The dumping site is directly above Lost Creek, a rather important body of water. Also, irrigation, domestic, and other wells owned by the State of Colorado are directly downstream from the dumping site. Contamination of underground water is of real concern. Victor Klein stated that he is one of the closest landowners and he agrees to continue this case. He stressed to please get all the facts pertinent to this application. The site is needed, but not necessarily in that particular area. Fred Otis, Chairman of the Planning Commission, stated that the present dumping arrangement is up to the Enforcement Arm of the Planning Department. Dear Ms. Tipton: This extension request will be placed on the Planning Commission agenda for July 7, 1981. At this time I do not feel there will be a need for anyone from your firm to attend the meeting, as the letters discussing the problem areself-explanatory. I will be recommending an extension for an additional six-months. If the Planning Commission takes an action on July 7, 1981, I will set the matter before the Board for final action on July 15, 1981, at approxi- mately 9:30 a.m. The meeting will take place in the First Floor Hearing Room in the Centennial Center at 915 10th Street in Greeley. I would suggest, if at all possible, someone be in attendance for the County Commissioner's meeting on Wednesday, July 15, 1981. A second issue which I would like to discuss with you regards an amendment to a Continental facility in the NW4 NW., Section 2, T1N, R67W of the 6th P.M. , Weld County, Colorado at Weld County Roads 21 and 14. In May of 1981, the County Commissioners approved removal of a development standard which required woven lattice in the site boundary fencing. I would like to have Continental sign a document (which I will record) that shows the new standards. I will be preparing the document to mail to your attention. I would expect the document -to contain two .(2) legal size pages, which will require six dollars ($6.00) to record. These modifica- tions consist of the installation of a three-centered compound curve on the south corner of County Road 18-1/2 and U.S. High- way 85. Because we have not yet been able to acquire right-of-way on that property, we will be unable to comply with the July 14 , 1981 , deadline. Thus , Continental Pipe Line Company respect- fully requests an extension of CUP 66 : 80 :14 to a date sixty (60) days after acquisition of the necessary easement. As soon as we secure this permission, we will proceed with installation of a three-centered compound curve in accordance with Colorado State Department of Highways' recommendations . Continental Pipe Line Company also requests permission to improve the driveway through the truck unloading facility on the north corner of County Road 18-1/2 and U.S . Highway 85 . ry;', ' 'er j ,n a R, ee Cll ` o o G- : ,a Mr. Thomas Honn - 2 - June 1, 1981 Weld County, Colorado Our intention is to asphalt the internal roadway rather than continuing to apply gravel to it. We believe that asphalting will improve both the appearance and maintenance of the facil- ity. We hope to begin asphalting during the last week of July and will construct the three-centered compound curve at the same time, if at all possible. We appreciate your consideration of these proposals . If you have any questions or need additional information, please con- tact the Project Engineer in charge of these improvements , Lori Tipton, at (307) 634-4408 . Box 728 Cheyenne, Wyoming 82001 Dear Lori: The Right-of-Way Department has encountered some difficulty in acquiring roadway easements for the Spindle "B" turn- around in Weld County, Colorado . The property is owned one-third undivided interest in the Olive Lamb Estate and two-thirds undivided interest in the Yvonne C. Dalton Trust. Both parties are out of state and affairs are being handled by local banks and attorneys . The Yvonne C. Dalton Trust is being handled by Vern Moser, Greeley National Bank, and the Olive Lamb Estate is repre- sented by Fred Jolley of Gorsuch, Kirgis , Campbell, Walker & Grover, Denver, Colorado . Both parties have been contacted some time ago and so far there has been no response from either of them. However, Fred Jolley and Vern Moser in- dicated there will be no objection to the acquisition of the roadway easements . A greater amount of time that usual is required because of the excess red tape involved. I will contact you immediately upon hearing from either landowner. The drawing shows two 8 ' x 7 .5 ' buildings . One of these buildings is currently in place and the other was a proposed addition. We wish, however, to replace the existing 8 ' x 7. 5 ' building with a 10 ' x 10 ' building, eliminating the need for two buildings . If this proposal is acceptable, please phone me at (307) 634-4408 and provide notification in writing. The facility will continue to be automated. Continental Pipe Line Company employees, stationed at the Fort Lupton Pump Station, will maintain and supervise the operations at the unloading facility. There are not now, nor will there be , any personnel physically assigned to the Spindle B Station, thereby eliminating the need for a water supply or a sewage disposal system. Under current operations , the facility provides for three crude oil transports to unload their contents simultaneously, while providing parking for up to five additional transports on the facility grounds. Individual transport operators make the necessary connections to the facility to unload and pump their contents directly into designated breakout tankage. At a predetermined level, a pump will automatically begin transferring volumes from that tank, through an Automatic Custody Transfer (ACT) unit for measurement, and subsequent delivery via underground pipeline, to Contenintal Pipe Line Company' s mainline injection station at Fort Lupton. _ The facility has one (1) 1000 barrel tank and one (1) 500 barrel tank enclosed by an earthen dike, two ACT units, a 6 foot high chain link fence around the tank and ACT area, and three truck unloading pumps. The paved aprons where the trucks unload are equipped with catch basins which gather and contain any oil which is lost during unloading operations, thus eliminating the hazard of ground water pollution. The proposed modifications will be designed and constructed so that an additional crude oil transport can unload at the facility. _ An additional curbed and paved apron will be installed equipped with a catch basin to gather and contain any oil which is lost _ during the unloading operation. A pump will be installed adjacent to the apron, approxamately 100 feet north of the existing - tankage. The earthen dike surrounding the existing tankage will be enlarged to facilitate the addition of two (2) 400 barrel tanks. One additional ACT unit will be installed immediately adjacent to the two existing ACT units. The operation - and maintenance of this expanded facility will be identical to the existing facility. The facility will provide parking for five additional transports on the property while they wait use of _ the facility. The 6 foot high chain link fence around the tank - and ACT area will be maintained. - E, ' Continental Pipe Line Company -' Conditional Use Pei ' t/Amendment , Page Two Traffic volume at the Spindle B Station will average approxi- mately thirty trucks per day. Truck traffic will be the highest _ during daylight hours, with approximately one-sixth of the unloading occurring between 6 PM and 6 AM daily. - Acceleration and deceleration lanes have been installed on the U.S. Highway 85 to County Road 181/2 exit, thus eliminating any i traffic hazard. - 4 The facility will be maintai .ed in a neat and professional manner. Noxious weeds or any unsightly debris will be disposed of promptly and in accordance with any applicable regulations. Facility will comply with noise levels as stated in 25-12-103, _ CRS 1974 . Environmental and safety precautions at the facility will also be provided for. In addition, the facility will continue to comply with all the previously agreed upon CUP Development Standards to which this Amendment does not address. and/or change. •• 0 1 r • Continental Pipe Line Company Conditional Use Pe t/Amendment Page Three Listed below please find the requested changes to the current Continental Pipeline Company CUP Development Standards: • 1.
