Description: Production Facility
There are six issued Building permits attached to this parcels.
1. A building permit shall be obtained prior to the change of use, or construction of any new
structures
• 2. A plan review is required for each building for which a building permit is required. Two
complete sets of plans are required when applying for each permit. Include a Code Analysis
Data sheet provided by the Weld County Building Department with each Building permits
Submittal plans shall include a floor plan showing the specific uses of each area for the building.
The Occupancy Classification will be determined by Chapter 3 of the 2006 International Building
Code. The plans shall also include the design for fire separation and occupancy separation
walls, when required by Chapter 5 and 7 of the 2006 International Building Code. Fire Protection
shall conform to Chapter 9 and exiting requirements by Chapter 10.
3. Buildings shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 2006
International Building Code; 2006 International Mechanical Code; 2006 International Plumbing
Code; 2006 International Fuel Gas Code; 2006 International Energy Conservation Code; and
the 2008 National Electrical Code and Chapter 29 of the Weld County Code.
. 4. All building plans shall be submitted to LaSalle Fire District Fire District for review and
approval prior to issue of Building Permits,

Dear Ms. Hatch:
This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to
county planning directors, this office will only perform a cursory review of the referral information and
provide comments. The comments do not address the adequacy of the water supply plan for this
project or the ability of the water supply plan to satisfy any County regulations or requirements. In
addition, the comments provided herein cannot be used to guarantee a viable water supply
• plan or infrastructure, the issuance of a well permit, or the physical availability of water.
According to the referral information the applicant will obtain water from a commercial well to
be located on the SemCrude property (Lot C). The referral information did not specify the well permit
number of the well, however according to the records available in the State Engineer's Office well
permit no. 65759-F has been issued to SemCrude LP for construction of a well on Lot C. Well 65759-
F is currently permitted for industrial, irrigation and commercial uses with a maximum pumping rate of
500 gpm and allowed annual withdrawal of 19.8 acre-feet. Our office has not received evidence that
the well has been constructed and the well permit expires on May 21, 2009. Once constructed, well
65759-F can be used to serve the uses proposed in the referral as long as the well is operated in
accordance with the terms and conditions of the well permit.

Environmental Health Services has reviewed this proposal to amend an existing oil and
gas storage facility. The amendment will consist of adding two oil polishing facilities for
Noble Energy, Inc. and Anadarko Petroleum Corporation. Although SemCrude LP
currently owns the 80 acre property, an application to create 2 - ten acre lots for
purchase by Noble and Anadarko has been submitted to Weld County. As the lots will
not be owned by SemCrude, individual water and sanitation facilities should be provided
for each 10 acre lot or a recorded agreement allowing utilization of SemCrudes water
and sanitation facilities should be provided and the reception number noted on the plat.
A Spill Prevention Control and Countermeasure plan (SPCC) for Anadarko has been
submitted. An SPCC plan for the Noble facility will be required and the plans shall be
• available on each site.
A truck washout building is proposed. This facility will be utilized to thaw frozen
discharge valves on the trucks in order to release the oil. The valve will be thawed by
spraying with hot water. A detailed design and operation plan is required to ensure
there is no discharge to groundwater.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit evidence of an Air Pollution Emission Notice
(A.P.E.N.) and Emissions Permit application from the Air Pollution Control
Division (APCD), Colorado Department of Health and Environment. Alternately,
the applicant can provide evidence from the APCD that they are not subject to
these requirements.
2. The applicant shall submit an updated dust abatement plan for all driving and
parking areas for review and approval, to the Environmental Health Services,
Weld County Department of Public Health & Environment. (WCDPHE)

• 3. A recorded agreement allowing utilization of SemCrudes water and sanitation
facilities shall be provided to WCDPHE. The reception number shall be noted on
the USR plat.
4. The applicant shall submit evidence of a Colorado Discharge Permit System
(CDPS) from the Water Quality Control Division of the Colorado Department of
Health and Environment for any proposed discharge into State Waterways, if
applicable.
5. The applicant shall submit evidence of an Aboveground Storage Tank permit
from the Colorado Department of Labor and Employment (CDL&E), Oil
Inspection Section for any aboveground storage tanks located on the site.
Alternately, the applicant can provide evidence from the (CDL&E), Oil Inspection
Section that they are not subject to these requirements.
6. A detailed design and operations plan for the truck washout building shall be
submitted to WCDPHE for review and approval. The design shall demonstrate
how all spilled waste, stormwater and wash down water will be contained. The
design shall also include the method to prevent leakage. A leak detection
system shall be designed and installed beneath the washout bay. The truck
washout shall be constructed and operated in accordance with the approved
• design.
7. A Spill Prevention Control and Countermeasure plan, for the Noble facility, shall
be submitted to WCDPHE.
8. The applicant shall submit an updated waste handling plan, for approval, to
WCDPHE. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
conditions that must be met one month prior to construction activities:
1. A stormwater discharge permit may be required for a
development/redevelopment/construction site where a contiguous or non-
contiguous land disturbance is greater than or equal to one acre in area. Contact
the Water Quality Control Division of the Colorado Department of Public Health

• and the Environment at www.cdphe.state.co.us/wq/PermitsUnit for more
information.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan".
• 5. The applicant shall comply with all provisions of the Underground and Above
Ground Storage Tank Regulations (7 CCR 1101-14).
6. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan" at all times.
7. The operation shall comply with all applicable State noise statutes and/or
regulations.
8. The truck washout shall be operated in accordance with the approved design and
operations plan.
9. The facility shall be constructed and operated to ensure that contamination of soil
and groundwater does not occur.
10.Any petroleum contaminated soils on the facility shall be removed, treated or
disposed of in accordance with all applicable rules and regulations.
11.Reception number allows the use of the adjacent parcel for drinking
water, handwashing and toilet facilities for employees and drivers.

. 12.Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
13. A Spill Prevention Control and Countermeasure plan shall be kept on site, at all
times.
14.All potentially hazardous chemicals must be stored and handled in a safe manner
in accordance with product labeling and in a manner that minimizes the release
of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's).
15.If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
16.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

The Weld County Public Works has been working with the applicant through the pre-application
and the 7-Day Completeness Review. All the items from my memo dated July 18, 2008, have
been added to the amended USR packet to complete my requirements.
Both the Long-Term Maintenance and Improvements Agreement and the amended agreements
have been through the county process and have been recorded with the Clerk and Recorder.
The drainage report has been stamped and signed by a professional engineer. The Weld
County Public Works feels that the applicant has met the requirements and recommends
forwarding this to the Planning Commission for a hearing on October 21, 2008.
