South'Half of the Southeast Quarter of the Northeast Quarter (SliSE.1NS$)
of Section Twenty-three (23); also pert of the West Half of the Southwest
quarter (W15WW) of Section Twenty-four (24) beginning 1150 feet South of
the West Quarter Corner, thence South 38° East 610 feet. thence South 33°46'

Notwithstanding any provision of Paragraph (11), the parties agree that
this Lease shall cover such of the above described lands owned by Lessor
together with any mineral interests of Lessor in and to Seeley Lake Sub-
division First Filing and Sonny View Estates Subdivision First Filing. Lessor
makes no warranty of any kind, but Lessor represents that it has not trans-
ferred any interest in the described property other than as disclosed in
instruments recorded prior to this date in the office of the County Clerk
and Recorder of Weld County, Colorado.
Notwithstanding any provision in the Leese to the contrary, Lessee shall
conduct no operations.including placement of pipelines, personal property
• or any equipment on any land included within Seeley Lake Subdivision First
Filing. Sonny View Subdivision First Filing or any other lend,lying East
of the inlet to Seeley Lake. Further, Lessee shall not drill or conduct
any drilling or other operation within the high water line of Seeley Lake.
if further lands are subdivided hereafter, no further operations will occur
in such subdivided lands subsequent to recording of subdivision plat, pro-
vided that any operations commenced prior to that dote may continue but
shall not thereafter be expanded.
Lessee specifically assumes full responsibility and liability for any and
all damages and injuries occasioned by any operations occurring under this
Lease, including, without limitation, damages or injuries sustained by Ogilvy
Irrigating and Land Company or any of its shareholders, including lose of
crops, by reason of damage to Seeley Lake, inlets, outlets or dikes appurtenant
thereto or used in connection with the filling or withdrawal of water there-
from. Lessee acknowledges that it will examine all geological facts prior
to conducting any drilling operations in order to assure that no damage
occurs. Lessee further agrees that prior to any operations, Lessor shall
exhibit to Lessor such insurance policies or other information as may be
necessary to.demonstrate that Lessee maintains public liability and property
damage'insuradce by reason of its operation in an amount not less than
$3,500.000.00.
So mining will be conducted and no pipelines ray be installed unless connected
to wells on the leased premises or land pooled therewith.
