RE: GRANT REQUEST TO PREADVERTISE SITE SPECIFIC DEVELOPMENT PLAN AND
USE BY SPECIAL REVIEW PERMIT#1665 - HIGH PLAINS DISPOSAL, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has received a request from Andy Cunningham, High Plains
Disposal, Inc., 601 South Main Street, Suite 215, Grapevine, Texas 76051, c/o Bradley Curtis,
Lamp Rynearson and Associates, Inc., 808 8th Street, Greeley, Colorado 80631, for
preadvertisement of an application for a Site Specific Development Plan and Use by Special
Review Permit#1665 for an Oil and Gas Support Facility(Class II-Oilfield Waste Disposal Facility)
in the A (Agricultural) Zone District, and
WHEREAS, said property is described as part of the Ni/2 of Section 25, Township 5 North,
Range 65 West of the 6th P.M., Weld County, Colorado, and
WHEREAS, after study and review the Board deems it advisable to grant said request,with
the hearing date to be set as October 29, 2008, at 10:00 a.m.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request from Andy Cunningham, High Plains Disposal, Inc., for
preadvertisement of an application for a Site Specific Development Plan and Use by Special
Review Permit#1665 for an Oil and Gas Support Facility(Class II-Oilfield Waste Disposal Facility)
in the A (Agricultural) Zone District, be, and hereby is, granted.
BE IT FURTHER RESOLVED by the Board that the hearing date to consider said request
be, and hereby is, set as October 29, 2008, at 10:00 a.m.

Use by Special Review Permit #1665, which will be heard by the Planning Commission on
October 7,2008, be pre-advertised. If you wish to approve this request,a hearing before the Board

SUBJECT: USR-1665 — Pre Advertisement
High Plain Disposal represented by is requesting a pre-advertisement for USR-1665 (Waste
Water Disposal facility). The applicant has indicated in the attached letter dated August 22,
2008 that the reason for this request is that the applicant does not anticipate any significant
issues or concerns to be brought up during the Use by Special Review process and is
requesting an expedited hearing date of October 29, 2008. The Planning Commission hearing
is scheduled for October 7, 2008.
Section 2-3-40.C states that the applicant shall appear at the Board of County Commissioners
meeting and explain why the pre-advertisement has been requested. The applicant must show
that the request for pre-advertisement is necessary because of an emergency circumstance, or
that the delay caused by no pre-advertisement is likely to create severe economic hardship for
the applicant.
The applicant has not demonstrated that an emergency circumstance or severe economic
hardship will be created if this pre-advertisement request is not granted. The Department of
Planning Services is recommending denial of the pre-advertisement for USR-1665.

Dear Mr. Gathman:
This letter is regarding the Use by Special Review approval process for High Plains Disposal USR-1665.
In preparation for the Use by Special Review submittal and as required by the Weld County Planning
Department,the applicant does not anticipate any significant issues or concerns to be brought up during
the Use by Special Review referral/approval process that is underway.
With this in mind,the applicant wishes to expedite the Use by Special Review approval process and
hereby requests a"Pre-Advertisement"of the Board of County Commissioners' hearing for the October
29,2008 approval.
The Weld County Planning Commission is currently scheduled to hear this case on October 7,2008.
have coordinated with the Clerk to the Board regarding the possibility of completing the requested"Pre-
Advertisement"process. The Clerk to the Board informed me that the next available Board of County
Commissioners' hearing would be October 29, 2008 since the October 22,2008 date the Board of County
Commissioners will be at a conference. Since the applicant is anticipating the Planning Commission's
recommendation of approval to the Board,we request that the"Pre-Advertisement"process be completed
and this case added to the October 29, 2008 Board of County Commissioners' agenda. We have attached
the$100 processing fee as required. Please contact me if you have any questions or comments. Thank
