RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST WAYNE HARSH FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Wayne Harsh, ZCV #0800066, is allegedly in violation of the Weld County
Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 12th day of August, 2008, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Wayne Harsh, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until October 12, 2008, to allow adequate time for the property owner to submit a Use
by Special Review application to bring the subject property into compliance and for an inspection
of the property by the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV#0800066 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Wayne Harsh to remedy the violation of the Weld County Code, and
any other persons occupying the properties, any persons claiming an interest in the properties,and
any persons acting in active concert with the identified parties,with an instruction for delay of action
upon such referral until October 12, 2008, to allow adequate time for the property owner to submit
a Use by Special Review application to bring the subject property into compliance.

disrepair. Such disrepair may include a cargo container that is partially or totally damaged
by fire, earthquake, wind or other natural causes, or is in a state of general dilapidation,

maintained in, the original condition it was in at the time it was placed on the site as
established by the original inspection by the Department of Building Inspection, or it shall

23-3-30.K.6 A cargo container used for storage shall be removed from the property upon
cessation of the USE.
23-3-30.K.7 The cargo container may not be used in any manner to display a sign.
23-3-30.L Up to two (2) semi-trailers may be used for accessory storage on agricultural
parcels not in an approved or recorded subdivision plat, or LOTS which are part of a map
or plan filed prior to the adoption of any regulations controlling subdivisions in the A

goods, equipment or livestock, as long as the number of trips does not exceed sixty (60)
per day to and from the property. When the property is located within an approved or
recorded subdivision, or part of a LOT which is part of a map or plan filed prior to adoption
of any regulations controlling subdivisions, such USE may be permitted through Section
23-4-950 of this Code.
23-3-40 Uses by special review
23-3-40.R Any use permitted as a Use by Right, an Accessory Use, or a Use by Special
Review in the commercial or industrial zone districts, provided that the property is not a lot
in an approved or recorded subdivision plat or lots parts of a map or plan filed prior to
adoption of any regulations controlling subdivision. PUD development proposals shall not
be permitted to use the special review permit process to develop.
23-3-40.AA More than one (1) cargo container per legal lot or parcel.
REMEDY
1 (one) Cargo/Conex Container is allowed to be situated on the property, but a building permit is
required. The remaining containers shall be removed from the property or appropriately permitted
through the Use by Special Review (USR) and building permit process.
2 (two) semi trailers are allowed to be situated on this property as storage units, but they must maintain
current license plates (a copy of the registration can be faxed or mailed to my attention) and be
operable at all times (all tires must be on the trailer, functional and aired up). Any additional semi
trailers would need to be permitted through the USR process as well.
The presence of COMMERCIAL VEHICLES, equipment or storage also requires a Use by Special
Review permit. 1 (one) USR application can be submitted for multiple uses.
Any DERELICT VEHICLES, wood, iron/metal, automobile pads and miscellaneous debris would need
to be removed, restored or completely SCREENED from all adjacent properties and public
rights-of-ways.
Please keep in mind that if a Use by Special Review(USR)application is submitted prior to August 11,
2008, the above referenced Violation Hearing would be cancelled.
RECOMMENDATION
The Department of Planning Services recommends this case be forwarded to the County Attorney's
Office for immediate legal action.

OTHER CASE HISTORY
04/10/2008 Phone Call Wayne Harsh (303-619-3627) called. He was upset. He
wanted to know why he was getting in trouble for this.
He said Michelle knew that he was going to put together
a USR application. I tried to explain that Michelle
forwarded this violation to me as a condition of
withdrawing some other application. I asked if he
wanted me to forward him to Michelle. He said yes.
04/14/2008 Phone Call Michelle advised me that she had spoken to Wayne and
he indicated he would be submitting his USR application.
She said she explained that we just needed to be able to
track the submittal of the USR, thus the violation was
initiated.
06/06/2008 Phone Call Michelle called Wayne Harsh and asked how he was
coming on his USR application. He explained to her that
he had been busy cleaning the site. Removing all of the

unwanted derelict vehicles and miscellaneous debris.
His intent was to get the property cleaned up as much as
possible prior to submitting his USR application. He told
her that he had spoken to Karen Kanetel - deal with the
RE is now applicable. Spoke about having him
scheduled for a pre-application meeting soon. He
indicated the containers have sat there for approximately
7 years. Michelle advised him to call Don Dunker with
any flood plain questions. He wants to have the property
limited to equipment, trucks and containers so it is
obvious that all he wants is storage. He indicated that he
is there and is ready to now start on the USR paperwork.
Michelle explained that Bethany would be sending him a
letter scheduling him for the 08/12/08 Violation hearing,
but as long as he had submitted the USR application
prior to 08/11/08 -the hearing would be cancelled. He
said he understood.

On Friday August 1, 2008 an informal meeting was held in the Greeley Planning office regarding
the proposal for the storage of 25 plus cargo / storage containers. The legal description is the
Lot C RE-3453 being part of the SE4 being part of Section 26, Township 3 North, Range 65
West of the 6th P.M. The site consists of approximately 122 acres and is located west of County
Road 47 and south of County Road 30.
Background Information:
Wayne Harsh is currently in violation for having numerous cargo / storage containers on his
property without being appropriately permitted. The violation hearing is scheduled for Tuesday
August 12, 2008 at that time Mr. Harsh is going to request a 60 day continuance to submit a
complete USR application till October 12, 2008. If the USR application comes in after October
12, 2008 the investigation fee (50% of the application fee) will be assessed.
Public Works
The plat shall include the circulation of vehicles on site and the location of the containers.
No traffic study is required
No flood hazard development permit is required
No geological hazard development permit is required
No drainage study is required
Building
A building permit will be required for each cargo / storage container and will be required every
time they are moved. The applicant can ask at the time of the Board of County Commissioners
hearing for the USR to have this requirement waived.
Planning
The USR boundary should not include the entire 122 acres and should be limited to just the
area around the cargo / storage container areas and all outdoor storage areas.
The applicant in their pre-application letter stated that there were 25 cargo / storage containers
on site. Staff recommended that the applicant increase that number to 30 to allow for more.
They typical cargo /storage container on site is approximately 8' x 40' in size.
Staff explained the process that the applicant shall submit 4 packets for our 7 day completeness
review. Once the 7 day completeness review is complete the applicant will be informed of what
items are still required to make the applicant complete. After the completed application is
submitted it will be sent out for referral for 28 days. The applicant will then meet with their
Planner to discuss the referrals and address as many of the referrals as possible. At the
meeting the Planning Commission hearing will be scheduled. The Board of County
Commissioners hearing typically follows approximately 3 weeks after the Planning Commission
hearing.
It is the applicant's responsibility to comply with state statutes regarding notice to mineral estate
owners. Colorado Revised Statute, C.R.S.24-65.5-103 (adopted as part of H.B.01-1088)
requires notification of all mineral estate owners 30 days prior to any public hearing. The
applicant shall provide the Weld County Planning Department with written certification indicating
the above requirements have been met.

August 3, 2007 Wayne Harsh and Randy Lamp applied for a Clustered
Planned Unit Development Change of Zone for eight (8) lots
with Estate uses, four (4) common open space outlots (2.35
acres), and two (2) agricultural outlots (137.87 acres).
November 20, 2007 Planning Commission recommended approval.
January 30, 2008 Michelle Martin held a meeting with the applicants and public
works to go over the conditions. At that time they indicated
they might withdraw their application. Michelle informed the
applicants that they would still need to address the cargo
containers and non commercial junkyard on Mr. Harsh
property even if they withdrew the PUD application.
April 2, 2008 At the applicants request the BOCC withdrew PZ-1098.
April 15, 2008 Michelle Martin talked to Mr. Harsh about the violation on the
property and the necessary steeps to correct the violation.
April 16, 2008 Michelle Martin faxed a copy of the pre-application form.
July 24, 2008 Michelle Martin spoke to Mr. Harsh and he indicated that he
would be bringing in his pre-application request.
July 30, 2008 Michelle Martin received Mr. Harsh pre-application request
which she forwarded to Kim Ogle.

Parking and operation of up to five (5) COMMERCIAL VEHICLES from property equal to, or
greater than, eighty (80) acres in size when used to haul agricultural goods, equipment or
livestock, as long as the number of trips does not exceed sixty (60) per day to and from the
property. When the property is located within an approved or recorded subdivision, or part of a
LOT which is part of a map or plan filed prior to adoption of any regulations controlling
subdivisions, such USE may be permitted through Section 23-4-950 of this Code.
23-3-40 Uses by special review
23-3-40.R Any use permitted as a Use by Right, an Accessory Use, or a Use by Special
Review in the commercial or industrial zone districts, provided that the property is not a lot in
an approved or recorded subdivision plat or lots parts of a map or plan filed prior to adoption of
any regulations controlling subdivision. PUD development proposals shall not be permitted to
use the special review permit process to develop.

would need to be removed, restored or completely SCREENED from all adjacent properties
and public rights-of-ways.

It has come to the attention of the Department of Planning Services staff that the uses on your property may
