HomeMy WebLinkAbout840298.tiff RESOLUTION RE: APPROVE CONTINUANCE OF HEARING FOR USE BY SPECIAL REVIEW, DOG KENNEL, LEWIS AND BARBARA CORNELL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of admini-stering the affairs of Weld County, Colorado, and WHEREAS, a Use by Special Review hearing for a dog kennel, requested ±y Lewis and Barbara Cornell, was scheduled for March 7 , 1984 , at 2 : 00 o' clock p.m. , and WHEREAS , at the hearing -of March 7, 1984 , only three Com- missioners were present, and WHEREAS, the applicants did request that this :natter be continued to a date when all five Commissioners will be present, and WHEREAS, the Board did determine that this matter be con- tinued to March 21 , 1984 . Commissioners C. Carlson and Brantner were ex- cused from this hearing. Lee Morrison, Assistant County Attorney, read this item into the record. Rod Allison, Planning Department representative, said the applicants wished to have this matter continued until a time when all five Commissioners will be present. MOTION: Doug Graff moved Case Number USR-616:84:12 for Dakolios Construction Company for a Use by Special Review Mining Permit for an open-cut wet gravel pit to forwarded to the Board of County Commissioners with the Planning Commission's recommendation for approval based upon the recom- mendations of the Department of Planning Services staff, and the Opera- tion Standards as amended by the staff. Motion seconded by Jack Holman. The Chairman called for discussion from the members of the Planning Commis- sion. Discussion followed. The Chairman asked the secretary to poll the members of the Planning Commission for their decision. Cornell REQUEST: A Use by Special Review Permit fora Dog Kennel LEGAL DESCRIPTION: Lot 11, Block 2, JoAnn Subdivision; located in part of the SE4, Section 26, TIN, R66W of the 6th P.M. , Weld County, Colorado LOCATION: Approximately 3.5 miles northwest of Lochbuie; north of Weld County Road 4 Rod Allison stated this case was heard by the Planning Commission at an earlier date. At this meeting the Planning Commission recommended denial to the Board of County Commissioners. The Board has sent this application back to the Planning Commission asking them to work with the applicants to see if a compromise could be made to made the site compatible with the surrounding area. Summary of the Weld County Planning Commission Meeting March 6, 1984 Page 16 APPEARANCE: Fred Otis, Attorney,'represented the applicants. He stated that after reviewing this case with the Cornelis' he felt the case had been unfairly represented. He also felt the use, as critiqued by the State Humane Society and the Weld County Health Department was unfair. This kennel is not a licensed kennel, therefore, it does not need to comply with these requirements.. Mrs. Cornell is only operating the kennel for her own pleasure; this is her hobby. According to the County regulations she does have a kennel, but according to the State she does not. Mr. Otis reviewed the statements made by the Humane Society, stating he did -t feel they were really fair because when they were out there we were :_other _ incar. "r- :ornel _ to meet the deadlines outlined by the scarf. She is willing to ::pond the money and the time to put in a good facility. Mr. Otis distributed pictures of the surrounding area to the members of the Planning Commis- sion. These were retained as evidence. Tape 155 - Side 1 Mr. Otis also stated the Cornells are now asking to be allowed to keep eighteen dogs instead of twenty-four as stated in the first application. He also felt the thirteen letters objecting to the kennel could not be considered as valid letters objecting to this proposal as they were zeroxed copies with boxes for the surrounding property owners to check-off and sign their name. Barbara Cornell, property owner and applicant, appeared and -explained her plans for the kennel operation. She raises and shows Golden Retrievers and Smooth Fox Terriers. The Chairman askedSod Allison to read the recommendations of the Depart- ment of Planning Services staff, which is for denial, into the record. He also read Operation Standards in accordance with the directive from the Board of County_Commissioners. The Chairman calle3 for discussion from the audience. Barbara Flashet, Colorado Dog Fancier's Association, and Pat Schmidtz, a professional handler, spoke on the high quality of dogs Mrs. Cornell has, and on the cleanliness of the kennel area whenever they have been there. Ron Stow, Weld County Health Department, stated Mr. Otis correctly stated how they had reviewed this kennel. Their standard forms do not allow them to critique an operation comparable to this. The Health Department can live with the Operation Standards, as outlined by the staff, if they are adhered to by the applicants. c c Summary of the Weld County Planning Commission Meeting March 6, 1984 Page 17 Mr. Otis stated he disagreed with #2 of the staff's recommendations. There are not four properties within five hundred feet of the Cornell's, there is only one. He felt all other concerns regarding the health, safety and welfare of the neighborhood had been adequately answered, as well as the problem of compatibility. Rod Allison read an amendment into the Operation Standards as follows: 11. A bond in the amount sufficient to guarantee the cost of the improvements setforth in the Use by Special Review Operations shall be executed payable to the Board of County Commissioners in Weld County. Said bond is to be executed by the operator and a corporate surety doing business in the State of Colorado. The bond shall be released by the Board of County Commissioners following a hearing after the improvements have been made. Mr. Otis did not agree with this standard. The bond for performance for a Use by Special Review Permit is that the permit is revoked if the dead- lines, which are set in the operation standards, are not met. MOTION: Bill McMurray moved Case Number USR-596:83:59 for Lewis W. and Barbara S. Cornell for a Use by Special Review Permit for a dog kennel be forwarded to the Board of County Commissioners with the Planning Commission's recom- mendation for denial based upon the recommendations of the Department of Planning Services staff. Motion seconded by Doug Graff. The Chairman called for discussion from the members of the Planning Commis- sion. Discussion followed. The Chairman asked the secretary to poll the members of the Planning Commission for their decision. Bill McMurray - yes; Sharon Linhart - No, because her feeling is that Mrs. Cornell deserves a chance to upgrade her facility, and a chance to pursue her hobby in the subdivision. It appears, from the photographs that have been submitted, that the subdivi- sion is an agricultural type subdivision in which other animals are being raised, and she is not sure that neighboring horses, cows, pigs, etc. , are any more of a nusiance to neighbors than are Mrs. Cornell's dogs. She feels she does deserve to have a chance to prove herself to us. Doug Graff - no; Louis Rademacher - No, for the same reasons Sharon has given. Bob Ehrlich - No, because he feels his reasons are best summed-up through the recent T.V. commercial where the little lady steps up to the counter and says, "Where's the beef"? His question is, "where's the subdivision?" It does appear that this dog kennel does; or can become, consis- tent with the existing subdivision with the Operation Standards as out- lined by the staff, and that the amendment, #11 of the Operation Standards concerning bonding, be deleted. Motion seconded by Louis Rademacher. The Chairman called for discussion from the members of the Planning Commission. Discussion followed. The Chairman asked the secretary to poll the members of the Planning Commission for their decision. That there is adequate provision for the protection of health; safety and welfare of the inhabitants of the neighborhood and the County. 2. The applicant is requesting approval of an existing dog kennel with a maximum of eighteen (18) dogs on a four and one half (4.5) acre parcel of land. There are approximately four (4) residences on properties within five hundred (50-0) feet of this proposal. In addition, there are approximately three (3) vacant lots -eligible for homes within five hundred (500) feet of this proposal. Due to the current density of this neighborhood, the proposal is not compatible with existing surrounding land uses. Dear Sirs, I have known Mrs. Barbara Cornell for 13 years. In that time , I have handled ( shown) her dogs at A. K. C. Dog Shows all over the country. I am a professional dog handler and have been since 1967. I also own a kennel. In the 13 years Mrs. Cornell's dogs have always been in excellent show condition. In order to keep a dog in show condition, they must be carefully cared for. Mrs. Cornell is a dedicated breeder/exhibitor. Her dogs are a very important part of her life. My husband and I own and operate a kennel and have since 1971. Our kennel is an indoor-outdoor kennel similar to Mrs. Cornells. I can telljg% rom first hand experience maintaining a kennel through the pastnwas a very difficult job. Because of the extreme cold it was impossible to keep water in front of the dogs 24 hours a day. It was necessary to carry water to them 7 or 8 times a day and make sure they drank it before it froze. This would explain why it would be possible for someone spot checking" any indoor-outdoor kennel to find dogs without water or with frozen water. Clean-up at times was totally impossible. You do the best you can when it is snowing and freezing day after day. I can fully understand how a"spot check would show an accumulation of dog manure during this type of weather. It was not possible to thoroughly clean up until it started to thaw. As you know we did not have many "thaw" days in Nov. , Dec. or Jan. As I said, Mrs. Cornell is a dedicated breeder and I am sure under normal, weather conditions her kennel would have been in excellent condition. Because of the time, work, care and money it takes to breed, raise, train,; and show dogs, it would not make sense for anyone to keep valuable dogs in anything but good conditions. Mrs. Cornell has proven herself as a breeder, exhibitor to the professional dog people in this area over the years. She is respected for her careful breeding program and her honesty in the sale of puppies. To take away her good reputation, let alone her excellent dogs after all these years without a complaint from anyone, until now, seems very unfair. Thank you for your time and consideration. Lafayette, Co. 80026 665-4277 17 February 1984 Lakewood, Colorado Hearing Bcard Weld County Planning Commission Greeley, Colorado Gentlemen: This letter is addressed toward your forthcoming hearing regarding Barbara Cornell and the future of her Taragold Goldens, I thave known Barbara for several years - as an AKC exhibitor, as a member of the Mile Hi Golden Retriever Club, but most of all as a person who has deep and personal convictions about the welfare, needs, and our responsibilities toward all dogs - not only Golden Retrievers, As the Director of a Rescue Organization whose animals are the products of irresponsible pet ownership, my first contact with Mrs. Cornell was when she took into her home a very ill, malnourished, and abused male golden. She did this for me without hesitation or regard for the welfare of her own show quality Goldens because he had no other place to go. This Golden Retriever named "Redford" is alive, well, and happy in a loving home because of the efforts of Barbara Cornell. - I have visited Mrs. Cornell's home and its remote location, isolation, and difficulty of access make the presence of her goldens very difficult to notice. On my first visit, I spent three hours driving country roads without success and finally gave up and returned home to acquire new directions. Please be encouraged to offer favorable consideration to her desire to remain in her present home and continue.. having her golden family.
