COLORADO The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS AND REQUIREMENTS: Weld County Strategic Roadway: (December 2002) WCR 7 is classified by the County is a Strategic Roadway, which requires a 140-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. Weld County Road 7 is the closest roadway to the proposed USR. The USR accesses off of a private road/easement. Access: Access is an existing gravel drive/easement. This drive/easement accesses WCR 7 to the east. Ire applicant shall indicate specifically on the plat the type of right-of-way/easement that exists. Off-street parking spaces including the access drive shall be surfaced with gravel, asphalt, concrete or the equivalent and shall be graded to prevent drainage problems. Each parking space shall be equipped with wheel guards or curb blocks when necessary to prevent vehicles from extending beyond the boundary of the space and from coming into contact with other vehicles, walls, fences or planting. Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. The applicant must take into consideration storm water capture/quantity and provide accordingly for best management practices. Construct a storm water/water quality capture pond near the southeast corner of the property (20' offset from south property line) with approximate dimensions of 60' wide (east-west) by 40' (north-south) and 1.5 foot depth with shallow slopes. The south edge of the pond should be 6" below the height of the north, east, and west sides of the pond with a 6" pipe buried to act as a weir and to avoid erosion of downstream bank. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be incorporated into the permit as conditions that must be met prior to the issuance of the Certificate of Occupancy: 1. An individual sewage disposal system is required for the proposed set of restroom facilities and shall be installed according to the Weld County Individual Sewage Disposal Regulations. • 2. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. • 4. The applicant shall operate in accordance with the approved "waste handling plan". 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan at all times. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Residential Zone as delineated in 25-12-103 C.R.S., as amended. 7. Adequate handwashing and toilet facilities shall be provided for members and visitors of the facility. 8. Sewage disposal for the facility shall be by septic system. The Fire District does not object to the proposed use provided the requirements of the District can be met with regard to building construction, fire department access and water supply for fire protection. Building construction plans and the final site plan showing a code analysis which includes, the gross square footage of the building, the building construction type, and occupancy classification(s) must be submitted to the Fire District for review and approval before building permits may be issued. • Water supply for fire protection needs to be provided for the existing building/residence. Based on the nature of the occupancy the Fire District will accept the installation of a residential fire sprinkler system for the residence and cultural center a building. Water supply for fire protection will be required for the future shelters if the buildings are completely enclosed. A final inspection of the occupancy by a member of the Fire District will be required before a Certificate of Occupancy is issued. This violation was initiated due to the operation of the Cambodian Cultural Center without first obtaining the necessary Weld County Zoning Permits. This case was presented to the Board of County Commissioners on January 9,2007. At the Violation Hearing, the Board referred this case to the County Attorney's Office, but delayed legal action for 90 days. This application if approved by the Board of County Commissioners will correct the violation. TO: Michelle Martin, Planner COLORADO DATE: September 24, 2007 FROM: Kim Ogle, Planning Manager SUBJECT: Use by Special Review, USR-1627 Cambodian Cultural Center Landscape Referral The Legal Description for the property under review with this application shall be amended to reflect the recently approved Recorded Exemption. The correct legal description is Lot A of RE- 4660, being part of the S2 S2 NE4 Section 33, Township 1 North, Range 68 West of the 6th P.M., Weld County. The Department of Planning Services reviewed the above referenced Use by Special Review Landscape Plat and offers the following comments: The applicant shall prepare a Use by Special Review Permit Plan Map per Section 23-2-260.D of the Weld County Code. Alternative scales shall be approved by the Department of Planning Services. Section 23-3-50.B and Section 23-3-50.C of the Weld County Code addresses the required • setbacks and offset bulk requirements. The applicant did not submit a Landscape Plan in the application materials, however the application materials indicate that the existing landscape will be shrubs, trees and grasses of unknown quantity, size and species. The proposed seed mix for the undelineated retention pond is required and shall be submitted to the Department of Planning Services for review and approval. Further, all disturbed areas on site shall be reseeded to prevent nuisance conditions from establishing. Future landscaping shall be maintained at all times. Dead or diseased plant materials shall be replaced with materials of similar quantity and quality at the earliest possible time. The applicant shall demonstrate how the proposed plant material will be watered, thus ensuring adequate growth and established of the feeder root system. Further, the applicant shall provide evidence that a commercial water tap has been obtained prior to recording the Use by Special Review Permit Plan Map. The "Existing Cultural Center and Prayer Room" buildings delineated on the plan are approximately 1625 square feet on size. There is also a single family residence of 2600 square feet on the property. The relationship of the residence to this facility is unclear and requires addressing by the applicant. Per Appendix 23-B of the Weld County Code, the number of off- street parking spaces required is 1 space for every four seats of building rating. The applicant shall provide this office with evidence that adequate parking for the Existing Cultural Center and Prayer Room and residential structure has been accommodated on the property. Given the • known information, Staff is unable to determine if the intent of the Section 23-3-320.C.3 of the Weld County Code has been met. • The Department of Planning Services will require the minimum number of parking spaces be installed and accessible to the users of this facility at all times. There shall be no exception to this standard. The Plan reviewed by this office delineates 57 useable parking spaces on the East side of the building, and 20 questionable use parking spaces on the West side of the building. There were no parking spaces identified as non-ambulatory spaces in either parking area locations. The applicant shall provide evidence that the number of parking spaces are useable and functional as delineated and further meets the intent and requirements of Appendix 23-B. The applicant shall address and adhere to the American with Disabilities Act and ADA standards for this facility at all times. Non-ambulatory/Ambulatory parking spaces shall be identified and shown on the plat. This site will be required to meet all requirements of the Americans with Disabilities Act. At least one space must be van accessible. A certain portion of the structure will also be required to meet the accessibility requirements. The parking spaces must be the closest possible to the entrance. Signing will be required. Curb cuts, ramps and other methods of providing accessibility shall be required to reasonably attempt to meet the requirements of this Act. The applicant shall delineate curb stops for the parking spaces to be delineated on the Use by Special Review Permit Plan Map. One curbs stop for each space is the standard, however, staff will accept one curb stop for every two parking spaces if curb stop is equally spaced on parking stripe between every two stalls. The applicant shall demonstrate a safe and approved access. The proposed access points into • the facility appears to be adequate. Points of ingress and egress to this parcel shall be clearly identified. Appropriate language shall be included on the drawing delineating the access to this parcel. The Department of Public Works shall be contacted in an effort to address points of ingress and egress, as applicable. Should the Department of Public Works not maintain this section of County Road 7, the appropriate government entity shall review, comment and provide written evidence of an approved access permit for this facility. The trash collection area was not identified on the drawing. Areas used for storage or trash collection shall be screened from adjacent public rights-of-way and adjacent properties. These areas shall be designed and used in a manner that will prevent wind or animal scattered trash. The applicant shall address the issue of on-site lighting, including security lighting if applicable. Any lighting ... shall be designed, located and operated in such a manner as to meet the following standards: sources of light shall be shielded so that beams or rays of light will not shine directly onto adjacent properties. The applicant has delineated any on-site sign. The property identification sign shall adhere to Section 23-4-90.A and Section 23-4-90.B of the Weld County Code. One identification sign per principal use shall be allowed, provided that the sign does not exceed sixteen (16) square feet in area per face. Further, the location of the sign, shall be delineated on the Use by Special Review Permit Plan Map. All structures, including signs, on site must obtain the appropriate building permits and meet the appropriate zone district setbacks. The applicant shall provide evidence that the water may be utilized for exterior yard and garden • watering. Further, the applicant shall provide evidence of adequacy of water prior to scheduling the PC Hearing. The applicant shall provide written evidence from the Fire Protection District of record stipulating that the approved point of ingress and egress, emergency access and circulation pattern meet the requirements of the District. • The applicant shall enter into an Improvements Agreement according to policy regarding collateral for improvements and post adequate collateral for all transportation (access drive, parking areas, etcetera) and non-transportation (seeding of disturbed areas, etcetera) or complete the on-site improvements prior to recording the plat. The District has reviewed the development proposal in terms of (1) available school capacity, (2) required land dedications and/or cash-in- lieu fees and (3) transportation/access considerations. Upon review, the School District finds that it does not oppose this development at this time. The reason for this position and other relevant information is as follows: • The 125% Capacity Benchmark is not expected to be exceeded at by any of the schools within this feeder. This determination includes the capacity of Elementary 23 opening in the Fall of 2008. • Until Elementary 23 is opened, Erie Elementary may experience further crowding in the short-term. Erie Elementary School's 5'" grade class will likely remain at Erie Middle School until the opening of • Elementary 23. This project is located at 595 Weld County Road 7, which is part of the south '/z of the northeast '/a of Section 33 in Township 1 North,Range 68 West in Weld County, Colorado. The project area is five acres. The existing residence will be utilized for the cultural center, and proposed additions include a traditional entrance gate, fenced dumpster area, and two pavilion shelter areas. A maximum of 10 people IIIwill reside on-site. This land is currently used by a variety of urban wildlife, including but not limited to red foxes (Vulpes vulpes), raccoons (Procyon lotor), striped skunks (Mephitis mephitis), coyotes (Canis latrans), mule deer(Odocoileus hemionus), white-tailed deer(Odocoileus virginianus), and great horned owls(Bubo virginianus). Conflicts Residents and visitors to the Cambodian Cultural Center should be aware that wildlife will exist in and around the property. Sometimes conflicts can occur when people and pets share the same living space as wildlife. For example, foxes and coyotes may prey on loose pets, deer may eat ornamental shrubs and flowers, raccoons may get into trash containers and open garages, and skunks may burrow under decks. While uncontrolled pets are at risk from animals such as coyotes, foxes and raccoons,pets can also have large negative impacts on wildlife. Cats kill many birds and rodents, while dogs often chase and harass wildlife such as deer. We recommend that for the safety of both pets and wildlife, pets should be controlled at all times on this property. Minimizing Conflicts Residents and visitors should be provided with information about how to avoid and minimize wildlife conflicts in this area, and should take responsibility for peacefully co-existing with local wildlife. There may be activities such as small game, upland bird, waterfowl, and deer hunting that occur in areas adjacent to the property. Landscaping and Fencing Landscaping and plantings on the property should utilize native vegetation to provide habitat for urban wildlife. With the exception of the fencing around the dumpster(which should effectively exclude wildlife), any fencing of property should be wildlife-friendly to prevent deer and other wildlife from getting caught. Post and rail fences can be a good choice for wildlife, as they are more visible than many wire fences. We recommend that the top rail of the fence not exceed 40 inches in height and the bottom rail is at least 22 inches from the ground. With these specifications, most wildlife can navigate over or through them. If the fence must be wire, the top and bottom wires should be barbless and flagged, and all wires should be kept taught. Deer crossing areas may also be incorporated into fences that exceed 40 inches in height or otherwise do not allow for easy wildlife movement. Spikes or pickets should be avoided. as they increase the risk of injury to wildlife. Deer may become impaled on such a fence if they attempt to jump and do not make it all the way over. Prairie Dog, Burrowing Owl, and Black-Footed Ferret Concerns If prairie dogs are found on a site that requires development, we recommend they either be moved to another location alive, or be humanely euthanized before any earth moving occurs. If poisoning/gassing in the burrows is the method chosen to euthanize prairie dogs, the U.S. Fish and Wildlife Service should be contacted at(303)275- 2370 to see if black-footed ferret surveys are needed for this specific location. Burrowing owl surveys are strongly recommended if destruction or poisoning of prairie dog burrows will occur between March 1 and October 31 of • any year. For information on burrowing owl survey protocols, contact District Wildlife Manager Claire Solohub at 303-291-7142. Trees and Weeds Mature native trees and their roots should be left intact if possible. If mature trees must be cut down, we recommend replacing them in a 1:1 ratio. In riparian areas, we recommend planting 8 ft tall trees of the same species in a 3:1 ratio. To prevent the spread of weeds during construction,we recommend that all construction equipment be thoroughly cleaned prior to each use on this property, and again before the equipment leaves the development site.
