The Weld County Public Works Department has reviewed this proposal; this project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS:
WCR 90 is a collector road and requires an 80-foot right-of-way at full build out. There is presently a 60-foot
right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The traffic counts
taken in April 2007 indicated 297 AADT, just west of this site. The applicant's representative has estimated
approximately 60 daily trip will be added to the roadways.

REQUIREMENTS:
A final Grading and Erosion control plan will be required there shall be 2' contours a minimum of 200' beyond
the property boundaries on the submitted plan. Show the access culvert within the roadside ditch on the plans.
The applicant shall indicate specifically on the plat the type of right-of-way/easement and indicate whether it is
dedicated, private, or deeded to provide adequate access to the parcel.
If a drainage culvert is required, a 15-inch corrugated metal pipe is the County's minimum size requirement. If
the applicant chooses to place a larger culvert, please contact the Public Works Department to adequately size
your culvert.
The internal road(s) shall enter onto WCR 90, at a 90° angle, for a minimum of one vehicle length to provide
adequate sight distance in both directions.
The applicant is required to comply with all Colorado Department of Health and Environment, Water Quality
Control Division regulations regarding storm water quality permitting and protection and construction storm
water discharges.
I am referring the storm water drainage to the Department of Health and Environment, as it deals with animal
units. The applicant is required to comply with the Colorado Confined Animal Feeding Control Regulations
(State of Colorado).

A 40' radius is required on all accesses to public roads for accesses designed to accommodate truck traffic. {A
minimum effective turning radius of forty (40) feet shall be used for accesses intended to accommodate truck
traffic. (Weld County Codification Ordinance 2000-1)} Sec. 8-2-40 B. Road access design standards.
Explain in detail what type of proposed surface will be installed for the driveways and parking lots.
The access shall be placed in such a location to have adequate sight distance in both directions and not below
the crest of a hill or where physical obstructions are present.
Each parking space shall be equipped with wheel guards or curb blocks when necessary to prevent vehicles
from extending beyond the boundary of the space and from coming into contact with other vehicles, walls,
fences or planting.
A stop sign shall be placed at the intersection of WCR 90 and the access into the USR facility to stop
southbound traffic entering onto the WCR 90.
Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for your agricultural operation.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.

Cody,
Where will the pond emergency spillway be located? I cannot find it on any of the
drawings. Just east of this property crossing CR-90 there is a waterway flowing southeast
how will this area be protected from a discharge? Then just south of CR-88 this same
waterway becomes a FEMA regulated floodplain.
Please describe how mud will be controlled and not tracked onto County Road 90 during
feedlot operations? Will there be paving from the access off CR-90 to the office and
around the office area? As an alternative to a long driveway length of paving double
cattle guard can be used side by side to knock off the mud from the trucks before entering
the County Road system. Maintenance will be required to be done periodically to remove
the excess mud under the cattle guards. The cattle guards are required to be located a
minimum of 100 ' from the access within the site to ensure no portions of vehicles will
protrude into the County ROW as they pass over the cattle guards. This first 100 ' will
need to be paved or surfaced with recycled asphalt.

Chris and Cody,
Dave Bauer, Janet Carter and I visited the site today and discovered that it is a main
paved east - west traffic route. Due to the large size of feed trucks, cattle trucks
delivering cattle to the feedlot and taking cattle to the butcher shop and the speed limit
of CR-90 being 55 MPH a westbound acceleration lane will be warranted, this lane would
need to be a minimum of 400 ' long. Please refer to CDOT access code 3 .8 . Please call if
you have any questions.

The Weld County Department of Public Health& Environment has reviewed this
application for a 15,000 head buffalo and 24,000 head cattle feedlot with the total not to
exceed 24,000 animals. Based on the Department's conversations with the applicant's
representative AGPROfessionals, LLC and the application materials submitted, the
facility will be designed to meet the Confined Animal Feeding Operations (CAFO)
standards of Colorado Water Quality Control Commission Regulation Number 81 for a
Large CAFO and may seek a CAFO Discharge Permit. Therefore, our referral comments
reflect this fact.
These two items need to be addressed prior to recording the plat:
• Demonstrate that the proposed impoundment meets setbacks to water wells and
groundwater for new an expanded impoundments found in the groundwater protection
requirements of Colorado Water Quality Control Commission Regulation Number 81 (5
CCR 1002-81).
Demonstrate that the facility has adequate manure storage in the event that off-site
composting becomes unavailable or not economically feasible. The application materials
state that manure produced will be composted or hauled off and provided to local
farmers. No composting area or manure storage areas are designated on the site plan
map.
The Department recommends the following requirements be incorporated into the permit
as development standards:
1. The open lot wastewater impoundment described in the submitted application
materials shall be constructed to contain the design storm event and the liner shall
meet seepage rate requirements prior to the acceptance of waste water.
2. The facility shall design, construct, operate, and maintain their open lot
wastewater impoundments using the standards for new impoundments set forth in
the groundwater protection requirements of Colorado Water Quality Control
Commission Regulation Number 81 (5 CCR 1002-81).

3. The facility shall operate in compliance with Colorado Water Quality Control
Commission Regulation Number 81 and 61.
4. There shall be no discharge of manure or wastewater to surface waters, unless
allowed by Water Quality Control Commission Regulation Number 81 or by
CAFO Colorado Discharge Permit issued under Regulation 61.
5. Any land applications of manure and wastewater shall be made at agronomic rates
using practices and procedures, which are protective of ground and surface
waters. Land applications shall be in accordance with the facilities Manure and
Wastewater Management Plan, Facility Management Plan, or Nutrient
Management Plan. There shall be no discharge from land application areas
except for agricultural stormwater.
6. The facility shall be operated and maintained in a manner to prevent nuisance
conditions and operated in accordance with their current approved Management
Plan for Nuisance Control.
• 7. The facility shall control fugitive dust on this site and operate in accordance with
their current approved Management Plan for Nuisance Control.
8. The facility shall be operated in a manner to control pests. The facility shall be
operated in accordance, at all times, with their current approved Management
Plan for Nuisance Control. Additional control measures shall be implemented at
the request of the Weld County Department of Public Health and Environment in
the event that rodents (which can be determined to be associated with the facility)
are in such a number to be considered a nuisance condition.
9. The facility shall be operated in a manner to control flies. The facility shall be
operated in accordance, at all times, with their current approved Management
Plan for Nuisance Control. Additional fly control measures shall be implemented
at the request of the Weld County Department of Public Health and Environment
in the event that flies (which can be determined to be associated with the facility)
are in such a number to be considered a nuisance condition. Additional controls
shall also be implemented in the event the Weld County Department of Public
Health and Environment receives a significant number of fly (associated with
facility) complaints, and in the judgment of the Weld County Health Officer, there
exists a fly condition requiring abatement.
10. The facility shall be operated in accordance with the approved nuisance control
plan. Odors detected off site shall not equal or exceed the level of fifteen-to-one

dilution threshold, as measured using methods set forth in Regulation 2 of the
Colorado Air Pollution Control Regulations. Additional controls shall be
implemented at the request of the Weld County Department of Public Health and
Environment in the event odor levels detected off site of the facility meet or
exceed the level of fifteen-to-one dilution threshold, or in the judgment of the
Weld County Health Officer, there exists an odor condition requiring abatement.
11. The applicant shall remove, handle, and stockpile manure from the livestock area
in a manner that will prevent nuisance conditions. The manure piles shall not be
allowed to exist or deteriorate to a condition that facilitates excessive odors, flies,
insect pests, or pollutant runoff. The surface beneath the manure storage areas
shall be of materials which are protective of State waters. These areas shall be
constructed to minimize seepage or percolation of manure contaminated water. In
no event shall the facility impact or degrade waters of the State in violation of
Colorado Water Quality Control Commission Regulation Number 81.
12. Any individual sewage disposal system (I.S.D.S.) on the property shall be
permitted, installed, maintained, and operated in compliance with Weld County
• I.S.D.S. Regulations.
13. The facility shall operate in compliance with applicable Colorado Air Quality
Control Commission Regulations. There shall be no open burning except
"agricultural open burning" as defined by Colorado Air Quality Control
Commission's Regulation 9.
14. There shall be no permanent disposal of solid wastes, as defined in the
Regulations Pertaining to Solid Waste Disposal Sites and Facilities (6 CCR 1007-
2), at this site. This is not meant to include those wastes specifically excluded
from the definition of a solid waste in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended.
15. Waste materials, not specifically addressed by other development standards, shall
be handled, stored, and disposed in a manner that controls fugitive dust, blowing
debris, and other potential nuisance conditions.
16. The facility shall adhere to the maximum permissible noise levels allowed in the
Light Industrial Zone as delineated in Section 25-12-103 C.R.S, as amended.
17. The applicant shall comply with all provisions of the Underground and Above
Ground Storage Tank Regulations (7 CCR 1101-14).

18. Adequate drinking water, hand washing, and toilet facilities shall be provided for
employees and patrons of the facility.
19. If required, a stormwater discharge permit shall be obtained from the Colorado
Water Quality Control Division for construction activities.
20. The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

Dear Mr. Gathman:
We have reviewed the above referenced proposal for a livestock confinement operation. Since
the submitted material does not appear to qualify as a "subdivision" as defined in §30-28-101(10)(a),
C.R.S., pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors, this
office will only perform a cursory review of the referral information and provide comments. The comments
will not address the adequacy of the water supply plan for this development or the ability of the water
supply plan to satisfy any County regulations or requirements.
The applicant indicated in the submittal materials that water for the cattle and domestic purposes
• will be provided by the North Weld County Water District (District). However a letter of commitment for
service from the District was not included. We recommend that the County obtain a signed copy of the
water service agreement from the District prior to the final approval of the proposal.
The applicant also indicated that there are currently shares of Water Supply and Storage
irrigation water and an irrigation well on the subject property. However, no information was provided on
the intended use, if any, of this water for this project. From a review of our records, the irrigation well
located on the parcel is permitted under permit number 11262-R, for irrigation purposes. The well is also
decreed for irrigation purposes by the Division 1 Water Court in case no. W-2109, and depletions
associated with the irrigation use are included in the Lonetree Members Accretion Company (LOMAC)
temporary Substitute Water Supply Plan (SWSP), which expires on March 31, 2009. Please note, use of
this well or the ditch shares for purposes other than what is decreed and/or permitted may require a
change of water right and/or a new well permit.
