RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION
ZCV #0800168 AGAINST SORENSEN PARK, INC. FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Sorensen Park, Inc., ZCV #0800168, is allegedly in violation of the Weld
County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 14th day of October, 2008, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
• WHEREAS, Sorensen Park, Inc. was not present or represented at said hearing, although
all parties were notified of said hearing by Department of Planning Services staff, and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
named above to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed with
legal action against Sorensen Park, Inc. to remedy the violation of the Weld County Code, and any
other persons occupying the properties,any persons claiming an interest in the properties,and any
persons acting in active concert with the identified parties.

in an approved or recorded subdivision plat or lots parts of a map or plan filed prior to
adoption of any regulations controlling subdivision. PUD development proposals shall not
be permitted to use the special review permit process to develop.
COMMERCIAL VEHICLE: Any vehicle, other than an automobile, used or previously used
to facilitate an activity where goods, products or services are bought, sold or transferred in
ownership on a fee, contract or barter basis, excluding those uses listed by right and
accessory uses in the A(Agricultural) Zone District. A COMMERCIAL VEHICLE shall
include, but is not limited to, semi-trailers, dump trucks, construction equipment, railroad
cars and cargo containers. A COMMERCIAL VEHICLE shall not be allowed to deteriorate
to the condition of a DERELICT VEHICLE.
DERELICT MANUFACTURED (MOBILE) HOME: A MANUFACTURED (MOBILE) HOME
that is partially or totally damaged by fire, earthquake, wind or other natural causes, or is in
a state of general dilapidation, deterioration or decay resulting from improper lack of
maintenance, vandalism or infestation with vermin or rodents. Any such DERELICT
MANUFACTURED (MOBILE) HOME shall be returned to and maintained in the condition 2008-27'
VilIation Summary Report
as originally established on site and as inspected by the Building Inspection Department,
or it shall be removed from site.
DERELICT VEHICLE: A vehicle that is inoperable (unable to move under its own power);
is partially or totally dismantled; has all or portions of its body work missing or is
substantially damaged; does not have valid registration with the State, as required by
Section 42-3-103, 42-3-138 or 42-12-102, C.R.S., and/or the number plate assigned to it is
not permanently attached to the vehicle, as required by Section 42-3-123, C.R.S.; or is
lacking proper equipment to the extent that it would be unsafe or illegal to USE on public
road rights-of-way or otherwise not equipped with lamps and other equipment, as required
in Sections 42-4-202 to 42-2-227, C.R.S:This definition shall not include implements of
husbandry, farm tractors or vehicles customarily operated in a FARMING operation.
JUNK: Scrap brass, iron, lead, tin, zinc; all other scrap metals and alloys; bones; rags;
used cloth, rope, rubber, tinfoil, bottles, old or used machinery of any type; used tools;
used appliances; used lumber or crates; building materials; fabrication of any material;
used pipe or pipe fittings; used conduit or conduit fittings; used automobile parts;
DERELICT VEHICLES; used tires and other manufactured goods that are so worn,
deteriorated or obsolete as to make them unusable in their existing condition.
REMEDY
- In order to maintain COMMERCIAL VEHICLES within the boundaries of a Subdivision, such as
Sebolds, they must be permitted. Furthermore, within the boundaries of a Subdivision, only 1 (one)
Commercial Vehicle (1 semi cab and 1 semi trailer) are allowed to be permitted. All other Commercial
Vehicles shall be removed from the property. A Zoning Permit for a Commercial Vehicle (ZPCV)
application was sent with the previous letter.
- Additionally, while a NONCOMMERCIAL JUNKYARD consisting of DERELICT VEHICLES is an
allowed use, it must be completely SCREENED from all adjacent properties and public rights-of-ways.
Otherwise, it they shall be restored or removed from the property.
- Lastly, the presence of mobile homes on a property(even if temporary) require additional Weld
County Zoning & Building Permits. Furthermore, if you intent is to start a mobile home demolition
operation, this use would not be allowed within a recorded subdivision (such as Sebolds). The mobile
homes along with any associated demolition debris shall be removed and no additional mobile homes
shall be added to this property without first obtaining any necessary zoning and building permits.
RECOMMENDATION
The Department of Planning Services recommends this case be referred to the County Attorney's
Office for immediate legal action.

This hearing will take place in the County Commissioners Hearing Room, first floor, Weld County
Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a
representative be in attendance to answer any questions the Board of County Commissioners
might have about the violations.
Please also be advised that I will be taking video and/or pictures from the road or adjacent
properties the business day before or as soon as possible to the above mentioned Violation
Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the
violation. Our records indicate that you were made aware of the nature of the violation including
the action necessary to correct the violation, and that you were given sufficient time to remedy

DERELICT MANUFACTURED (MOBILE) HOME: A MANUFACTURED (MOBILE) HOME that
is partially or totally damaged by fire, earthquake, wind or other natural causes, or is in a state
of general dilapidation, deterioration or decay resulting from improper lack of maintenance,
vandalism or infestation with vermin or rodents. Any such DERELICT MANUFACTURED
(MOBILE) HOME shall be returned to and maintained in the condition as originally established
on site and as inspected by the Building Inspection Department, or it shall be removed from
site.
DERELICT VEHICLE: A vehicle that is inoperable (unable to move under its own power); is
partially or totally dismantled; has all or portions of its body work missing or is substantially
damaged; does not have valid registration with the State, as required by Section 42-3-103,
42-3-138 or 42-12-102, C.R.S., and/or the number plate assigned to it is not permanently
attached to the vehicle, as required by Section 42-3-123, C.R.S.; or is lacking proper
equipment to the extent that it would be unsafe or illegal to USE on public road rights-of-way
or otherwise not equipped with lamps and other equipment, as required in Sections 42-4-202
to 42-2-227, C.R.S. This definition shall not include implements of husbandry, farm tractors or
vehicles customarily operated in a FARMING operation.
JUNK: Scrap brass, iron, lead, tin, zinc; all other scrap metals and alloys; bones; rags; used
cloth, rope, rubber, tinfoil, bottles, old or used machinery of any type; used tools; used
appliances; used lumber or crates; building materials; fabrication of any material; used pipe or
pipe fittings; used conduit or conduit fittings; used automobile parts; DERELICT VEHICLES;
used tires and other manufactured goods that are so worn, deteriorated or obsolete as to
make them unusable in their existing condition.
NONCOMMERCIAL JUNKYARD: An area wher
To bring your property into compliance with the Weld County Code:
- In order to maintain COMMERCIAL VEHICLES within the boundaries of a Subdivision,
such as Sebolds, they must be permitted. Furthermore, within the boundaries of a
Subdivision, only 1 (one) Commercial Vehicle (1 semi cab and 1 semi trailer) are allowed to
be permitted. All other Commercial Vehicles shall be removed from the property. A Zoning

COMMERCIAL VEHICLE: Any vehicle, other than an automobile, used or previously used
to facilitate an activity where goods, products or services are bought, sold or transferred in
ownership on a fee, contract or barter basis, excluding those uses listed by right and
accessory uses in the A(Agricultural) Zone District. A COMMERCIAL VEHICLE shall
include, but is not limited to, semi-trailers, dump trucks, construction equipment, railroad
cars and cargo containers. A COMMERCIAL VEHICLE shall not be allowed to deteriorate
to the condition of a DERELICT VEHICLE.
DERELICT VEHICLE: A vehicle that is inoperable (unable to move under its own power); is

Planning Services to lessen the noise, light, heat or visual impacts of a USE on surrounding

Planning Services.

ZONING PERMIT COMMERCIAL VEHICLE (ZPCV) SUBMITTAL CHECKLIST
APPLICATION REQUIREMENTS:
One original application form plus two copies
One original drawing plus two copies. A scaled drawing of the property(1"=50')needs to show where the
proposed commercial vehicle will be parked on the property. Include distances between the property lot
lines and proposed accessory structure and all other existing structures on the property; access to the
property(indicate whether it is existing or proposed) ; County, State, or Federal road rights-of-way; amount
of road frontages; location and measurements of any easements; and any proposed structures to be
located on the property.
One original Weld County Road Access Information Sheet plus one copy
One original questionnaire plus two copies
One copy of deed or legal instrument identifying applicant's interest in the property. Copy of recorded
instruments may be obtained from Weld County Clerk and Recorder's Office or a title or abstract company.
One copy of affidavit and certified list of the names, addresses and the corresponding Parcel Identification
Number assigned by the Weld County Assessor of the owners'of property(the surface estate)within 500 feet of
property being considered. This list shall be compiled from the records of the Weld County Assessor, the
Weld County Website, www.co.weld.co.us., or a person qualified to do the task, and shall be current as of a
date no more than thirty days prior to the date the application is submitted to the Department of Planning
Services.
Application fee$75.00
$37.50 investigation fee. If there is an associated violation which has been presented to the Board of County
Commissioners through the Violation Hearing process, the investigation fee shall be fifty percent of the fee
established by separate action by the Board of County Commissioners for land-use applications shall be
assessed. The payment of such investigation fee shall not relieve any persons from fully complying with the
requirements of the Weld County Code, nor from any other penalties.
One each of the application and scaled drawing shall be collated into two complete application packets and
bound with binder clips or paper clips only. The original copies shall be placed in one packet (includes
additional items below if applicable). Applications bound in any other fashion than binder or paper clip will
be returned to the applicant without review. Additional required information shall be kept separate to be
collated by Planning Staff. The Department of Planning Services may request additional information,
application packets and/or fees that will aid in the review of the Zoning Permit application.

ARTICLES OF INCORPORATION
OF
S0RO1sER PARE, INC.
We, the undersigned, natural persons of the age of 18 years or more, acting
as incorporators of a corporation under the Colorado Corporation Code, adopt the
following Articles of Incorporation for such corporation:
FIRST: The name of the corporation is Sorensen Park, Inc.
SECOND: The period of duration of the corporation shall be perpetual.
THIRD: The corporation is organized for any legal and lawful purpose
pursuant to the Colorado Corporation Code.
FOURTH: A. This corporation is authorized to issue one class of shares of
stock designated as common. The aggregate number of shares of stock that the
corporation shall have authority to issue is 50,000 shares of common stock.
B. 50,000 shares of common stock shall be known as voting (common)
stock of the corporation. All of such stock shall have no par value. The holders
of voting (common) shares shall have the exclusive voting power and shall have
the sole voice in the management of the corporation. Each of the voting (common)
shares shall be entitled to one vote. All or any part of the common stock shall
be issued by the corporation from time to time and for such consideration as may
be determined upon and fixed by the Board of Directors.
C. Upon issuance of the stock of the corporation the Board of

D. Upon the death or adjudication of incompetency of any

E. No transfer of common stock shall be valid until fifteen (15)
days after written notification of the proposed sale or transfer, the number of
shares proposed to be sold or transferred, the price at which the proposed sale
is to be made and the name of the prospective buyer shall have been delivered to
David Sorensen and Albert E. Park. During said fifteen (15) days David Sorensen
and Albert H. Park shall have the option to buy, at the price set by seller, any
and all shares of con stock before the owner or the person in whose name it
stands on the corporation's books may transfer them. Should David Sorensen and
Albert H. Park fail to purchase any such shares of common stock for any reason
and the corporation fails to exercise its option to buy such stock as set forth
in this Fourth paragraph, clause F., the stock can be sold a third party.
F. No transfer of the stock shall be valid until fifteen (15) days
after the corporation, through its secretary, shall have written notice of the
proposed sale, the number of shares proposed to be sold, the price at which the
proposed sale is to be made and the name of the prospective buyers. During said
fifteen (15) days the corporation shall have the option to buy, at the price set
by seller, any and all shares of the outstanding stock before its owner or the
person in whose name it stands on the books may transfer them. Should the
corporation not have the funds to buy the shares or should it deem it undesirable
to purchase them for any reason any other owner of the common stock shall have
the option for an additional fifteen (15) days of purchasing the shares at the
price set by the seller in proportion to the number of shares then held by said
shareholder. If not exercised within this time, any sale to a third person shall
be valid.

FIFTH: The address of the corporation's initial registered office in the
State of Colorado is 2416 Thirteenth Street, Greeley, Colorado 80631. The name
of the corporation's initial registered agent at such address is David Sorensen.
SIITH:-The Board of Directors shall have the power to conduct all affairs
of the corporation. The number comprising the Board of Directors shall be fixed
by the by-laws which number may equal the number of shareholders of the
corporation.The manner of the election or appointment and the term of the office
of the members of the Board of Directors shall be stated in the by-laws. The
number of directors constituting the initial Board of Directors in the
corporation is three (3). The names and addresses of the persons whom are to
serve as directors until the first annual meeting of the shareholders, or until

The number of directors of the corporation shall not be less than three (3);
except there need be only as many directors as there are, or initially will be,
shareholders in the event that the outstanding shares are or initially will be
held of record by fewer than three (3) shareholders.
SEVENTH: This corporation may be dissolved at any time by an affirmative
vote of the shareholders holding 51t of its voting common stock at a meeting of
the ehareholdera called for that purpose and in a manner not inconsistent with
the law or as set forth in the by-laws. In the event of such dissolution the
shares of the corporation shell be wound up in a manner provided by Colorado law.
EIGHTH: In furtherance and not in limitation of the powers conferred by the
laws of the State of Colorado, the Board of Directors is expressly authorized to
frame and adopt any such by-laws for this corporation as are not inconsistent with
the laws of the State of Colorado or these Articles of Incorporation. Any by-
law(s) ao adopted by the Board of Directors may be amended or appealed by vote
of the shareholders holding 51% of the corporation's voting common stock at any
regular shareholders meeting or at a special shareholders meeting called for that
purpose.
NINTH: The corporation reserves the right to amend, add to or appeal any
provisions contained in these Articles of Incorporation in the manner consistent
with Colorado law and conformity with the provisions set forth in the by-laws.
