Lupton, CO x0� 02°' Q m o Dear Ms. Krieger I have attempted to discuss this special use request that lies within your IGA boundaries with you, but was told that no further discussion was necessary, unless brought through the Weld County referral process. Weld County, however, has asked that I attempt— again—to bring to your attention the clients willingness to work within Dacono's process. Mario Calderon has operated his concrete construction business on this property, since he purchased it in July of 2002. Prior to his purchase the previous owner operated a construction company on this same site—without complaint from neighbors, but unfortunately without approved zoning. Directly north of this site is another business currently in operation that has the necessary zoning allowing a commercial use. This area has many commercial features-dotted with oil/gas wells—5 within walking distance of this site, also high voltage power lines and radio towers all within view of this property. • Wanting to be a good neighbor, Mr. Calderon is willing to comply with the additional requirements to mitigate the business use, next to residential, by adding landscaping and fencing along CR-15 and any area used for storage- per Weld County criteria. He is also wondering if there is criterion that Dacono would like implemented, to help this project be viewed more favorable, if approved during this review process. My understanding is that"staff' reviewed the IGA request for this property and found it to abe within a residential growth area and from that, recommended denial. I attempted to find out if anyone actually visited the site to see if this project impacted the area negatively, but no other information was available. I am requesting a "nem/ look at this project to see if we cannot help each other in this O , challenge- If Mr. Calderon is forced to move his business it will cause a financial burden greater than improving the property. Again, he's used this site for years without violation J F or complaint from the Town of Dacono or Weld County. The City of Dacono continues to work towards implementation of its Comprehensive Plan. The proposed use as described in USR-1640 is not In compliance with the intent, goals or objectives of the City's Comprehensive Plan. The City of Dacono did not respond to correspondence dated January 3, 2008 from Mr. Carry Carroll. Since the proposed use in USR-1640 is such a departure from the intended goals and objectives of the Dacono Comprehensive Plan, any negotiation by Staff regarding acceptable uses and standards on the petitioned site would constitute an amendment to the Comprehensive Plan without following the proper amendment procedures. The City of Dacono recognizes that the property owner has been operating a business on the site since 2002. The City of Dacono has reviewed the recommended conditions for development on the site as prepared by the Weld County Department of Planning Services. If the Weld County Commission approves USR-1640 over the objections of the City of Dacono, the conditions as set forth in the Weld County staff report are acceptable.
