Please find this letter as a courtesy notification of the progress we're
making with the property that Northern Colorado Disposal has under
contract.
Northern Colorado Disposal is in the process of applying for a Use by
Special Review (USR) for a Recycling Facility and Transfer Station
through the office of Weld County Planning. The proposed site is located
at the Southwest Corner of 59th Avenue (WCR 31) and O Street (WCR
64).
As you are aware, we are having a neighborhood meeting in October and 1
will invite you as soon as we have the date and time established.
Secondly, the next step with Weld County will be a Planning Commission
meeting to be held at the Weld County Planning office located at 918 10th
Street. Tentatively the meeting is set for Tuesday, November 4th. When I
notified of the start time of the meeting, I will forward that information to
you.

General
1 City staff met with the applicant and engineer on June 6, 2008. Issues such as
screening (landscaping and fencing), setbacks, ROW dedication, building materials,
fumes, water and water quality, and ingress/egress were discussed and generally
• agreed upon.
Response: Noted and agreed with.
City Limits
1 This property is adjacent to existing City of Greeley municipal limits, additionally this
property and the properties around it are substantially surrounded by Greeley
incorporated area.
Response: Noted.
Environment
1 This property is located within an area of moderate ecological significance.
Appropriate steps to mitigate impact to the local environment should be taken. An
example of this would be to providing landscaping around the site which would also
serve as screening for the facility.
Response: Landscaping is proposed along WCR 64 (O Street) and 59th Avenue.
In addition,the landscaping is proposed on the outside of the fencing and
screening, providing additional benefits to the surrounding neighbors and
environment. See the attached updated site plan for Landscaping Buffers.
Fencing
1 Fencing on a site this large should be opaque and provided screening to the site.
Such fencing should be broken up though the use of columns or pillars.
Response: Fencing will comply with the Weld County requirements. In areas
that screening is mandated, opaque fencing will be used.
• Growth Area
1 This property is located within the City of Greeley's Long Range Expected Growth
Area, it is likely that this property will be incorporated into the City at some point in the
future.

Landscaping
1 This site, while in a transitional area now between urban and rural areas will be highly
visible on a major thoroughfare. Landscaping and buffering should be provided to
meet City of Greeley standards. This can be accomplished through any number of
combinations of fencing, berming, and plantings.
Response: Noted. See the attached updated site plan for Landscaping Buffers.
Right-of-way
1 Right-of-way for the future expansions of"O" Street and 59th Avenue should be
dedicated at this time. Both roads are intended to become Arterial roadways with "O"
Street acting as a Major Arterial.
Response: The Right-of-ways for both streets have been shown on the
attached updated site plan and will be dedicated upon completion of the
•
approval process and final purchase of the property.
Structure
1 The application does not mention the materials, configuration, or type of structure that
will be present on the site. The building should conform to City of Greeley standards
• as it is adjacent to City limits and, along with nearby properties, substantially
surrounded by properties already incorporated into the City of Greeley.
Using a mix of materials such as stucco or brick is recommended and would be
required if within the City of Greeley as this property is and will be highly visible from
major roadways. Similar projects have utilized stucco embossed metal as a portion of •
their mix of materials which provides a less expensive alternative to other types of
primary materials.

Fire
1 All previously discussed requirements, including the requirements outlined in the letter
from Dale Lyman, from Union Fire District shall be addressed prior to approval of this
plan.
Response: Noted
Traffic
1 Per the Street Design Criteria Detail S-6, the standard width of the right-of-way varies
between 125' between intersection and 135' at the intersections. The current plan
does not show this distinction between the right-of-way widths but the transition
locations is not far enough south. This right-of-way increase at the intersection for this
roadway is to accommodate the needed left turn land, and that left turn lane shall be
sized per the traffic counts, resulting vehicle stacking and stopping distances. The
City has estimated that this north bound left turn lane onto O Street will need to be
approximately 420' long. Therefore rather than taking a preliminary estimate as to the
location of the taper back to 125' right-of-way width, the City is requesting that 37.5' of
additional right-of-way dedicated along the entire eastern border of the site, as the
current proposal is not adequate.
Response: Revised as requested. See the attached updated site plan for
updated right-of-way width.
2 The emergency access point onto 59`h Avenue shall remain gated at all times and •
shall only be used in an emergency situation. This emergency access shall not
become a long term access point but rather only as long as needed to make the main
access functional again.

Comment/Response
General
1 The Use by Special Review Plat shall be prepared in accordance with Section 23-2-
260.D of the Weld County Code. In addition to these requirements,the plat scale •
shall be 1"=40 feet. The Vicinity Map scale of 1"=2000 feet scale shall be delineated
on the plat.
This application shall be in compliance with Section 23-3-250 A and B and is
addressed in the following coments.
Response: Noted.
Sec. 23-3-250.A.1
1 All users of land shall provide and maintain storm water retention facilities designed to
retain the storm water runoff in excess of historic flow from the developed site. The
storm water retention facility on a developed site shall be designed for a one-hundred-
year storm. The storm water retention facility shall be designed and operated to
release the retained water at a quantity and rate not to exceed the quaintly and rate of
a five-year storm falling on the undeveloped site. The application materials do
address this issue, stating that the surface water will be collected by engineered
swales and held in ponds. There is no evidence of the applicant's ability to pipe under
the railroad and discharge on lands to the south of the proposed facility. The applicant
shall contact the Storm Water Engineering Staff of Weld County Department of Public
Works, to further discuss this issue. Written evidence of the compliance shall be
submitted to the Department of Planning Services.
Response: Written evidence has been supplied from the Railroad providing
assurance that a Stormwater pipe can be installed. A copy of the letter is
attached.
Sec. 23-3-250.A.2
1 Parking. Sufficient screened, off-street, paved parking areas shall be provided to meet •
the requirements of employees, company vehicles, visitors and customers of the
Uses Allowed by Right and Accessory Uses. Appendix 23-A describes the design
requirements for parking spaces and Appendix 23-B delineates the number of parking
spaces required by use for this property.

• The property facility is compressed of several structures with large expanses of gravel
surface. For the purpose of this referral staff has taken the position for full build out of
the property, i.e., 18000 SF Structure and up to twenty employees using this property.
The required parking spaces by definition is twenty personal vehicle spaces plus
eighteen additional space for the [warehouse-1space per 1000 SF of space]. Total
onsite parking will be minimum of twenty eight spaces. Additionally, semi-tractor
spaces shall be provided to accommodate the staging of vehicles associated with this
facility.
All parking spaces shall comply with the minimum design requirements for off-street
parking as delineated in Appendix 23-A of the Weld County Code. Compliance with
the minimum parking and access standards for the Americans with Disability Act shall
be followed at all times, as applicable.
Should the employee or visitor numbers increase, the parking requirements shall be
structured according to Appendix 23-B of the County Code. Written evidence of
compliance shall be submitted to the Department of Planning Services.
Response: Additional dedicated parking spaces have been shown to total 28
spaces. The comments request 28 spaces, but the math of the above
calculations indicate 38 spaces may be required. For the proposed use, 28
spaces is likely excessive, therefore we suggest no more then 28 spaces be
required at this time,with the knowledge that additional space on-site would be
available in the event that additional parking becomes necessary.
Sec. 23-3-250.A.3
1 Street Access. Lots shall have safe access to an approved public or private street.
• The design designation of any street or highway as to type shall be in conformance
with that shown on the county thoroughfare plan and/or the master plan of the
affected municipality. Visual inspection of the USR Plat identifies one point of ingress
and egress, onto County Road 64. The internal circulation is unclear, additional
information shall be submitted delineating the internal circulation pattern and the
proposed parking areas associated with this facility. Further, the applicant shall
delineate on the plat the proposed parking layout, including adequate aisles, and
wheel stops. Written evidence of compliance from the Department of Public Works,
the Fire Protection District and associated emergency responder personnel shall be
submitted to the Department of Planning Services.
Response: Revised as requested.
2 The fire District of record may require a second point of ingress and egress for this
facility, including, potentially the upgrade and maintenance of County Road 31 right-
of-way. All approved access roads shall be graded and drained to provide all weather
access. Accesses shall be placed in such a location as to have adequate sight
distance in both directions, shall not be placed below the crest of a hill or where
physical obstructions are present. Written evidence of compliance shall be submitted
to the Department of Planning Services.
Response: Noted.
Sec. 23-3-250.A.4
1 Required Yards-Setbacks
No use or accessory use may be located closer than twenty (20)feet to the existing or
proposed (whichever represents the greater right-of-way) highway or street right-of-
way. Off-street parking areas may be permitted in the required setback area when the
•
area is screened from direct view of persons on the public right-of-way. Fences over
six (6)feet in height are not required to comply with the minimum setback and may be
located on the property line. Fences located on corner lots abutting public right-of-way
shall not obstruct the view of vehicular traffic at an intersection. There was not a
scaled elevational drawing of the proposed facility, therefore, prior to the release of

building permits, the set back shall be verified given the existing proposed site
conditions, specifically addressing the landscape and screening component that is
delineated within the County Road 64 right-of-way. Written evidence of compliance
shall be submitted to the Department of Planning Services.
Response: The building has been located 20 feet off of the WCR 31 ROW
Reservation and more then 20 feet off of the WCR 64 ROW Reservation. A table
outlining the design criteria has been added to the site plan.
2 Required Yards-Offset
No use or accessory use may be located closer than ten (10) feet to its lot line. Off-
street parking areas may be permitted in the required offset area when the area is
screened from adjacent lots zoned R-1, R-2, R-3, R-4 or R-5. Fences over six (6)feet
in height are not required to comply with the minimum Offset and may be located on
the property line. The plans submitted with the application materials have not
delineated the offset. Written evidence of compliance shall be submitted to the
Department of Planning Services.
Response: The building has been located greater then 10 feet off of the WCR 31
and WCR 64 ROW Reservation. A table outlining the design criteria has been
added to the site plan.
Sec. 23-3-250.A.5.A
1 Required Landscape Areas
No more than eighty-five percent(85%) of the total area of a lot shall be covered.
Land shall not be deemed covered if it is used for growing grass, shrubs, trees, plants
or flowers or if covered by decorative gravel or wood chips, or if it is otherwise suitably
Landscaped. There was not a schematic Landscape and Screening Plan submitted •
with the application materials. It is also unclear from the submitted drawings if the
fifteen (15) percent landscaped requirement has been met. The applicant shall
address this issue and provide additional documentation including all proposed
fencing, lighting, adjacent property screening and landscape treatment to meet this
section of Weld County Code.
Response: The proposed site plan does not exceed the 85% covered criteria.
Final fencing, lighting, screening and landscape design based upon Weld
County criteria will be provided with the final design. Some initial design
information has been provided on the site plan.
2 Further, given that the facility is proposed within 0.5 miles of the Poudre City townsite,
Staff will request substantial screening and the placement of plant material to soften
and blend the facility with the neighborhood. Further, staff will require an approved
weed management plan and a reseeding/post construction plan to facilitate soil
stabilization and plant material growth. Further, staff will require an updated
landscape and screening plan that addresses the issue of the landscape and
screening component for the buffer between the outdoor storage component and the
adjacent properties for this proposed facility. Written evidence of compliance shall be
submitted to the Department of Planning Services.

Sec. 23.3-250.A.5.B
That portion of a lot which abuts a public or private street right-or-way shall be
landscaped for a distance of ten (10)feet, measured at a right angle from the lot line
towards the interior of the lot. Driveways may pass through the required landscape
areas. There was not a schematic Landscape and Screening Plan submitted with the •
application materials. Additional information is required prior to accepting the plat for
recording. Written evidence of compliance shall be submitted to the Department of
Planning Services.

Areas used for trash collection shall be screened from public rights-of-way and all
adjacent properties. These areas shall be designed and used in a manner that will
prevent wind or animal-scattered trash. The application materials did identify the
location of the three dumpsters for recycling on the plat, however, there was no
evidence of immediate screening or other recycling material control device employed
to control this issue. Future submittals shall address this issue as outlined in this
Section of the Code. Written evidence of compliance shall be submitted to the
Department of Planning Services.
Response: Noted. The appropriate screening will be provided.

Water Supply. Uses shall have an adequate source of potable water. The application
materials state that water is provided via a North Weld County Water District tap. The
applicant shall meet the requirements of the Weld County Department of Public
Health and Environment at all times. Written evidence of compliance shall be
submitted to the Department of Planning Services.

Sec. 23-3-250.A.8
Sewage Disposal. Uses shall have adequate sewage facilities. The application
materials state that individual sewage disposal systems (ISDS)will handle the effluent
flow. Further, the applicant shall meet the requirements of Weld Count Department of
Public Health and Environment. Written evidence of compliance shall be submitted to
the Department of Planning Services.

Sec. 23-3-250.A.9
Outside Storage. Uses involving outdoor storage of vehicles, (including the parking of
employee vehicles) equipment or materials when permitted shall be screened from
public rights-of-way and all adjacent properties. The applicant shall submit
documentation as to how the outside storage will be screened during the construction
period, and for periods thereafter as applicable.

Sec. 23-3-250.6
Operation Standards. Uses shall demonstrate conformance with the following
operation standards to the extent that they are affected by location, layout and design
prior to construction and operation.

Sec. 23-3-250.B.1
Noise. Uses and structures shall be located, designed and operated in accordance
with the noise standards as established in Section 25-12-101 C.R.S. the applicant
shall meet the established standards set by the Weld County Department of Public
Health and Environment.

Sec.23-3-250.B.2
Air Quality. Uses shall be located, designed and operated in accordance with air
quality standards established by the Colorado Air Pollution Control Commission. The
applicant shall meet the established standards set by the Weld County Department of
Public Health and Environment.

Water Quality. Uses shall be located, designed and operated in accordance with the
water quality control standards established by the Colorado Water Quality Control
Commission.

Sec. 23-3-250.B.4 -
Radiation and Radioactive Materials. The handling, use, storage and processing of
radioactive materials shall be in accordance with the applicable regulations of the
State and the Unites States government.

Sec. 23-3-250.B.5
Heat. Uses shall not emit heat in such an amount sufficient to raise the temperature of
the air or of materials at or beyond the Lot line more than five (5)degrees Fahrenheit.
The application materials don not indicated this is applicable, should this not be the
case, the applicant shall provide additional information to the Weld County
Department of Public Health and Environment and the Department of Building
Inspection. Further, the applicant shall obtain a written approval from the jurisdictional
Fire Protection District stating that the facility is in compliance with the Fire Code.
Response: Noted.
Sec. 23-3-250.B.6
Light. Any lighting, including light from high temperature processes such as welding or
combustion, shall be designed, located and operated in such a manner as to meet the
following standards: sources of light shall be shielded so that beams or rays of light •
will not shine directly onto adjacent properties; neither the direct nor reflected light
from any light source may create a traffic hazard to operators of motor vehicles on
public or private streets; and no colored lights may be used which may be confused
with or construed as traffic control devices. The application materials did not include a
Lighting Plan, Should exterior lighting be a part of this facility, all light standards shall
be delineated on the USR Plat.
Response: At this time, only building mounted exterior lighting is proposed. If
exterior lighting is proposed, a lighting plan will be provided.
Sec. 23-3-250.B.7
Property Maintenance. Property shall be maintained in such a manner that grasses
and weeds are not permitted to grow taller than twelve (12) inches. In no event shall
the property owners allow the growth of noxious weeds. The application materials do
not address property maintenance. Future correspondence shall identify how the
property will be in compliance with this Section of the County Code.
Response: Noted.
Sec. 23-4-50
Off Street Loading. The applicant shall delineate on the plat the location of the loading
zone that is in compliance with this Section of the Code. There shall be no parking or
staging of vehicles within the public rights-of-way. Further, the applicant shall meet all
requirements of the Department of Public Works concerning access and internal
circulation of vehicles for this proposed facility.
Response: Revised as requested.
Sec. 23-4-90 •
Signs. The application materials did not address the issue of on-site signs. The
applicant shall provide written evidence that all proposed signs are in compliance with
this Section of the Code.

Improvements
Agreement
The applicant shall enter into an Improvements Agreement according to policy
regarding collateral for improvements and post adequate collateral for all
transportation (access drive, parking areas, et cetera) and non-transportation (plant
materials, fencing, screening, et cetera). The agreement and form of collateral shall
be reviewed by County Staff and accepted by the Board of County Commissioners
prior to recording the USR plat.

1 0 Street is a major arterial road, which requires a 140-foot right-of-way at full build
out. There is presently a 60-foot right-of-way. The road is maintained by Weld
County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90),
- the required setback is measured from the future right-of-way line. .
Response: Noted and agreed with.
2 Radiuses for the drive shall be 60 feet to accommodate large trucks
Response: The radiuses have been revised to 60 feet on the site plan.
Traffic Study
1 In the Narrative please specify the units for the 57 loads heading for the landfill and
28 loads for recycling are these per day? Per month?
Response: The units are per month.
Drainage Report
1 Please update the submitted Drainage Report to reflect the release rate from the
detention pond per County Code. All storm water detention facilities shall be
designed to detain the storm water runoff from the fully developed USR from a one-
hundred-year storm and release the detained water at a rate not to exceed the rate of
a five-year storm falling on the undeveloped site. (Weld County Code Ordinances
2001-1; 2003-10, and 2006-7). All storm water must be detained on site and follow
the requirements per Weld County Code 24-7-130 D and Ordinance 2006-7.
Response: This will be revised as requested.
2 Please provide a letter from the Railroad Company to the south to allow a storm pipe
to be installed under the tracks to drain this property and offsite storm wate flows.

Soils Report
