Andy,
I received some comments that the lights at the Kersey facility were pretty bright. I drove
out to the site the other day and noticed that a few lights were shining directly off of the
property. They did not appear to be downcast. Development #31 of the approved Special Use
Permit: "Sources of light, shall be shielded so that light rays will not shine directly onto
adjacent properties where such would cause a nuisance or interfere with the use on the
adjacent properties sources of light."
Andy, could you please respond as to how you are going to address this issue.

The following conditions need to be satisfied for the High Plains Kersey Facility:
Condition 4I. USR-1665: Tank and system Solids/Sediment waste handling plan needs to be
submitted. I understand they will be cleaned out as a sludge/slurry and sent to WMX CSI
facility for disposal but I have no formal plan at this point. Submit your waste handling
plan or commit to this in writing.
Condition 4.J&K USR-1665: Where are you at regarding Closure Plans/Financial Assurance with
COGCC. Has a bond been posted covering all closure costs (well and facility)? Provide this
Department with proof of bonding and the closure plan.
Condition 5.A. USR-1665: Evidence that facility was built according to application
materials. "As builts" due ASAP after facility construction completed.
Where are you at it regards to Monitoring wells and leak detection monitoring wells? They
need to be in place and developed.

Dear Mr. Gathman:
We have reviewed the above referenced proposal for disposal of by-products result from the drilling
of oil and gas wells and the production of oil and gas. Some of these by-products include flow back from the
well completion process and saltwater produced (produced water) from the production process of the oil and
gas wells. The site will consist of an off-loading area and a tank farm for processing the flow back and
produced water before injection into the deep geologic formations. Flow back and produced water will be
injected into the Lyon/Amazon/Council Grove, Fountain and Missouri Formations to a projected total depth of
10,300 feet. The facility will include an office and pump house.
Since the submitted material does not appear to qualify as a "subdivision" as defined in §30-28-
101(10)(a), C.R.S., pursuant to the State Engineer's March 4, 2005 memorandum to county planning
directors, this office will only perform a cursory review of the referral information and provide comments. The
comments will not address the adequacy of the water supply plan for this development or the ability of the
water supply plan to satisfy any County regulations or requirements. In addition, the comments provided
herein cannot be used to guarantee a viable water supply plan or infrastructure,the issuance of a
well permit, or the physical availability of water.
According to the submitted information, potable water will be supplied by an existing well located on
the property, permit no. 37044. Well permit no. 37044 was issued on March 20, 1969 for domestic purposes.
The Applicant filed application receipt no. 3641327 to change well permit no. 37044 from domestic to
commercial purposes. On July 15, 2009 the application was returned to the Applicant for additional
information. The ability for well permit no. 37044 to be changed to a commercial well will be evaluated at the
time that the well permit application is re-submitted to this office.

There are a lot of conflicts in the residential manufactured home and the commercial
modular requirements Use the manufactured application for the modular offices, but
consider the structure as commercial buildings and not residences. The only thing that you
would need is the manufactures set up manual. The remainder will be out of the 2006 IBC.

In the mobile & manufactured home installation requirements construction
handout it says that mobile homes or manufactured homes must be at least 24' wide and that
it must be set on a permanent foundation or if either of these requirements are not met, a
Mobile Home Zoning Permit is required. The proposed office/break-room modular building
for each of the two sites is 16' wide X 65' long (see the enclosed sketch) but they are
not homes or accessory uses to homes. The Owners want to set both modular buildings on
permanent foundations and use them for their permanent office and break room for their

for both the projec sites (Kersey & Platteville) . oth projects were approved
through the Weld County USR process (USR 1665 & USR 1677) . Do we permit this as a
Commercial building or do we have to submit it through the Manufacture Home process and
then what about the Mobile Home Zoning Permit since it' s not a home or accessory use?

We have been going back and forth with High Plains Disposal over the last couple of days
regarding the issuance of an early grading permit for their WCR 54 site between WCR 47 and
WCR 49. High Plains Disposal' s consultant has been fishing around trying to find somebody
to release the grading permit. Please do not release the grading permit because there are
several outstanding issues that have not been addressed yet.
We have not received a signed improvements agreement with collateral for the project.
They are also addressing some issues on their construction drawings.
Please direct any phones-calls you get on this issue to myself. Let me know if you have
any questions.

I have trying to track down the 2/11/2009 plats and did not see them. Maybe they got
misplaced. I apologize if that was the case. I have reviewed the original plat you
submitted with the application. As long as you have added the following information the
plat will be acceptable:
1) Add "USR-1665" to the title.
2) Add "Lot A of Recorded Exemption 4519; located in the N2 of Section 25, T5N, R65W"
3) Attach the development standards.
4) Indicate lighting on the plat.
5) Either submit the landscaping plan (dated 1/29/2009 under job no. 0208010.00 020) for
recording along with the USR-1665 plat or add the information on this landscape plan to
the USR-1665 plat.

Dear Gentlemen.
As a neighbor of the new oil well that is to be built by Highpleins
Development along County Road 54 I have many concerns oil being drilled
near my home and in my neighborhood where many farms have bean operating
for hundreds of years. I know that you listened to my concerns during your
meeting last week and made the decisions that you made anyway
tam concerned that you have allowed this new outfit to have complete
access to their oil well with as many trucks as they wish.They said themselves
that they would only take 30 trucks In and out o₹there during the day and Into the
night, but at the end of the meeting It sounded to me that you decided instead to
remove all restrictions on the number of trucks they drive on County Road 54.
I told you during that meeting that I am opposed to this new oil well being
built altogether.You decided to let them build their site anywayand I wWM Nava to.
accept that But then to allow them unlimited access to County Road 54 with all
their trucks is taking the matter too far and that is simply unfair to those of us
having to live-Around this oil well. I am concerned about the safety of me and my
neighbors and would hope that you would have the same concerns.
With all this In mind I am asking that you reconsider the unlimited access
that you have given to the oil company and limit them to 30•trucks per day as
they have already said that they would agree to.
