This project falls primarily under the purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division IV, Section 23. Our comments and requirements are as follows: COMMENTS: Weld County Road Classification Plan (FHU): (June 2002) WCR 17 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1- 90), the required setback is measured from the future right-of-way line. ADT: Weld County's most current average daily traffic count for WCR 17 between WCR 16 and WCR 18 reflect 114 vehicles taken in a 24-hour period. The east/west roads, 16 and 18 have counts • that reflect between 170 and 180 vehicles at this location. REQUIREMENTS: Utilize the existing access point from WCR 17 to access the dairy facility and on-site accessory to farm housing. Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for your agricultural operation. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. Off-Street Parking: The applicant has shown off-street parking to accommodate employee parking adjacent to the scale house, office, and shop area. Also the over flow parking is adjacent to the hay barn. Utilize these locations for additional parking. Traffic Study: The milk semi-transport trucks and commody trucks, and the employee traffic does not generate significant amount of additional vehicles to warrant a traffic study. Storm Water Drainage: The storm water drainage will be handled by a current waste water retention structure and berm. A nutrient management Plan has been submitted. The amendment will increase the number of livestock from 1450 to 5,000, add 2 new corral areas and 6 new barns. The applicant indicated, via email, that a CAFO permit will be applied for if this application is approved. The application indicates potable water is provided from 2 commercial wells; however no permits were included with this department's packet. Evidence of a tap from Central Weld County Water District was also not included in the packet. Individual Sewage Disposal Systems provide sewer provisions for the mobile homes and the milk parlor. This Department has 9 septic permits for mobile homes, as well as septic permits for the milk parlor and the office/scale house. • We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. Provide documentation, prepared by a Colorado Registered Professional Engineer, that all wastewater impoundments for the confined animal feeding operation (CAFO) meet seepage rate standards of Colorado Water Quality Control Commission Regulation 81. 2. Provide evidence that a Standard Operating Procedure for sludge and manure removal (cleaning of impoundments to maintain capacity) has been submitted for approval to the Colorado Water Quality Control Division required by Colorado Water Quality Control Commission Regulation Number 81. 3. Demonstrate that wastewater impoundments meet required setbacks to water wells and groundwater required by Colorado Water Quality Control Commission Regulation Number 81. 4. Provide evidence that a CAFO Colorado Discharge Permit has been applied for or obtained from the Colorado Water Quality Control Division. • • 5. Submit copies of the two commercial well permits and evidence of a tap from Central Weld County Water District to Weld County Department of Public Health and Environment . We recommend that the following requirements be incorporated into the permit as development standards: 1. The facility shall maintain compliance with the Colorado Water Quality Control Commission's Animal Feeding Operation Control Regulation Number 81 (5 CCR 1002-81). 2. The facility shall maintain CAFO Colorado Discharge Permit coverage and operate in compliance with Colorado Water Quality Control Commission Regulation Number 61. There shall be no discharge of manure or process wastewater into surface water from the production area, except as provided in the facilities CAFO Colorado Discharge Permit. 3. Manure and process wastewater shall be applied at agronomic rates and in accordance with the Nutrient Management Plan or Manure & Wastewater • Management Plan. There shall be no discharge from land application areas except for agricultural stormwater. 4. The facility shall be operated and maintained in a manner to prevent nuisance conditions and operate in accordance with the Management Plan for Nuisance Control submitted with the application materials. 5. The facility shall control fugitive dust on this site and be operated and maintained in a manner to prevent nuisance conditions. The facility shall be operated in accordance, at all times, with their current approved Management Plan for Nuisance Control. 6. The facility shall be operated in a manner to control pests. The facility shall be operated in accordance, at all times, with their current approved Management Plan for Nuisance Control. Additional control measures shall be implemented at the request of the Weld County Department of Public Health and Environment in the event that rodents (which can be determined to be associated with the facility) are in such a number to be considered a nuisance condition. • 2 . 7. The facility shall be operated in a manner to control flies. The facility shall be operated in accordance, at all times, with their current approved Management Plan for Nuisance Control. Additional fly control measures shall be implemented at the request of the Weld County Department of Public Health and Environment in the event that flies (which can be determined to be associated with the facility) are in such a number to be considered a nuisance condition. Additional controls shall also be implemented in the event the Weld County Department of Public Health and Environment receives a significant number of fly (associated with facility) complaints, and in the judgment of the Weld County Health Officer, there exists a fly condition requiring abatement. 8. The facility shall be operated in a manner to control odors. The facility shall be operated in accordance, at all times, with their current approved Management Plan for Nuisance Control. Odors detected off site shall not equal or exceed the level of fifteen-to-one dilution threshold, as measured using methods set forth in Regulation 2 of the Colorado Air Pollution Control Regulations. Additional controls shall be implemented at the request of the Weld County Department of Public Health and Environment in the event odor levels detected off site of the facility meet or exceed the level of fifteen-to-one dilution threshold, or in the judgment of the Weld County Health Officer, there exists an odor condition . requiring abatement. 9. The applicant shall remove, handle, and stockpile manure from the livestock area in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant runoff. The surface beneath the manure storage areas shall be of materials which are protective of State waters. These areas shall be constructed to minimize seepage or percolation of manure contaminated water. In no event shall the facility impact or degrade waters of the State in violation of Colorado Water Quality Control Commission Regulation Number 81. 10. Any Individual Sewage Disposal System (I.S.D.S.) on the property shall be permitted, installed, maintained and operated in compliance with Weld County I.S.D.S. Regulations. 11. The facility shall operate in compliance with applicable Colorado Air Quality Control Commission Regulations. There shall be no open burning except "agricultural open burning" as defined by Colorado Air Quality Control Commission's Regulation 9. • • 12. There shall be no permanent disposal of solid wastes, as defined in the Regulations Pertaining to Solid Waste Disposal Sites and Facilities (6 CCR 1007- 2), at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 13. The facility shall adhere to the maximum permissible noise levels allowed in the Light Industrial Zone as delineated in Section 25-12-103 C.R.S, as amended. 14. Waste materials, not specifically addressed by other development standards, shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 15. The applicant shall comply with all provisions of the Underground and Above Ground Storage Tank Regulations. 16. Adequate handwashing and toilet facilities shall be provided for employees and patrons of the facility. 17. A building permit shall be obtained prior to the change of use or construction of any structure, 2. A plan review is required for each building for which a building permit is required. Two • complete sets of plans are required when applying for each permit. Include a Code Analysis Data sheet provided by the Weld County Building Department with each Building permits application Plans shall include a floor plan showing the specific uses of each area for the building. The Occupancy Classification will be determined by Chapter 3 of the 2006 International Building Code the plans shall also include the design for fire separation and occupancy separation walls, when required by Chapter 5 and 7, requirements for exiting in Chapter 10 of the 2006 International Building Code. This is an amendment to the existing Busker Dairy, which was acquired by individuals associated with the TV Dairy. At time of initial application approval, 80 acres was utilized for 1450 head, with the property to the North having animal units in compliance with the Use by Right. The current applicant has acquired 262 acres. One tract at 205 acres and two tracts totaling 57 acres. With the acquisition of additional lands the dairy will be able to accommodate • the expansion as outlined in the application materials. The application materials did not explain the proposed landscaping for the site, either in writing or graphic delineation. The applicant shall submit a Landscape Plan to the Department of Planning Services for review and approval. Upon approval the Landscape Plan shall be placed on the plat, prior to scheduling the Board of County Commissioners Hearing as stated in the application materials.. At a minimum, the following shall be submitted: 1. The applicant shall adhere to the lighting requirements for off-street parking spaces per Section 23-4-30.E of the Weld County Code. 2. The applicant shall adhere to the lighting standards, in accordance with Section 23-3- 360.F of the Weld County Code 3. The applicant shall place "plant material" to mitigate the impacts of the facility from adjacent properties. The plant material screen shall be placed between the road right- of-way and the proposed improvements. The road base into the facility was not suitable for our fire equipment. There had been a storm and had left the access very wet and muddy. We had trouble maneuvering our fire trucks without getting them stuck. With the addition of the 6 new barns we need the road access to and from and around • the facility to be adequate to support our fire equipment. This up-grade of the roads needs to take affect immediately and continued before and after the construction.
