RE: ACTION OF BOARD AT SHOW CAUSE HEARING CONCERNING USE BY SPECIAL
REVIEW PERMIT #1602 FOR AN AGRICULTURAL SERVICE ESTABLISHMENT,
INCLUDING A LIVESTOCK CONFINEMENT OPERATION (DAIRY FOR A TOTAL OF
4,500 CATTLE, INCLUDING MILKING COWS AND DRY COWS) IN THE
A(AGRICULTURAL) ZONE DISTRICT - BRAD AND SCOTT COCKROFTS DAIRY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on October 24, 2007, a Show Cause Hearing was conducted to consider
revocation of Use by Special Review Permit #1602 for an Agricultural Service Establishment,
including a Livestock Confinement Operation (dairy for a total of 4,500 cattle, including milking
cows and dry cows) in the A(Agricultural)Zone District, issued to Brad and Scott Cockrofts Dairy,
LLC, 27906 County Road 388, Kersey, Colorado 80644, and
WHEREAS, Brad and Scott Cockrofts Dairy, LLC, is the current owner of the facility located
on property being further described as follows:
Lot A of Amended Recorded Exemption#178; being
part of Section 11, Township 6 North, Range 64
West of the 6th P.M., Weld County, Colorado
WHEREAS,at said hearing of October 24, 2007,the Board deemed it advisable to continue
the matter to August 13, 2008, in order to allow the facility operator adequate time to implement
the Revised Management Plan for Nuisance Control, and
WHEREAS, at said hearing on August 13, 2008, the Board heard all of the testimony and
statements of those present and, having been fully informed, finds that the matter should be
continued to October 1, 2008, in order for staff to monitor that the implemented plan for nuisance
control continues to mitigate concerns.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the abovementioned matter be, and hereby is, continued to October 1,
2008, at 10:00 a.m.
