RE: APPROVE CONTINUANCE OF HEARING FOR CHANGE OF ZONE , A (AGRI-
CULTURAL) TO I-3 (INDUSTRIAL THREE) FOR JESSE YARBROUGH
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, a public hearing was held on the 15th day of Feb-
ruary, 1984 , at 2 : 00 o' clock p.m. for the purpose of hearing the
application of Jesse L. Yarbrough, 19357 Weld County Road 8 ,
Hudson, Colorado 80642, requesting a Change of Zone From A (Ag-
ricultural) to I-3 (Industrial Three) for a parcel of land
located on the following described real estate, to-wit:
Part of the SE4j Section 31 , Township 1 North,
Range 66 West of the 6th P .M. , Weld County,
Colorado
WHEREAS, Section 21 . 6 . 2 of the Weld County Zoning Ordinance
provides standards for review of such a Change of Zone, and
WHEREAS, the applicant was neither present nor represented,
and
WHEREAS, after consideration, the Board deems it advisable
to continue this hearing until the applicant can be present or
represented.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the Change of Zone
Hearing, requested by Jesse Yarbrough be, and hereby is , con-
tinued until such time that the applicant, or his representa-
tive, can be present.
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 15th

A public hearing was conducted on February 15 , 1984, at 2:00 P.M. , with
the following present:
Commissioner Norman Carlson, Chairman
Commissioner Jacqueline Johnson, Pro-Tem
Commissioner Gene Brantner
Commissioner Chuck Carlson
Commissioner John Martin
Also present:
Acting Clerk to the Board, Tommie Antuna
Assistant County Attorney, Lee D. Morrison
Planning Department Representative, Michael Mullen
The following business was transacted:
I hereby certify that pursuant to a notice dated January 9, 1984, and duly
published January 12, 1984, and February 2, 1984, in the La Salle Leader, a
public hearing was conducted on February 15, 1984, for the purpose of con-
sidering the request of Jesse L. Yarbrough for a Change of Zone from A (Agri-
cultural District) to I-3 (Industrial Three District) . Lee Morrison, Assistant
County Attorney, read this request into the record. Mike Mullen, Planning
Department representative, read the favorable recommendation, with conditions,
fium the Planning Commission into the record. He also read a letter, from the
City of Brighton requesting denial of this proposal, into the record. Neither
the applicant nor a representative was present. The Chairman suggested that
this matter be delayed until after the other hearing scheduled for tnlay.
Board concurred with this.
At the time the Board was ready to continue with this hearing, it was brought
to the Board's attention that Mr. Yarbrough was out of State and no representa-
tive was present. The Board did hear testimony from Ken Hickman and John
Franklin opposing this Change of Zone. After discussion, Commissioner C.
Carlson moved to table this matter until the applicant, or his representative,
can be present. Chairman N. Carlson seconded the motion and it carried by
the following vote: Chairman N. Carlson and Commissioners C. Carlson, Martin
and Johnson voted aye. Commissioner Brantner voted nay.
