I am very concerned about several points in the application. About one month ago I was informed by Mr.Hasbrouck of his families intention to build a custom feedlot for buffalo. He told me the feedlot would be a very modern lot with high fences. A sprinkler system to keep dust at a minimum. He also stated all manure would be composted so odor would not be a problem. Since talking with Mr. Hasbrouck and attending the planning hearing, I have found the compost site has a problem. and manure might have to be stored at a different site, or land applied and land has not been designated for such an application. This does not comply with CAFO regulations and to my knowledge has not been approved by CAFO. My greatest concern however is the water availability for dust control purposes. There is only one well on this property(11262-R). This well is only adjudicated for 400 gpm and at the present time will not perform at this capacity due to the drought in the area . The 11262-R well capacity should be tested. This well is only designated for irrigation and can not be used as proposed in the application. The only other water mentioned on the application is Water Supply& Storage stock. This water is also irrigation water and would have to be changed in court. This water is only available three to four months a year and therefore would not work for dust control in the other months of the year. It only stands to reason without this water extreme dust conditions could exist with not a very good way to control it. Mother problem this property has is that it lies in the Owl Creek floodplain which had water three to four feet deep at the proposed lagoon site in 1935 & 1965. Colorado state laws require that the water available on this property can only be used for irrigation and therefore can not be used for dust control as proposed in this application. Therefore with the lack of water, the lack of CAFO permits for manure composting and storage, and the Owl Creek floodplain. I would very much like you to consider these potential problems before granting this property iilli a USR permit. [ I. Box 758 Greeley CO 80632 Re: Traffic Speeds on WCR 90 Dear Commissioners, I would like to express my concerns of excessive speeds of vehicles, especially large semi-trucks on WCR 90 between Hwy 85 and WCR 45. I travel this road weekly and many times have been worried about entering WCR 90 from WCR 43. The semi-trucks seem to be traveling excessively over the speed limit and it is dangerous for any cross traffic or traffic attempting to turn onto WCR 90. Thank you for hearing my concern. Box 114 Ault, CO 80610 EXHIBIT • QS : t' Weld Count Commissioners September 14, 2008 • Re: USR 1661 —Buffalo Feedlot I have some questions based on the Special Review Permit Administrative Review from Mr. Gathman and the Specific Site Development Plan that I am assuming is supposed to address the concerns in the first document. In the administrative review, it states that any manure storage needs to be located toward the center of the site. This is mentioned again in the section discussing conditional approval as something that needs to be addressed. Section A,number 13 states, "Manure storage and/or composting areas shall be indicated on the plat to provide adequate storage for the facility at full build out. These areas shall be located toward the center of the property to buffer from neighboring properties." In section G it states that the applicant must "demonstrate that the facility has adequate manure storage in the event that off site composting becomes unavailable or not economically feasible. The application materials state that manure produced will be composted or hauled off and provided to local farmers. No composting area or manure storage areas are designated on the site plan map." None of the information I have seen indicates this requirement has been met. We were told repeatedly at the September 2n°meeting that the composting facility was a separate proposal and could not be discussed. It seems to be implied, however, even in the county paper work that these two are directly linked. In the Specific Site Development Plan that addresses development standards, the only discussion of this is in number 15 stating, "the applicant shall remove, handle, and stockpile manure from the livestock area in a manner that will prevent nuisance conditions". I don't however, see • anywhere in the topographical photo that this has been planned for. I am expecting this to be addressed before this is approved. In number 13 of the same document, it talks about control of flies and says measures will be implemented in the event that the flies are considered to be a nuisance condition. My question is in regards to who exactly gets to decide if the flies are a nuisance. This seems to be set up in favor of Mr. Hasbrouck. The paragraph discussed flies "which can be determined to be associated with the facility." That would be next to impossible to prove where the flies came from. So do we just have to suffer with them? Number 14 discusses odor control saying odors detected of site won't exceed the level of fifteen to one dilution threshold. Who exactly will measure that and at what times of day? I am guessing no one will rush out there to measure this when we as neighbors have a concern. A few final comments. At the September 2 hearing, Mr. Hollingsworth told us this type of feedlot has never been made before and reassured us several times that the wastewater pond will not smell. If it's never been done before, how can he be so sure that there will not be problems? Also, maybe he should put his money where his mouth is. Maybe he should be the one who offers to live 250 feet from a wastewater pond. I don't, however, see him, Mr. Hasbrouck or anyone else rushing to buy our property as a prime piece of real estate on which to build their dream home. We have diagnosed her with asthma. We started William A. Lanting, M.D. treatment with inhaled anti-inflammatory therapy and she is now totally asymptomatic and doing quite well. She had allergy testing also which was positive to different items including trees, grasses, weeds, molds, etc. Karen is doing very well now with this and other nasal treatment. Previously she had been quite symptomatic on a daily basis and is now asymptomatic. It is my understanding that this is still in the planning stages. They are her health because of asthma, the effect of our sheep on the buffalo, and property values. I have some questions that I would like to have answered. What if my wife gets sick and 1 have to keep taking her to the hospital? Who is going to be looking out for us then? I understand everyone is telling us there won't be any dust. But what about in the wintertime when it is too cold for the sprinklers to run? Have any of you be around a pile of manure in the winter when the wind is blowing? Most of our North West winds are in the winter. That manure and dust will be blowing in our direction. There is a good chance this feedlot will have a negative impact on our finances both in terms of property values but also in medical bills. What if my wife is unable to breathe and we are forced to move? Which one of you is going to offer to buy our home? Like many Americans, • we can't afford to walk away from it. While Mr. Hasbrouck's feedlot is making money, we could lose everything. What if the Buffalo get sick and start dying? Is that going to come back on us? Will we be held responsible for this even though Mr. Hasbrouck is aware of the problem now before the feedlot has even been built? And who do we talk to when problems arise? Do we talk to Agpro or to Mr. Hasbrouck? When my wife can't breathe at 2 in the morning, who do I get out of bed? I would appreciate some answers to my questions.
