HomeMy WebLinkAbout20081542.tiff I • RESOLUTION RE: ACTION OF THE BOARD CONCERNING PETITION AND AGREEMENT FOR ANNEXATION OF A PORTION OF COUNTY ROAD 7 (HIGHLAND ESTATES ANNEXATIONS #1 -#5) - TOWN OF MEAD WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on May 28, 2008, the Board was presented with a Petition for the Annexation of a Portion of County Road 7 (Highland Estates Annexations #1 - #5) from the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, to the Town of Mead, Colorado, and WHEREAS, at said meeting the Board deemed it advisable to continue the matter to June 4, 2008, and then to June 16, 2008, to allow the matter to be considered by a full quorum of the Board, and • WHEREAS, after review, the Board deems it advisable to withdraw said petition and deny said agreement, unsigned copies of which are attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Petition for the Annexation of a Portion of County Road 7 Highland Estates Annexations #1 - #5) from the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, to the Town of Mead, Colorado, be, and hereby is, withdrawn, and the Chair is not authorized to sign said petition. These proposed annexations fall outside the I-25 MUD. All these proposed annexations, except the WCR 13 annexation, lie west of 1-25. Our comments are below. GENERAL COMMENTS: 1. Highland Estates Annexation — a serial annexation on WCR 7 south of WCR 38. This road annexation of approximately 2650 feet of 60-foot Right of Way. This road annexation will result in Mead jurisdiction over 1 mile of WCR 7 from WCR 38 to WCR 36. Public Works supports this annexation. 2. WCR 36 Vale View Annexation—This road annexation is a full mile of 60-foot ROW along WCR 36 between WCR 7 and 1-25. Public Works supports this annexation. 3. WCR 34 Annexation — This road annexation of 30 feet of ROW (the south half of WCR 34 not • already annexed by Mead) extends between WCR 7 and 1-25 for a length of approximately 1504 feet. Public Works supports this annexation. 4. State Land Board Annexation—This serial annexation will incorporate 60 feet of WCR 7 ROW south of WCR 34 for a length of 1828 feet. This road annexation will create an approximately 320 acre enclave of County jurisdiction surrounded by Mead. This road annexation will result in Mead jurisdiction over 1 mile of WCR 7 from WCR 34 to WCR 32. Public Works supports this annexation. 5. Hunters Ridge Annexation—This road annexation will incorporate 60 feet of WCR 7 ROW south of WCR 32 for a length of approximately 2653 feet. Mead has already annexed the subdivisions on either side of this stretch of WCR 7. This road annexation will result in Mead jurisdiction over 1/2 mile of WCR 7 from WCR 32 to WCR 30. Public Works supports this annexation. 6. WCR 13 Annexation —This annexation will incorporate the 60 feet of WCR 13 ROW 1/2 mile north of State Highway 66 for a length of approximately 2653 feet. This road annexation lies adjacent to the 160 acre Grand View Estates subdivision which has already been annexed into Mead. Public Works supports this annexation. Note that these proposed annexations will leave short segments of County roads interspersed with Mead jurisdiction roads. Discussions between Public Works and the Town of Mead to address efficient maintenance and snow plowing needs for discontinuous road segments have begun. Our property does run along the portion that the City of Mead wants to annex. I am strictly against this to happen. Mead has never shown any capability of maintaining a road, just look at WCR 7 as it goes out of Mead towards Hwy 66. It is terribly maintained with bumps in the road that a contractor was allowed to leave. Even though complaints were made, the City of Mead did nothing, but pay the contractor and now we are stuck with a rough road. Road 34 1/2 is another mess, this goes West along the new pocket park and housing development, again it needs repair, but they don't do anything but let it deteriorate even more. The town receives thousands of dollars annually from Richie Brother Sales and they can't even fix a pot hole! The City of Mead does not know how to maintain roads- what they have now is proof of that. • gain nothing positive from having the City of Mead take over the roads in front of our house. What we do loose is a nicely maintained road which has been taken care of by Weld county, they have done an excellent job and I really hope they continue. Please do not allow this annex to go through, please vote against it. NOW THEREFORE, in c sideration of the foregoing premises and the covenants, • • promises and agreements of each f the parties hereto, to be kept and performed by each of them, it is agreed by and between the arties hereto as follows: 1. Submission f Annexation Petitions: Annexor has submitted to the Town for its considerat. n certain annexation petitions for the annexation of the real property describe in Exhibit A, with said petitions being incorporated herein by reference (herei fter the "Annexation Petitions"). The Annexation Petitions have been sub tted on the express condition that they will be approved by the Town and the eal property described in Exhibit A will be annexed to the Town under and p rsuant to the conditions set forth in Paragraph 2, hereunder, and pursuant to the greement for Annexor to pave the intersection of WCR's 7 and 38, as set forth in Paragraph 4, hereunder. 2 Conditions Applicable to Annexation. It is expressly understood by the Town that certain requirements are being imposed by Annexor as a condition precedent to the Town's annexation of the real property described in Exhibit A. These conditions are as follows: (a) From and after annexation of the real property described in Exhibit A, the Town, except as hereinafter provided, will be responsible for prospective maintenance of said real property. • (b) Town will not impose any weight limitation applicable to vehicles using the real property described in Exhibit A, other than those imposed under 1 Mead ANNEXATION AGREEMENT Weld CO 2(2).doc applicable state law, unless and until such time as the roadway is surfaced with concrete or asphalt; • (c) From and after annexation, no attempt will be made by the Town to limit vehicular access or use of the property annexed so as to exclude rm or agricultural vehicles and equipment. It is the express intention of the undersigned parties that any entity other than the undersigned parties receiving services or benefits under this agreement shall be an incidental beneficiary only. 8. No Waiver of Immunities. No portion of this agreement shall be deemed to constitute a waiver of any immunities the parties or their officers or employees may possess, nor shall any portion of this agreement be deemed to have created a duty of care which did not previously exist with respect to any person not a party to this agreement. 9.
