• Environmental Health Services has reviewed this proposal for propane storage which
will consist of two 30,000 gallon storage tanks and a 600 square foot office for two
employees. The existing well on the parcel will be re-permitted for commercial use. An
individual sewage disposal system will be installed for office use.
We have no objections to the proposal, however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
• 1. The applicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
Environment.
• 2. An individual sewage disposal system is required for the proposed facility and
shall be installed according to the Weld County Individual Sewage Disposal
Regulations.
3. Evidence of an application submitted to the Colorado Department of Labor and
Employment Division (CDL&E), Oil and Public Safety in accordance with the
Liquefied Petroleum Gas (lpg) rule 7 ccr 1101-15 (Effective September 1, 2005)
shall be submitted to Environmental Health Services, Weld County Department
of Public Health & Environment. Alternately, the applicant can provide evidence
from the CDL&E, Oil and Public Safety Section that they are not subject to these
requirements.
4: The applicant shall submit evidence of an Aboveground Storage Tank permit
from the Colorado Department of Labor and Employment (CDL&E), Oil
• Inspection Section for any aboveground storage tanks located on the site.
Alternately, the applicant can provide evidence from the CDL&E, Oil Inspection
• Section that they are not subject to these requirements.
• 5. In the event that 1 or more acres are disturbed during the construction and
development of this site, the applicant shall obtain a stormwater discharge
permit from the Water Quality Control Division of the Colorado Department of
Public Health and Environment.
6. The applicant shall submit evidence to the Department of Planning Services,
from the Colorado Division of Water Resources, demonstrating that the well is
appropriately permitted for the commercial use.
7. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
• conditions that must be met one month prior to construction activities:
1. A stormwater discharge permit may be required for a
development/redevelopment/construction site where a contiguous or non-
contiguous land disturbance is greater than or equal to one acre in area. Contact
the Water Quality Control Division of the Colorado Department of Public Health
and the Environment at www.cdphe.state.co.us/wq/PermitsUnit for more
information.
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to the issuance of the Certificate of Occupancy:
1. An individual sewage disposal system is required and shall be installed according
to the Weld County Individual Sewage Disposal Regulations.
2. The septic system is required to be designed by a Colorado Registered
Professional Engineer according to the Weld County Individual Sewage Disposal
Regulations.

• We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
• as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan".
•
5. The applicant shall comply with all provisions of the Underground and Above
Ground Storage Tank Regulations (7 CCR 1101-14), as applicable.
• 6. The applicant shall comply with all provisions of the Liquefied Petroleum Gas
Regulations (7 ccr 1101-15), as applicable.
7. The facility shall be operated in a manner to prevent odors. Odors detected off
site shall not equal or exceed the level of fifteen-to-one dilution threshold, as
measured pursuant to Regulation 2 of the Colorado Air Pollution Control
Regulations. Additional controls shall be implemented at the request of the Weld
County Department of Public Health and Environment in the event odor levels
detected off site of the facility meet or exceed the level of fifteen-to-one dilution
threshold, or in the judgment of the Weld County Health Officer, there exists an
odor condition requiring abatement.
8. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved dust abatement
plan at all times.
9. The facility shall have sufficient equipment available to implement dust control as
required by the Weld County Department of Public Health and Environment.
10.This facility shall adhere to the maximum permissible noise levels allowed in the
Light industrial Zone as delineated in 25-12-103 C.R.S., as amended.

11.Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility.
12.Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
13.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes at all times.
14.Adequate toilet facilities (port-a-potty) shall be provided during construction.
15.Bottled water shall be utilized for drinking and hand washing during construction.
•
16.AII potentially hazardous chemicals must be stored and handled in a safe manner
in accordance with product labeling and in a manner that minimizes the release
of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's).
17.If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
18.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.
Additionally, please note the following:
1. This application is proposing a well as its source of water. The applicant should
be made aware that while they may be able to obtain a well permit from the Office
of the State Engineer, Division of Water Resources, the quantity of water
available for usage may be limited to specific uses. Also, the applicant should be
made aware that groundwater may not meet all drinking water standards as
defined by the Colorado Department of Public Health and Environment. We
strongly encourage the applicant to test their drinking water prior to consumption
and periodically test it over time.

The Weld County Public Works Department has reviewed this proposal. Our comments and requirements are
as follows:
COMMENTS:
Weld County Road Classification Plan (FHU): (June 2002)
WCR 20 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot
right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
WCR 59 is a major arterial road, which requires a 140-foot right-of-way at full build out. There is presently a
60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the
Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
•EQUIREMENTS:
Direct access from a public road will be limited to one (1) per legal parcel, except as further limited or restricted
by zoning or subdivision regulations. Additional accesses may be approved by the Department of Public
Works or the Board of County Commissioners. This policy shall apply to all new and existing accesses within
the unincorporated areas of the County. Properties within municipalities or other counties which access
County roads are subject to this policy.
A commercial access shall be a minimum distance of 150 feet from an intersection county or state roadway.
A 40' radius is required on all accesses to public roads for accesses designed to accommodate truck traffic. {A
minimum effective turning radius of forty (40) feet shall be used for accesses intended to accommodate truck
traffic. (Weld County Codification Ordinance 2000-1)} Sec. 8-2-40 B.Road access design standards.
The USR area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA).
A water quality capture feature shall be constructed for all buildings, drives, and other impervious areas of the
USR.
The applicant must take into consideration storm water quantity capture and provide accordingly for best
management practices.

1. A building permit shall be obtained prior to the construction of the office and placing of storage tanks and dispensing
equipment.
2. A plan review is required for each building for which a building permit is required. Plans shall bear the wet stamp of
a Colorado registered architect or engineer. Two complete sets of plans are required when applying for each permit.
Include a Code Analysis Data sheet which is provided by the Weld County Building Department with each Building
permit application.
• 3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application.Currently
the following has been adopted by Weld County:2006 International Building Code;2006 International Mechanical Code;
2006 International Plumbing Code; 2006 International Fuel Gas Code; and the 2005 National Electrical Code and
Chapter 29 of the Weld County Code.
4. All structures will require an engineered foundation based on a site-specific geotechnical report or an open hole
inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado
registered engineer.
5. The building will be classified as B (Office). Fire resistance of walls and openings, construction requirements,
maximum building height and allowable areas will be reviewed at the plan review. Storage tank placement and
dispensing equipment shall be according to NFPA 58. Setback and offset distances shall be determined by the Zoning
Ordinance.
6. Building height shall be measured in accordance with the 2006 International Building Code for the purpose of
determining the maximum building size and height for various uses and types of construction and to determine
compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building height shall be measured
