wastes shall be removed at least weekly from the facility and disposed by a commercial hauler. • 2 • 2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and • Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 3. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 4. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 5. The applicant shall operate in accordance with the approved "waste handling plan". 6. The applicant shall comply with the Colorado Department of Agriculture (CDA), Division of Animal Industry, if applicable. 7. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan at all times. • 8. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103 C.R.S., as amended. 9. Adequate handwashing and toilet facilities shall be provided for employees and patrons of the facility. 10.Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 11.The facility shall utilize the existing public water supply. Our comments and requirements are as follows: COMMENTS: Weld County Road Classification Plan (FHU): (June 2002) WCR's 40 & 33 are local gravel roads and require a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. These roads are maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. REQUIREMENTS: Direct access from a public road will be limited to one (1) per legal parcel, except as further limited or restricted by zoning or subdivision regulations. Additional accesses may be approved by the Department of Public Works or the Board of County Commissioners. This policy shall apply to all new and existing accesses within e unincorporated areas of the County. Properties within municipalities or other counties which access ounty roads are subject to this policy. Please close the center or most eastern access point and designate the western most access point on the plat as Agricultural/Oil and Gas use only. A 40' radius is required on all accesses to public roads for accesses designed to accommodate truck traffic. {A minimum effective turning radius of forty (40) feet shall be used for accesses intended to accommodate truck traffic. (Weld County Codification Ordinance 2000-1)} Sec. 8-2-40 B. Road access design standards. This area is NOT in FEMA Flood Zones. A water quality capture/10 year detention pond is required for the site (disturbed portion, ie: buildings, graveled areas, etc.) conforming to Weld County Drainage Standards designed by a Colorado Registered Professional Engineer. Agreements with adjacent land owners will be required if the pond discharges onto adjacent properties. The adjacent land owners must agree to accept the quantity and nature of discharge. In addition to these requirements, the plat scale shall be 1" = 20 feet. The Vicinity Map scale of 1" = 2000 feet scale accurately be delineated on the plat. The applicant is proposing to kennel up to 200 dogs over the age of 6 months. Additional information shall be provided stating their typical daily requirements, including approximate • square footage of the facility, housing (bedding), levels of acceptable noise and dietary requirements. The applicant's USR Map delineates limited fencing on site predominately at the perimeter with the three structures associated with the kennel facility. The existing single family residence, garage, metal barn, tool shed and mobile home, presently permitted as an accessory to the farm, [ZPMH 2315] all are sited west of the kennel. Parking for this facility is based on square footage of structures associated with the kennel per Appendix 23-A and B. Staff identified Structure 1 as the primary structure having 960 SF. It is unclear if Structures 2 and 3 are part of the kenneling facility. Therefore, staff requests additional information on this point. Staff will require the site to meet all ADA standards, specific to accessibility, parking, signage et cetera. At a minimum, staff will require one space for each employee, three total; one space for Structure 1, Kennel; two spaces for Structure 4, mobile home; one non-ambulatory space to address the ADA component and two customer spaces for potential clients. Total minimum parking for this facility is nine (9) spaces. The parking shall be delineated on the plat. The application does not provide information concerning the date of construction for all on-site structures. As there is a change in use, the Department of Building Inspection shall be contacted to verify how the structure was permitted and if there are any building related issues that should be addressed. The application states that domestic water is obtained from Central Weld County Water District. • As this is technically a commercial endeavor, verification of a commercial tap should be obtained from the water district. The application states that there is a leach field on site. Wastes are disposed of through a refuse hauler. Section 23-3-250.A.6 states "Areas used for trash collection shall be screened from public rights-of-way and all adjacent properties. These areas shall be designed and used in a manner that will prevent wind- or animal-scattered trash." It is unclear from the applicant's drawing whether the trash collection area is screened from the public rights-of-way and adjacent properties. Written and /or graphic evidence shall be submitted to the Department of Planning Services for review and approval. Section 23-3-250.6 addresses Operation Standards. Section 23-3-250.B.6 addresses the issues of Light. "Any lighting, including light from high temperature processes such as welding or combustion, shall be designed, located and operated in such as manner as to meet the following standards: sources of light shall be shielded so that beams or rays of light will not shine directly onto adjacent properties; neither the direct nor reflected light from any light source may create a traffic hazard to operators of motor vehicles on public or private streets; and no colored lights may be used which may be confused with or construed as traffic control devices." It is unclear from the applicant's drawing whether there is any exterior lighting. The applicant shall provide written and /or graphic evidence to the Department of Planning Services for review and approval. A Lighting Plan may be required, if applicable. Section 23-3-250.B.7 states "Property shall be maintained in such a manner that grasses and weeds are not permitted to grow taller than twelve (12) inches. In no event shall the property owners allow the growth of noxious weeds. (Weld County Codification Ordinance 2000-1) • The existing on-site landscape treatment is adequate for this facility. Staff requests that the plot plan for this facility be oriented with North facing up as viewed on the drawing. Staff requests a legal description that acknowledges this as one parcel of a Recorded Exemption and staff requests the applicant simplify the Vicinity Map such that the location is readily visible. The applicant shall enter into an Improvements Agreement according to policy regarding collateral for improvements and post adequate collateral for all transportation (access drive, parking areas, et cetera)and non-transportation (fencing, screening, et cetera). The agreement and form of collateral shall be reviewed by County Staff and accepted by the Board of County Commissioners prior to recording the USR plat. End memorandum. •
