RE: GRANT PERMIT FOR TEMPORARY ASSEMBLY TO ANDERSON SOUTH FARM, LLC-
SEPTEMBER 26-28, OCTOBER 3-5, 10-12, 17-19, 19-21, 24-26, AND OCTOBER 31-
NOVEMBER 2, 2008
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Anderson South Farm, LLC, Attn: Jim Anderson, 6876 County Road 5, Erie,
Colorado 80516, c/o Todd Hodges Design, LLC, 1269 North Cleveland Avenue, Loveland,
Colorado 80537, has presented to the Board of County Commissioners an application for a Permit
for Temporary Assembly on land within the unincorporated portion of the County of Weld, State of
Colorado, to be held from 10:00 a.m. until 11:00 p.m., on September 26-28, October 3-5, 10-12,
17-19, 19-21, 24-26, and October 31-November 2, 2008, on property described as follows:
6728 County Road 3.25, Erie,Colorado 80516;being
further described as a part of Section 32, Township
2 North, Range 68 West of the 6th P.M., Weld
County, Colorado
WHEREAS, said applicant has paid Weld County the sum of ONE-HUNDRED DOLLARS
($100.00) for said Weld County Permit for Temporary Assembly, and
WHEREAS, having examined said application, the Board deems it appropriate to grant a
Weld County Permit for Temporary Assembly to Anderson South Farm, LLC, and
WHEREAS,said permit shall be issued subject to compliance with the terms and conditions
as set forth in the application materials and upon the express condition and agreement that the
temporary assemblage will be conducted in strict conformity to all laws of the State of Colorado,
and
WHEREAS,any violation to said terms and conditions shall be cause for revocation of said
permit and forfeiture of bond.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that said Weld County Permit for Temporary Assembly on September 26-28,
October 3-5, 10-12, 17-19, 19-21, 24-26, and October 31-November 2, 2008, be, and hereby is,
granted to Anderson South Farm, LLC, to conduct a temporary assemblage at the hereinabove
described location.

By action of the Board of County Commissioners of the County of Weld, State of Colorado,
taken this 15th day of September, 2008, IT IS HEREBY GRANTED a permit for a temporary
assemblage on land within the unincorporated portion of the County of Weld, State of Colorado,

2. Nature or purposes of the assembly: Development Standard #20 of USR-1232 indicates,
"The applicant must obtain a Temporary Assemblage Permit in compliance with
Ordinance#85 for any activity including more than 489 participants at any one time,providing
no overnight camping is authorized by this Development Standard." This request is for a
maximum of 10,000 persons per day during the weekends for the Fall Harvest Festival as
noted below.
3. Dates and hours during which the assembly is to be held: September 26-28, October 3-5,
10-12, 17-19, 24-26, and October 31-November 2, 2008 . Staff arrives at 7 a.m. The site is
open to the public from 10 a.m. — 11 p.m. The last staff may leave at 1 a.m.
4. Maximum number of persons to be allowed at assembly at any one time:
10,000 persons daily during the weekends listed above over a 13-hour period of time.
5. The maximum number of tickets to be sold, if any: The maximum number of tickets sold in
one day was approximately 8,000.

6. Identify plans to limit number of persons to the maximum identified above: Sale of entrance
tickets. The last ticket sale is at 9:45 p.m.
7. Identify plans for supplying potable (drinking) water, including the source, number, and
location of facilities, and type and means of disposing of waste deposited: Bottled water is
sold on site. Patrons are allowed to bring non-alcoholic beverages on site. Waste
generated on site includes snack food wrappers as well as plastic and aluminum bottles.
Waste is collected in garage cans located on site and collected at least every 48 hours by a
contracted service provider. Please see contract for providers (2007) enclosed.
8. Identify the plans for holding, collecting, and disposing of solid waste materials: See
response above. Any waste generated will be collected and hauled away. Please see the
2007 contract enclosed.
9. Identify the plans for providing separate toilet facilities for males and females, including the
source, number, and location,type and the means of disposing of wastes deposited:There
is one enclosed restroom for women and one for men in the Concessions Building. The
men's restroom has a urinal and a toilet with hand-washing facilities. The women's restroom
has two toilet stalls and hand-washing facilities. Port-A-Lets are provided. Please see
contract for the provider (2007) enclosed. The Port-A-Lets are cleaned once a day by the
contract company. Also included is a letter for service to pump the septic tanks.
10. Identify the plans to provide for medical facilities, including the location and construction of
any structures, the names, addresses, and hours of availability of emergency medical
technicians and nurses and provisions for emergency ambulance service: The First Aid
center is located near the site entrance. During high-use times, private security personnel
are on site. At least one EMT is employed as a first responder to all emergencies. One or
more employees are trained as EMT. Through the USR process, the Weld County
Ambulance, Sheriffs Department and Fire Protection District reviewed our plans. We would
be happy to provide each emergency responder a set of plans.
11. Identify the plans, if any,to illuminate the location of the assembly, including the source and
amount of power, and the location of lamps: Illumination for the parking lot is achieved by
lights attached to existing poles. These lights do not spill onto adiacent properties.
Additional on-site lighting is placed on the property and illuminates congregation areas.
12. Identify the plans for parking vehicles, including size and location of lots, points of highway
access and interior roads, including routes between highway access and parking lots: An
existing one-acre gravel parking lot is located in the southwestern portion of the property.
This area can accommodate anticipated numbers of vehicles. In the event more space is
needed, an additional 30 acres can accommodate overflow parking. Traffic comes from
Weld County Road 3.25 to access the parking lot. There is an existing entrance and exit for
the parking lot. At busy times,we do have 6 employees working in the parking lot to manage
traffic flow.
13. Identify the plans for communications with hospital, police, and fire services, including the
source, amount, and location of communication equipment: I keep a cell phone or walkie-
talkie with me at all times. In addition, all employees are outfitted with communication
devices. The private security personnel are also equipped with communication devices.
The First Aid Station, the Ticket Booth and the Concessions Building have communication
devices. In the event of an emergency, a mobile mega phone is used.
14. Identify the plans for camping facilities, if any: Not Applicable.
15. Identify the plans for fire protection: We are currently in Mountain View Fire Protection
District. I regularly meet with LuAnn Penfold, Fire Marshall. She, or her staff members
have been on site often. I have completed her requests and we have passed all inspections.
16. Identify the plans for security, including the number of guards,their deployment,their names,
addresses, credentials and hours of availability and description of peer group control, if any:
Private security services are contracted through Delta Security. Please see contract for
services from 2007 enclosed.
17. Identify the plans for sound control and sound amplification, if any, including number,
location, and power of amplifiers and speakers: Station-specific music is located in the
outdoor haunted activity. All other communication is achieved by walkie-talkie/cell phones.
In the event of an emergency, a mobile meqa phone is also used. In the event of an
emergency, such as the need for emergency evacuation, an air horn is used to get patrons
attention.
18. If applicable, identify plans for meeting County health standards for food concessions and
concessionaires who will be allowed to operate on the grounds, including the names and
addresses of all concessionaires and their license permit numbers:
I am the only concessionaire and am in the process of updating my permit with Weld County
Health Department.
19. Identify the plans, if any, for an electrical system: Electric power exists on site.
20. Identify the plans to ensure that trees, underbrush, large rocks, and other natural features
shall be left intact and undisturbed, and natural vegetative cover retained, protected and
maintained so as to facilitate drainage, prevent erosion, and preserve the scenic attributes;
and the plans to abate dust on the site: Vegetation such as the corn stubble in the corn
maze and pumpkin vines in the pumpkin fields may be damaged. However,these areas are
replanted to corn and pumpkins each year. The overflow parking area may be trampled
upon. This 30-acre area is a hay field and is replanted each year.
21. Attach a statement by a bonding company licensed to do business in the State of Colorado
indicating its intent to furnish a bond required in Section 12-1-30.6.13 of the Weld County
Code to ensure performance by the applicant of each of the terms and conditions of the
temporary assemblage permit.
22. Attach a statement by an insurance company licensed to do business in the State of
Colorado stating its intent to provide liability insurance, as required by Section 12-1-30.6.14
of the Weld County Code, to protect against injury to persons or property occurring as a
result of such an assembly.
23. Submit$100.00 fee for each event where three-hundred fifty(350)or more people assemble
or can reasonably by anticipated to assemble at any one(1) location, unless the location is
properly zoned for such assembly, in which case one permit shall be required for the total
number of events scheduled for that location for the reminder of the calendar year, not to
exceed ten (10) events per year. As used herein, the term event means an assembly or
anticipated assembly which is scheduled to last for three (3) consecutive days or less.

A TEMPORARY ASSEMBLAGE PERMIT,AND FROM ANY COSTS INCURRED IN DEFENDING
AGAINST SUCH ACTIONS OR IN CLEANING UP ANY WASTE MATERIAL PRODUCED OR LEFT
BY THE ASSEMBLY.

SUBJECT: Temporary Assembly Permit for LC0022
In response to your request, Environmental Health Services has reviewed the Temporary
Assembly Permit, LC0022, for James Anderson, Anderson South Farm LLC, located at
6728 WCR 3 14, Erie, Colorado.
Based on information provided by James Anderson, the highest number of tickets sold was
7,677 on Saturday October 20, 2008. Based on one person per ticket, the number of
portable toilets required would be 50. The Department recommends that 1 portable hand
washing station be made available for every two portable toilets in use. The Department
understands that the facility has a septic system, but that system has been designed to only
handle 200 persons a day.
Based on previous information provided, the Department also recommends placing at least
one portable hand washing at the following locations: the animal petting area, picnic area
for guests, and near the kiddie koral (note: hand sanitizer may be used in addition to hand
washing, but should not replace hand washing).
Dan Joseph also discussed food operations with Brenda Anderson in 2007. Previously she
stated that they provide refrigerated trucks to ensure that they have enough refrigeration
capacity for the number of people served and that no cooking will be done outside the
kitchen area. Provided circumstances from last year have not changed, the Department
has determined that this should be sufficient to ensure proper temperatures are maintained
during the event. In the event that this is not enough refrigeration, then addition units
must be obtained or the menu limited.

2 things we need from Anderson. First, it appears that they have supplied us with an
"Insurance Proposal. " Need a Certificate of Insurance that shows they indeed have the
coverage, rather than just a proposal. Second, there is nothing in the information about
a bond or other collateral. I would accept from Anderson a letter saying that in lieu of
a bond, Anderson South Farm LLC is ensuring that all of the terms and conditions of the
temporary assemblage permit will be performed. That letter could then just be updated on
a yearly basis.
