the process may not be all-inclusive, as other concerns or issues may arise during the remaining application
process. This project falls primarily under the purview of the Use by Special Review Standards, Weld County
Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows:
COMMENTS AND REQUIREMENTS:
Weld County Strategic Roadway: (December 2002) WCR 22 is classified by the County is a Strategic
Roadway, which requires a 140-foot right-of-way at full build out. There is presently a 60-foot right-of-way.
This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning
(23-1-90), the required setback is measured from the future right-of-way line.
Access: Utilize the existing access to this parcel. No new accesses are requested.
•he applicant shall indicate specifically on the plat the type of right-of-way/easement and indicate whether it
dedicated, private, or deeded to provide adequate access to the parcel. Section line accesses are
considered private lanes with no county maintenance.
The applicant shall contact the oil and gas or ditch owner to obtain, in writing, permission to utilize their
access road for a commercial/residential access.
Storm Water Drainage:
The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will
reasonably preserve the natural character of the area and prevent property damage of the type generally
attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm
run-off.
The applicant must take into consideration storm water capture/quantity and provide accordingly for best
management practices.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.

COLORADO DATE: October 15, 2007
FROM: Kim Ogle, Planning Manager 1(.O
SUBJECT: USR-1634, Bonilla Trucking
Reynaldo & Mayra Bonilla, Applicants
Landscape Referral
The Department of Planning Services reviewed the above referenced Use by Special Review
documentation and drawings and offers the following comments:
The application materials state this is an oil field service company, yet all other aspects of the
application imply that it is a trucking company that may serve the oil and gas industry. This
latter aspect may have further ramifications with the Environmental Health Division of the Weld
County Department of Public Health and Environment. The applicant is requested to provide
additional information as warranted.
The Use by Special Review Plat shall be prepared in accordance with Section 23-2-260.D of
the Weld County Code. In addition to these requirements, the plat scale shall be 1" = 20 feet.
The Vicinity Map scale of 1" = 2000 feet scale accurately be delineated on the plat.
This application shall be in compliance with Section 23-3-250 A. and B and is address in the
following comments.
Section 23-3-250.A.1
Stormwater Management. All users of land shall provide and maintain stormwater detention
facilities designed to retain the stormwater runoff in excess of historic flow from the developed
site. The stormwater detention facility on a developed site shall be designed for a one-hundred-
year storm. The stormwater retention facility shall be designed and operated to release the
retained water at a quantity and rate not to exceed the quantity and rate of a five-year storm
falling on the undeveloped site. The application materials do not specifically address this issue,
stating "No signifiacant change in historical flows will be created. All drive and parking surfaces
will be gravel or recycled asphalt to allow water absorption." The applicant shall contact the
Storm Water Engineering Staff of the Weld County Department of Public Works, to further
discuss this issue. Written evidence of compliance shall be submitted to the Department of
Planning Services.
Section 23-3-250.A.2
Parking. Sufficient screened, off-street, paved parking areas shall be provided to meet the
requirements of employees, company vehicles, visitors and customers of the Uses Allowed by
Right and Accessory Uses. Appendix 23-A describes the design requirements for parking
spaces and Appendix 23-B delineates the number of parking spaces required by use for this
property.
• USR-1634,Bonilla, page 1
The proposed facility is comprised of one structure and an office with no future structures
planned as stated in the application materials. Per the application materials, the building is of
• unknown height and construction. What is known is that it is a 30x80 square foot structure
serving as the shop, office and garage with unknown associated activities. Additional
information should be requested addressing the use of this structure. The application
materials state there are five employees and an unknown number of persons who may access
the site on any given day, Monday through Friday.
The parking requirement for this facility is as follows: The building is classified as a warehouse
having 2400 SF. The warehouse component is calculated as one space for every 1000 SF of
floor area. Total parking required is 2 parking spaces as outlined in Appendix 23-B. The
unknown square foot office requires one space for each two employees plus one space for
each 500 square feet of floor area. Total parking required for the office is 1 parking space. For
the office and warehouse components, a passenger space is nine (9)feet in width by nineteen
(19) feet in length. Parking for larger vehicles, depends on length of tractor, which could
exceed sixty (60)feet depending on vehicle type. Additional information is requested
addressing the specific length of the typical tractor.
Total parking as delineated in the Weld County Code for this facility is eight parking spaces for
the facility, two for warehouse, one for the office and five for employee parking. The employee
parking component shall be delineated on future paper plats prior to recording on mylar.
Should the employee numbers increase, the parking requirement shall be structured according
to Appendix 23-B of the County Code. Written evidence of compliance shall be submitted to the
Department of Planning Services.
• Section 23-3-250.A.3
Street Access. Lots shall have safe access to an approved public or private street. The design
designation of any street or highway as to type shall be in conformance with that shown on the
county thoroughfare plan and/or the master plan of the affected municipality. Visual inspection
of the USR Plat identifies one point of ingress and egress, onto CR 22. The internal circulation
is unclear, additional information shall be submitted delineating the internal circulation pattern
and the proposed parking areas associated with this facility. Further, the applicant shall
delineate on the plat the proposed parking layout, including adequate aisles, and wheel stops.
Written evidence of compliance from the Department of Public Works, the Fire Protection District
and associated emergency responder personnel shall be submitted to the Department of
Planning Services.
The Fire District of record may require a second point of ingress and egress for this facility,
including, potentially the upgrade and maintenance of County Road 22 right-of-way. All
approved access roads shall be graded and drained to provide all weather access. Accesses
shall be placed in such a location as to have adequate sight distance in both directions, shall not
be placed below the crest of a hill or where physical obstructions are present. Written evidence
of compliance shall be submitted to the Department of Planning Services.
Section 23-3-250.A.4
Required Yards - Setback
No use or accessory use may be located closer than twenty (20) feet to the existing or proposed
(whichever represents the greater right-of-way width) highway or street right-of-way. Off-street
parking areas may be permitted in the required setback area when the area is screened from
•
USR-1634,Bonilla, page 2
direct view of persons on the public rights-of-way. Fences over six (6)feet in height are not
required to comply with the minimum setback and may be located on the property line. Per the
• application materials, the facility appears to be in compliance.
Section 23-3-250.A.4
Required Yards - Offset
No use or accessory use may be located closer than ten (10) feet to its lot line. Off-street
parking areas may be permitted in the required offset area when the area is screened from
adjacent lots zoned R-1, R-2, R-3, R-4 or R-5. Fences over six (6) feet in height are not
required to comply with the minimum Offset and may be located on the property line. Per the
application materials, the facility appears to be in compliance.
Section 23-3-250.A.5.A
Required Landscaped Areas
No more than eighty-five percent (85%) of the total area of a lot shall be covered. Land shall not
be deemed covered if it is used for growing grass, shrubs, trees, plants or flowers or if covered
by decorative gravel or wood chips, or if it is otherwise suitably Landscaped. There was not a
schematic Landscape and Screening Plan submitted with the application materials. It is also
unclear from the submitted drawings if the fifteen (15) percent landscaped requirement has been
met. The applicant shall address this issue and provide additional documentation including all
proposed fencing, lighting, adjacent property screening and landscape treatment to meet this
section of the Weld County Code.
Further, Staff will require an approved weed management plan and a reseeding /post
construction plan to facilitate soil stabilization and plant material growth. Written evidence of
compliance shall be submitted to the Department of Planning Services.
• Section 23-3-250.A.5.B
That portion of a lot which abuts a public or private street right-of-way shall be landscaped for a
distance of ten (10)feet, measured at a right angle from the lot line towards the interior of the
lot. Driveways may pass through the required landscaped areas. There was not a schematic
Landscape and Screening Plan submitted with the application materials. Additional information is
required prior to accepting the plat for recording. Written evidence of compliance shall be
submitted to the Department of Planning Services.

Areas used for trash collection shall be screened from public rights-of-way and all adjacent
properties. These areas shall be designed and used in a manner that will prevent wind- or
animal-scattered trash. The application materials did not identify the location of the dumpster on
the plat. Future submittals shall address this issue as outlined in this Section of the Code.
Written evidence of compliance shall be submitted to the Department of Planning Services.
Section 23-3-250.A.7
Water Supply. Uses shall have an adequate source of potable water. The application materials
state that water is provided by a Private Well Permit number 265349. Given this is a commercial

I wish to submit the following information regarding the above referenced project.
X The concerns of Farmers Reservoir and Irrigation Company are in the area of
encroachment to the Right of Way of the canal. FRICO requires a minimum of 20' on
each side of the canal for a maintenance road plus the distance to the toe of the ditch
embankment. The boundaries of the Right of Way must be agreed upon.
X Drainage is another concern that must be addressed as FRICO does not allow any
developed storm flow into our canals.

Re: USR-1634 - Site Specific Development Plan and Special Review Permit for a Use By
Right, an Accessory Use, or a Use by Special Review in the Industrial Zone District
(Truck Parking, Maintenance And Office)
Dear Ms. Hatch:
This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to
county planning directors, this office will only perform a cursory review of the referral information and
provide comments. The comments do not address the adequacy of the water supply plan for this
project or the ability of the water supply plan to satisfy any County regulations or requirements. In
• addition, the comments provided herein cannot be used to guarantee a viable water supply
plan or infrastructure, the issuance of a well permit, or the physical availability of water.
According to the referral information the site will be served by an existing well constructed
under well permit no. 265349. The well is permitted for ordinary household purposes inside one single
family dwelling, the watering of domestic animals, and the irrigation of not more than 1 acre of home
gardens and lawns. The well was constructed on October 25, 2005 into the nontributary Laramie-Fox
Hills aquifer.
The referral information does not clearly specify all of the proposed uses for the well,
however, it appears that water from the well will be used to serve the home and shop, which will be
utilized by a maximum of 5 employees and the owner's family. In addition, water from the well will be
used for landscape irrigation around the home and the watering of large domestic animals (4 horses
and 10 cows). Since the employees will utilize the drinking and sanitary facilities at the site, and water
from the well may also be used as part of the commercial operation, such uses are considered
commercial and are not allowed under the existing well permit. Therefore, the subject well cannot be
used, as currently permitted, to serve the site. If the well will be used for the purposes described, a
new well permit must be obtained for commercial, domestic, irrigation and livestock watering uses
pursuant to C.R.S. 37-90-137(4).
Should you have any questions in this matter, please contact Joanna Williams of this office.
Sincerely,
• Kevin G. Rein, P.E.
