To Whom It May Concern:
The following are the comments and concerns for the above stated USR. All
requirements have been taking from the 2003 IFC and the most current NFPA standards.
• I did not sec any proposed new fire hydrants either on the maps or in the
documentation. Fire lines will need to be extended from the existing system on
site to cover the new turbines. The spacing on the fire hydrants needs to he no
further than 300 feet apart,
• The new fire hydrants need to be protected. 1 have enclosed Section 312 of the
• 2003 IFC.
• Fire extinguishers will need to be supplied around the new turbines. Types, sizes,
and distances need to mirror the existing turbines on site.
• Is the fuel dispenser on the east side of the property going to be moved'? If not,
then,distances from new turbines to fuel dispenser need to be giving Might still
need to be moved if to close.
• New gas line needs to comply with NFPA 54 - Fuel Gas Code& NFPA 58 -LPG
Code.
• Electrical for the new gas line needs to comply with NFPA 70--National
Electrical Code, Articles 500& 501.

Environmental Health Services has reviewed this proposal for a major facility of a public utility
(electric power plant and associated gas pipeline).
Water
Potable water is supplied by Central Weld Water District.
• Sewage
Sewage provisions are provided by two aerated lagoons, the discharge is permitted under
Colorado Wastewater Discharge Permit number— CO-0001121. Septic permit # SP-9600408
is utilized for the office building. This system was designed for up to 40 people and is
therefore adequate. There is also a vault system serving the laboratory building. It is
unknown if this vault is permitted.
The plant is currently permitted, through Weld County Department of Planning Services, via
USR-1063. This request will allow the continuing use of the plant and the installation of two
additional natural gas turbines and the associated gas pipeline.
We have no objections to the proposal, however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall amend the existing Emission Permit (APEN) for modification in the
operation if the Colorado Department of Public Health and Environment determines
that such a modification represents a significant change in emissions or production.
Alternately, the applicant can provide evidence from CDPH&E that a modification is not
required.
• 2. The applicant shall submit evidence of a Colorado Discharge Permit System (CDPS)
from the Water Quality Control Division of the Colorado Department of Health and
Environment for any proposed discharge into State Waterways. The CDPS that was
submitted with the application expired January 31, 2007. A copy of the draft permit is
acceptable.
3. The existing Colorado Discharge Permit System (CDPS) must be amended for the
increased operation if the Water Quality Control Division of the Colorado Department
of Public Health & Environment determines that such a modification represents a
significant change in the discharge. Alternately, the applicant can provide evidence
from CDPH&E that a modification is not required.
4. In the event that 1 or more acres are disturbed during the construction and
development of this site, the applicant shall obtain a stormwater discharge
permit from the Water Quality Control Division of the Colorado Department of
Public Health and Environment.
5. The applicant shall provide evidence that the facility has an adequate potable water
supply. (A letter from Central Weld Water District is sufficient).
6. All septic systems located on the property shall have appropriate permits from the Weld
County Department of Public Health & Environment. The applicant shall provide
evidence of septic permit for the vault system. If the existing septic system is not
currently permitted through the Weld County Department of Public Health &
Environment an I.S.D.S. Evaluation will be required prior to the issuance of the required
septic permit. The septic system shall be reviewed by a Colorado Registered
Professional Engineer. The review shall consist of observation of the system and a
technical review describing the systems ability to handle the proposed hydraulic load.
• The review shall be submitted to the Environmental Health Services Division of the Weld
County Department of Public Health and Environment. In the event the system is found
to be inadequate, the system must be brought into compliance with current I.S.D.S.
regulations.
We recommend that the following requirements be incorporated into the permit as a
condition that must be met one month prior to construction activities:
1. The applicant shall submit evidence of a Colorado Discharge Permit System or CDPS
permit from the Colorado Department of Public Health and Environment (CDPH&E),
Water Quality Control Division, to cover stormwater discharges from construction sites
(5 CCR-1002-61) Alternately, the applicant can provide evidence from CDPH&E that
they are not subject to the CDPS requirements. (New rule effective 3/2/2001).
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities
Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not meant to
• include those wastes specifically excluded from the definition of a solid waste in the
Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, blowing debris, and other potential nuisance conditions.
4. This facility shall adhere to the maximum permissible noise levels allowed in the

Industrial Zone as delineated in 25-12-103 C.R.S., as amended.
5. Any septic system located on the property must comply with all provisions of the Weld
County Code, pertaining to Individual Sewage Disposal Systems.
6. If applicable, the applicant shall obtain and maintain compliance with a stormwater
discharge permit from the Colorado Department of Public Health & Environment,
Water Quality Control Division.
7. Fugitive dust shall be controlled on this site.
8. Adequate hand washing and toilet facilities shall be provided for employees and
visitors.
9. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes. (Central Weld Water District)
10.Portable toilets and bottled water for drinking and sanitary purposes may be utilized
during the construction of the project.

The Weld County Public Works Department has reviewed this proposal. Our comments and requirements are
as follows:
COMMENTS:
Weld County Road Classification Plan (FHU): (June 2002)
WCR 19.5 is a collector road and requires an 80-foot right-of-way at full build out. There is presently a 60-foot
right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
REQUIREMENTS:
Direct access from a public road will be limited to one (1) per legal parcel, except as further limited or restricted
by zoning or subdivision regulations. Additional accesses may be approved by the Department of Public
orks or the Board of County Commissioners. This policy shall apply to all new and existing accesses within
e unincorporated areas of the County. Properties within municipalities or other counties which access
County roads are subject to this policy.
A 40' radius is required on all accesses to public roads for accesses designed to accommodate truck traffic. {A
minimum effective turning radius of forty (40) feet shall be used for accesses intended to accommodate truck
traffic. (Weld County Codification Ordinance 2000-1)} Sec. 8-2-40 B. Road access design standards.
The USR area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA).
Please provide all drainage/stormwater calculations for the proposed pond. Please provide calculations
showing the existing stormwater system capacities are able to handle the additional loading from the proposed
turbines.
Applicant must get all required Weld County permits for working in Weld County Rights-of-Way, for any
temporary road closures, etc. pertaining to this project.
The applicant must take into consideration storm water quantity capture and provide accordingly for best
management practices.

Description: Installation of 2 Gas Turbine Generators
There are 13 historical Building permits attached to the three parcels listed All have been finaled
1. A building permit shall be obtained prior to the construction of any structure.
0 2. A plan review is required for each building for which a building permit is required. Plans shall
include a floor plan. Plans for new structures shall bear the wet stamp of a Colorado registered
Architect or Engineer. Two complete sets of plans are required when applying for each permit.
Include a Code Analysis Data sheet provided by the Weld County Building Department with
each Building permits application. Building plans shall also be submitted to Platte/Gilchrest Fire
Protection District.
3. Buildings shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 2006
International Building Code; 2006 International Mechanical Code; 2006 International Plumbing
Code; 2006 International Fuel Gas Code; and the 2005 National Electrical Code and Chapter 29
of the Weld County Code.
4. Building height shall be measured in accordance with the 2006 International Building Code for the
purpose of determining the maximum building size and height for various uses and types of
construction and to determine compliance with 2006 International Building Code..
5. All building plans shall be submitted to the Platteville/Gilchrest Fire District for review and
approval prior to issue of Building Permits.

Re: USR-1647 — Public Service Company of Colorado ("Applicant") — Site Specific
Development Plan and a Special Review Permit for a Major Facility of a Public Utility
Dear Ms. Hippely:
This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to
county planning directors, this office will only perform a cursory review of the referral information and
provide comments. The comments do not address the adequacy of the water supply plan for this
project or the ability of the water supply plan to satisfy any County regulations or requirements. In
addition,the comments provided herein cannot be used to guarantee a viable water supply
• plan or infrastructure, the issuance of a well permit, or the physical availability of water.
According to the referral information the operation will be served by the Central Weld County
Water District("District") and Applicant's wells 11 and 12. The referral information also states that
Applicant's wells 3, 4, 9 and 10 may also be used. Our office has no comments regarding the
District's ability to serve the commercial operation.
The applicant currently has a court approved augmentation plan for well 10 (permit no. 14522-
RR) and well 11 (permit no. 14521-RR) and an approved substitute water supply plan for well 3
(permit no. 18904-TR), well 4 (permit no. 18904-UR), well 8 (permit no. 20480-SR) and well 9 (permit
no. 16860-RR). It appears based on the attached well permits that these are the wells that the
applicant will be using to serve the power plant. According to the records available in the State
Engineer's office it does not appear that the Applicant's well no. 12 (permit no. 2584-F based on the
applicant's court decree) is currently augmented. Therefore such well cannot be used until such time
as a court approved augmentation plan is approved.

Landscape Referral - USR-1647
The Department of Planning Services reviewed the above referenced Use by Special Review
documentation and drawings and offers the following comments:
The Use by Special Review Plat shall be prepared in accordance with Section 23-2-260.D and
21-3-330 of the Weld County Code. In addition to these requirements, the plat scale shall be
1" = 20 feet, with the Vicinity Map delineated at a scale of 1" = 2000 feet. Further, it is
requested that a Legend of Symbols be employed to call out the specific equipment associated
with this facility. The text on the submitted plat is difficult to read given the font selected.
This application shall be in compliance with Section 23-3-350 and is address in the following
comments, as applicable.
Section 23-3-350 addresses the Design Standards applicable to this proposed facility.
Per Section 23-3-350.B, the applicant shall delineate all areas associated with outdoor storage.
These areas shall be screened from adjacent properties and public rights-of-way. The applicant
shall delineate an opaque visual screen on all sides of the property to mitigate the potential
negative impact and aesthetic concerns on surrounding properties, specifically during
construction of the two Peaker Generating Units.
Section 23-3-350.G addresses the Required Landscape areas. The USR Plat has not identified
areas for landscape treatment. Given the type of facility, Staff will not request a Landscape
Plan for this facility. Staff does request that all areas disturbed by construction activities
including pipeline placement be drilled with an appropriate seed mix to limit the potential on-site
erosionary processes. The seed mix, prepared by a professional/consultant seed company or
government agency shall be submitted for review and approval prior to recording the USR Plat.
Section 23-3-350.H addresses the issue of trash collection areas. Areas used for storage or
trash collection shall be screened from adjacent public rights-of-way and adjacent properties.
These areas shall be designed and used in a manner that will prevent wind or animal scattered
trash. This fence enclosure structure shall be delineated on the USR Plat.
Section 23-3-360 addresses Operation Standards. The applicant shall address the issue of
noise, air quality, water quality, radiation and radioactive material, heat light, and property
maintenance.
• Section 23-3-360.A addresses noise. The Department of Public Health and Environment will
regulate the maximum permissible noise levels allowed for this facility. Further, the application
materials state the existing facility operates twenty-four hours each day, seven days per week
each calendar year.
• Section 23-3-360.F addresses the issue of on-site lighting, including security lighting if
applicable, this section, states "any lighting ... shall be designed, located and operated in such a
manner as to meet the following standards: sources of light shall be shielded so that beams or
rays of light will not shine directly onto adjacent properties...." Staff shall require a Lighting Plan
be submitted for review and approval prior to recording the USR Plat.
Section 23-3-360.G addresses property maintenance. Should noxious weeds exist on the
property or become established as a result of the proposed development the applicant/
landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15,
Articles I and II of the Weld County Code.
All other operation standards will be addressed by other referral agencies as warranted.
The applicant shall delineate all on-site signs. The signs shall adhere to Article IV, Division 2 of
the Weld County Code. Further, the location of the signs shall be delineated on the USR Plat.
All structures, including signs, on site must obtain the appropriate building permits.
The applicant shall enter into an Improvements Agreement according to policy regarding
collateral for improvements and post adequate collateral for all transportation and non-
transportation components as required. The Department of Public Works will address
additional requirements as warranted. Should the Improvements Agreement be required for this
facility, the agreement and form of collateral shall be reviewed by County Staff and accepted by
the Board of County Commissioners prior to recording the USR plat.
