HomeMy WebLinkAbout20082148.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST ANDREW MOORE III FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Andrew Moore Ill, ZCV#0800133, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 12th day of August, 2008, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Andrew Moore II l, property owner, and Walter Richie, tenant, were present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until September 12, 2008, to allow adequate time for the property owner and tenant to complete the screening in front of the gate area, and to license or remove the school bus to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. I also noted trash. No pictures were taken during this inspection. 06/26/2008 Phone Call Andrew Moore left a message saying that I need to send the letter to his tenant (Walter Ritchey???) - 11604 Julius St, Fort Lupton, Co 80621. He didn"t leave a phone number. 07/16/2008 Property Inspected Upon a visual inspection of the property, the following items were noted: No visible progress. Still has derelict vehicles (cars, trucks, vans, boats, etc) all over the property and lining the street. No pictures were taken during this inspection. 07/24/2008 Phone Call Andrew Moore (720-427-7268 message number) called. He said he just received a notice indicating that he was scheduled for a Violation Hearing on August 12, 2008. He asked for me to continue this hearing. He said he is trying to make his tenant (Walter Ritchey) understand how important it is for him to take this seriously. He really doesn't want to have to go through the eviction process, because the house is so delapidated now, that he would have to spend thousands of dollars to remodel it in order for it to get rented out again. I explained that I would not be willing to grant a continuance. He would need to attend the hearing and request an extension from the Board. As long he was able to provide an action plan and examples of what he has done in the mean time to correct the violation, the Board is pretty good at granting additional extensions. I explained that the Board probably would not grant a long extension, but he could probably talk them into 60 days or so.
