RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST TEMO MARTINEZ (HEIRS OF) AND MICHAEL MARTINEZ FOR
VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Temo Martinez(Heir of) and Michael Martinez, ZCV#0800134, are allegedly
in violation of the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 18th day of November, 2008, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Michael Martinez, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until January 18, 2009, to allow adequate time for the property owner to complete the
screening of the noncommercial junkyard from all adjacent properties and public rights-of-way to
bring the subject property into compliance and for an inspection of the property by the Department
of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV#0800134 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Temo Martinez(Heir of)and Michael Martinez to remedy the violation
of the Weld County Code, and any other persons occupying the properties, any persons claiming
an interest in the properties, and any persons acting in active concert with the identified parties,
with an instruction for delay of action upon such referral until January 18, 2009, to allow adequate
time for the property owner to complete the screening of the noncommercial junkyard from all
adjacent properties and public rights-of-way to bring the subject property into compliance.

JUNKYARD may also include the storage or keeping of DERELICT VEHICLES registered
last or currently registered under the property owner and/or tenant's name.
This definition does not include COMMERCIAL VEHICLES. If the Zone district allows, the
NONCOMMERCIAL JUNKYARD shall be totally ENCLOSED within a BUILDING or
STRUCTURE or visually SCREENED from all ADJACENT properties and public
rights-of-way.
SCREENED: Construction and maintenance of fences, earth berms or the USE of
LANDSCAPING materials or other materials USED with the approval of the Department of
Planning Services to lessen the noise, light, heat or visual impacts of a USE on

REMEDY
As we discussed, the NONCOMMERCIAL JUNKYARD consisting of DERELICT VEHICLES and a
small amount of wood and miscellaneous debris shall be removed, restored or completely SCREENED
from all adjacent properties and public rights-of-ways. Any trash shall be removed from the property.
Screening is not an option for trash.
Hopefully, by scheduling this hearing out till November, you will have enough time to finishing bringing
the property into compliance, if not, as we discussed, this case will be scheduled before the board of
County Commissioners for a Violation Hearing at which time, you will need to request additional time, if
that is your desire. Please call me if you feel you addressed all outstanding violations prior to the
hearing.
RECOMMENDATION
The Department of Planning Services recommends that this case be referred to the County Attorney's
Office for immediate legal action.

OTHER CASE HISTORY
06/03/2008 Property Inspected Upon a visual inspection of the property, the following
items were noted: multiple derelict vehicles and a small
amount of wood and miscellaneous debris. No pictures
were taken during this inspection.
06/10/2008 Phone Call Michael Martinez (303-717-0960) called. He stated that
he would get the property cleaned up. I asked him how
long he thought it would take. He said he thought he
could get it done in about 90 days. I advised him that I
could grant him 60 days and we could possible
re-assess after that time period. He said he would see
what he could accomplish within 60 days. I told him to
make sure an contact me before the end of the 60 days.
He said he would.
08/11/2008 Phone Call Michael Martinez(303-717-0960 cell or 303-857-6492
home) called. He said he has removed 3 of those
vehicles. He said he started cleaning the yard. He said
he needs to find a truck to load up some more trash and
have it removed. He said he still has around 5+ vehicles
to have removed plus the trash. He stated that he is also
going to install a fence. I explained that I will be
inspecting the property today and if substantial progress
has occurred, I will be sending an additional 30 day
letter. That would push the violation out to September
11th. If at that time the violation has not been corrected,
my next step will be to schedule the case for a violation
hearing on October 14th. If he has not been able to
correct the violation by that time, he would need to attend
the violation hearing and request additional time from the
BOCC. He said that would be great and if he can't get it
done before that he would do whatever he needs to do
including speak with the Board.
08/11/2008 Property Inspected Upon a visual inspection of the property, the following
items were noted: **Some progress was noted;
however, there are still derelict vehicles, trash and
miscellaneous debris. No pictures were taken during this
inspection.

09/15/2008 Phone Call Michael Martinez called. He said he is still not done. He
said he is the only one working on correcting this
violation. He said he still hasn"t had a chance to install
the fence, but has a receipt for the fencing which he has
already purchased. He said he still has a couple of
vehicles left on the property, which don"t have tires, but
he just doesn"t have the money to deal with it right now.
I explained that my next step was to schedule this case
before the BOCC. I explained that since he has made so
much progress, I would support a request for a 30-60
day extension. He said thank-you.

COLORADO
Upon a visual inspection of the property, multiple DERELICT VEHICLES and a small
amount of wood and miscellaneous debris was noted. While a NONCOMMERCIAL
JUNKYARD is an allowed use in the Agricultural Zone District, such as Wattenburg, it must
be completely SCREENED from all adjacent properties and public rights-of-ways;
otherwise, it shall be restored or removed from the property. Any Derelict Vehicles (even if
Screened) must also be lastly registered or currently registered to the property owner or
current tenant.
DERELICT VEHICLE: A vehicle that is inoperable (unable to move under its own power); is
partially or totally dismantled; has all or portions of its body work missing or is substantially
damaged; does not have valid registration with the State, as required by Section 42-3-103,
42-3-138 or 42-12-102, C.R.S., and/or the number plate assigned to it is not permanently
attached to the vehicle, as required by Section 42-3-123, C.R.S.; or is lacking proper
equipment to the extent that it would be unsafe or illegal to USE on public road
rights-of-way or otherwise not equipped with lamps and other equipment, as required in
Sections 42-4-202 to 42-2-227, C.R.S. This definition shall not include implements of
husbandry, farm tractors or vehicles customarily operated in a FARMING operation.
NONCOMMERCIAL JUNKYARD: An area where any waste, junk or used or secondhand
materials are stored or handled, including but not limited to scrap iron and other metals,
paper, rags, rubber tires, building materials and bottles. A NONCOMMERCIAL JUNKYARD
may also include the storage or keeping of DERELICT VEHICLES registered last or
currently registered under the property owner and/or tenant's name.
This definition does not include COMMERCIAL VEHICLES. If the Zone district allows, the
NONCOMMERCIAL JUNKYARD shall be totally ENCLOSED within a BUILDING or
STRUCTURE or visually SCREENED from all ADJACENT properties and public
rights-of-way.
SCREENED: Construction and maintenance of fences, earth berms or the USE of
LANDSCAPING materials or other materials USED with the approval of the Department of
Planning Services to lessen the noise, light, heat or visual impacts of a USE on surrounding
uses. A SCREENING PLAN shall be submitted and approved by the Department of
Planning Services.
