Saint Vrain Lakes PUD
Staff review of the application materials indicates that the previous discussion with the
applicant remains valid specific to the on-site access, security and landscape details.
Construction access will be from the existing single track access across the agrarian
fields. Later, when the PUD begins to develop, access for monitoring, pick up of
product will be from roads off of CR 9.5. The access to the facility will be form the
southwest into the facility located at a point west of the elementary school site, thus
avoiding potential conflicts with school children and school buses.
The facility will be fenced with small gauge vinyl coated chainlink fence or appropriate
• equal thus removing the potential attractive nuisance of the facility by unauthorized
intrusions. It was noted that there will be some level of onsite security, yet undefined.
The access gate and tracking pad was also discussed, including reinforced concrete
over the sidewalk and into the site. Planning strongly encourages an integral landscape
treatment be implemented on location that will tie into the existing framework of the St.
Vrain Lakes PUD masterplan.
Staff noted the possibility of an On-Site Improvements Agreement for all internal
improvements. This documented will be evaluated at a future date uncertain.

I have reviewed the material pertaining to the Site Specific Development Plan and Special
Review Permit for the drilling of oil and gas wells south of Weld County Road 28 and east of
Weld County Road 9.5 in the Carma Bayshore subdivision in Weld County. (Case Name: Kerr-
McGee Oil & Gas — Carma, Case Number: USR-1653). The location of the proposed wells is
within the boundaries of the Mountain View Fire Protection District and receives service from the
• District.
The Fire District does not object to the drilling of the wells. The Response Plan meets the
requirements of the Fire District.
Nothing in this review is intended to authorize or approve any aspect of the proposed project that

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS:
Weld County 1-25 Parallel Arterial Study: (September 2003) WCR 9.5 is classified by the County is a major
arterial road and requires a 140-foot right-of-way. There is presently a 60-foot right-of-way. This road is
maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance
(23-1-90), the required setback is measured from the future right-of-way line. (WCRs 5.5, 7, 7.5, 9.5, and 11)
I-25 MUD Roadway Standards: (July 2004) WCR 28 is classified by the County (I-25 Mixed Use
Development Area Structural Plan — Map 2.2 Structural Transportation Network.) as a minor arterial which
requires a 100-foot right-of-way at full build out.
•EQUIREMENTS:
Access: The applicant is identifying two access points to the proposed site. The existing access is temporary
from WCR 28 (Eagle River Road) and the optional access from WCR 9.5 (Lake Catamount Parkway). The
applicant shall provide a tracking control pad in using both locations.
The access width requirements for emergency equipment (fire department) are a minimum of 20 feet. The
applicant indicated that it has been cleared with the fire department and emergency services that the width and
weight capacity of the access lane shall be adequate for emergency purposes. The applicant shall provide
documentation to that effect.
The right-of-way or easement shall be a graded and drained road to provide an all-weather access. The
easement shall be graded and drained to provide an all-weather access.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.
Storm Water Drainage:
Final drainage construction and erosion controls plans (conforming to the final drainage report) stamped,
signed, and dated by a professional engineer license in the State of Colorado shall be submitted with each
plan (phase). These plans (storm water management plans) shall be based upon urban drainage methodology.
Ike applicant is required to comply with all Colorado Department of Health and Environmental (CDPHE)
regulations regarding berming and spill prevention for materials and liquids stored on site.
The applicant is required to comply with all Colorado Department of Health and Environment, Water Quality
ontrol Division regulations regarding storm water quality permitting and protection and construction storm
ater discharges.
County Permits: The County permits are required for any drilling rigs that are over width or overweight
utilizing County roadways. Contact Amy Burry at 381-3779 at 1111 H. Street, Greeley, Colorado, prior to
moving on or off site.

I am responding to the letter from Robert T. Spencer, Kerr-McGee Oil & Gas Onshore LP, dated May
19, 2008.
1. Prior to recording the plat: 1. E. i, a tracking pad would be installed at the entrance of the
primary access road off of the future Lake Catamount Parkway. This has been placed on
the plat drawing and is acceptable. The applicant is not identifying the existing access
(temporary) tracking pad from WCR 28 and or future Piedera River Road. The plat
drawing is identifying SUA vehicle access easement, 30 feet in width. If this 30-foot
easement is being utilized to access the facility either as a temporary or a secondary use,
there should be a tracking pattern in place adjacent to the roadway.
• In my previous memo dated April 23, 2008, under the Access Requirements, the access width
requirement for emergency equipment (fire department) is a minimum of 20 feet. On the plat drawing,
the applicant has indicated a 30-foot width, which is acceptable. The other item associated with this
paragraph is that the applicant shall provide documentation from the fire department emergency
response team that the width and weight capacity of the access lane shall be adequate for emergency
purposes. The applicant shall provide this documentation to that effect.

I need to have this added as a development standard.
When the Carma development occurs around this area the turning radii will have to be
upgraded to 40 ' minimum, to ensure the oil and gas traffic stay in their traffic lanes and
do not jump the sidewalks as they turn into the wellhead and tank battery areas. All
damages created by oil and gas traffic to the surrounding roadways, curb and gutter and
sidewalks will be required to be repaired at the expense of the Kerr-McGee Oil & Gas
Onshore LP.
The reason for this is there will be children on the sidewalks, more traffic in the area
and pedestrians walking around, this is a safety issue.

Environmental Health Services has reviewed this proposal for an oil and gas production facility.
We have no objections to the proposal, however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirement be met prior to allowing the plat to be recorded:
1. The applicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
Environment.
We recommend that the following requirement be incorporated into the permit as a condition
• that must be met 45 days after first production:
1. The applicant shall submit evidence of an Air Pollution Emission Notice (APEN)
application from the Air Pollution Control Division, Colorado Department of Health and
Environment. Alternately, the applicant can provide evidence from the APCD that they
are not subject to these requirements.
We recommend that the following requirements be incorporated into the permit as development
standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities
Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in
a manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not meant to
include those wastes specifically excluded from the definition of a solid waste in the
Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance
conditions.

4. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The
•
facility shall be operated in accordance with the approved dust abatement plan at all
times.
5. The operation shall comply with all applicable State noise statutes and/or regulations.
6. Adequate toilet facilities (port-a-potty) shall be provided during drilling/construction.
7. Bottled water shall be utilized for drinking and hand washing during drilling/construction.
8. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado
Department of Public Health & Environment, Water Quality Control Division.
9. The operation shall comply with all applicable rules and regulations of the State and
Federal agencies and the Weld County Code.
