RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST DONALD NESVIK FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Donald Nesvik, ZCV #0800065, is allegedly in violation of the Weld County
Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 8th day of July, 2008, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Donald Nesvik, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until October 8, 2008, to allow adequate time for the property owner to submit a
zoning permit, or remove the dwelling unit from the shop to bring the subject property into
compliance and for an inspection of the property by the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV#0800065 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Donald Nesvik to remedy the violation of the Weld County Code, and
any other persons occupying the properties, any persons claiming an interest in the properties, and
any persons acting in active concert with the identified parties, with an instruction for delay of action
upon such referral until October 8, 2008, to allow adequate time for the property owner to submit
a zoning permit, or remove the dwelling unit from the shop to bring the subject property into
compliance.

Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a
representative be in attendance to answer any questions the Board of County Commissioners

Hi Ann,
This letter is in reply to your request for information on the property at 703 east 16th street.
I purchased the property in the spring of 2000 from the Davis/Hensley family. They were living in Cheyenne,
Wyoming and the house had been used by squatters and transients for several years prior to my obtaining it.
It had a massive collection of trash, abandoned cars, construction debris and several dead farm animals that
littered the property.
After removing the trash and debris, which amounted to over 900 cubic yards as measured by a 40 cubic yard
roll-off dumpster, I started a weed control program. With the grounds cleaned, I then began a cosmetic
makeover on the house, replacing the windows and siding on the exterior and removed and replaced the
carpet, cabinets and doors and trim on the interior. I also received a permit for, and replaced the electric
service to the house from the street.
In the summer of 2000, I applied for and received a permit to construct a 1600 square foot metal building
which was completed in late summer of the same year. This building has been used to store an antique model
"A" Ford car, motorcycles, furniture, and other household items.
My father moved into the house in the fall of 2000 after living in Greeley with an in-house caretaker for
several years. He had been previously declared 100% disabled on July 13, 1992 by his family doctor and
needed some assistance with cooking, cleaning, and grocery shopping. It was a good situation for the
caretaker as she received a place to live and my father had the help he needed.
After trying to live by himself at the house at 703 east 16th street for approximately 2 years, his condition
required that either I get some assistance in the form of a caretaker/roommate or he would have to move into
an assisted-living center. He had fallen several times and also had trouble with dementia. Since my work
requires that I travel often, I wanted to have someone close by so he had the help that he needed if I was not
in the immediate area.
The lady who agreed to assist us tried staying in the house with my father for a trial period but since it is so
small, they both felt that it was an untenable situation. Some separation was needed to maintain a friendship
as well as the working relationship. At that point, I wanted to keep her as they got along well, as long as they
weren't on top of each other constantly, so I requested that she stay and I would make a small accommodation
for her in the auxiliary building north of the house.
The accommodations consist of approximately 760 square feet of space in that building. There is one
bedroom, a bathroom and the remainder being an open area for the kitchen and living area. The heat is
supplied via electric baseboard units. It has a gas powered hot water heater. The plumbing and electric has
been completed strictly adhering to established codes. The insulation in the walls is R-19 and the insulation
in the ceiling is R-40.
Presently, my father needs several medications to maintain his tenuous level of health. He currently is taking
Lisinopryl for high blood pressure, Simvastatin for high cholesterol, Levothyroxine for a thyroid condition,
Venlafaxine for depression, Alprazolam for anxiety, Oxycodone for pain, and Amitripyline to sleep. He will be

77 years old on June 1st. He is an orably discharged Korean War veten vho was injured in combat and
spent 10 months in hospitals in Korea and Japan. He has also undergone 3 major back and neck surgeries
since being discharged. On Christmas eve of 2006, he suffered a heart attack and was hospitalized at North
Colorado Medical Center for one week. Through all of this, he still maintains a positive attitude.
My father would like to live as independently as possible, for as long as that is possible. I would like to keep
him from having to live in a nursing home as long as I can. I do know, however, that it will probably be
necessary sometime in the future. This arrangement has helped us to avoid that reality thus far.

Yes, after speaking with Mr. Nesbick he did explain his current situation and is requesting a medical
Hardship. He will be contacted today and we are asking that he put his current situation and request in
writing which will then be presented at our staff meeting on Friday. At that time staff will determine if
we will allow the use and if permits shall be obtained. Otherwise we will ask that the use be vacated
and no one shall be occupying the garage. We also have building working along with us.
If email is the best way to get in touch with you I can certainly update you on Friday afternoon as the
direction that will be taken regarding this violation.Additionally, for better reference and your own
records this case is filed under violation number GCV0S-0008 .
