HomeMy WebLinkAbout20082823.tiff RESOLUTION RE: APPROVE AGREEMENT FOR COURT SECURITY GRANT FUNDS AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Agreement for Court Security Grant Funds between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Sheriff's Office, and the Colorado Judicial Department,commencing upon full execution,and ending December 31,2009,with further terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado,that the Agreement for Court Security Grant Funds between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Sheriff's Office, and the Colorado Judicial Department be, and hereby is, approved. The COUNTY and JUDICIAL may each be referred to herein as a "Party", or collectively and the "Parties." WHEREAS, in 2007 the Colorado General Assembly enacted SB 07-118, subsequently codified at §13-1-201 et seq., C.R.S., and thereby created the Court Security Cash Fund (hereinafter the "Fund") in the state treasury (see §13-1-204, C.R.S.) to be funded by annual appropriations by the General Assembly; AND WHEREAS, SB 07-118 also created the Court Security Cash Fund Commission (hereinafter the "Commission") to assist the State Court Administrator in distributing the funds to counties (see §13-1-203, C.R.S.) through a program of court security grant applications (hereinafter the "Court Security Grant Program" or"Program"); AND WHEREAS, SB 07-118 also provided for a local security team in each county composed of, at minimum, the Chief Judge, the County Sheriff, and a County Commissioner or Manager, or their designees, to oversee issues of court security for the county (see §13-1-202, C.R.S.); AND WHEREAS, the General Assembly has appropriated Fund moneys for the Court Security Grant Program for State Fiscal Year 2009 (July 1, 2008 - June 30, 2009), and JUDICIAL reasonably anticipates similar funding for State Fiscal Year 2010 (July 1, 2009-June 30, 2010); AND WHEREAS, the local security team for the above-named COUNTY has submitted an application for court security grant funds to supplement the COUNTY'S efforts already in place to improve the security of one or more facilities in which state courts and/or probation offices are located; AND WHEREAS, a grant of funds to the COUNTY has been approved by the Commission and the State Court Administrator. NOW THEREFORE, in consideration of the premises and mutual promises and covenants herein contained, the sufficiency of which is hereby acknowledged, COUNTY and JUDICIAL agree as follows: 1. PURPOSE OF AGREEMENT. The purpose of this Agreement is to acknowledge the grant of up to $37,182.00 to the COUNTY from the Court Security Cash Fund, to define the obligations of the COUNTY under the Court Security Grant Program, and to establish the payment plan under which the COUNTY will receive the said funds. 2. THE AGREEMENT. This Agreement is contained in this writing, which consists of five pages, plus Exhibits A, B and C. 3. TERM OF THE AGREEMENT. This Agreement shall be effective from its date of full execution by both Parties through December 31, 2009. 4. SCOPE OF WORK. The COUNTY shall use the grant funds to accomplish the goals and activities outlined in its Grant Application, including any modifications that may have been made by the Commission in the approval process, attached hereto as Exhibit A. 5. GENERAL CONDITIONS. The COUNTY shall use grant funds only for purposes of court security improvement as set forth in this Agreement. Failure to follow the intent of the Court Security Grant Program may result in revocation of the award, termination of this Agreement, and return of funds. 6. PAYMENT METHOD a. For grant funds, if any, that are to be used for the cost of salaries and employee benefits, disbursement of grant funds shall be made quarterly by JUDICIAL upon receipt of reimbursement request form, attached hereto as Exhibit B, which shall be submitted by the COUNTY within 10 business days following the end of June, September and December, 2009. If disbursement of grant funds on a reimbursement basis causes an undue hardship for COUNTY, disbursement shall be made in accordance with a written schedule prepared and agreed to by COUNTY and JUDICIAL, and attached as an addendum to this contract. b. For all other reimbursable costs, disbursement of grant funds shall be made upon receipt of reimbursement request form and substantiating receipts submitted by COUNTY on the schedule described above. If disbursement of grant funds on a reimbursement basis causes an undue hardship for COUNTY, COUNTY shall submit the vendor's invoice(s) to JUDICIAL for payment directly to the vendor. c. REPORTING REQUIREMENTS. The COUNTY shall submit quarterly activity reports on the Quarterly Activity Report Form attached hereto as Exhibit C. Such reports must be received by JUDICIAL on or before the 5th business day after the last day of each quarter. 8. RECORDS MAINTENANCE. The COUNTY shall maintain a complete file of all records, documents, communications, and other materials that pertain to the Program under this Agreement. Such files shall be sufficient to properly reflect all direct and indirect costs of whatever nature for which a Grant payment was made. These records shall be maintained according to generally accepted accounting principles and shall be easily separable from other COUNTY records, and shall be retained for at least three (3)years following expiration or termination of this Agreement. 9. AUDIT. The COUNTY authorizes JUDICIAL, or its designee, to perform audits and/or inspections of its records at any reasonable time during the term of this Agreement and for a period of three (3) years thereafter to assure compliance with this Agreement. 2 10. ADMINISTRATIVE REPRESENTATIVES. The Parties shall designate administrative representatives for this Agreement, and each Party shall notify the other Party promptly of any change in such designation. STATUS OF COUNTY WORKERS. The Parties understand and agree that the COUNTY'S employees and agents are not employees or agents of JUDICIAL. COUNTY shall have no authorization, express or implied, to bind the Colorado Judicial Department to any agreements, liability or understandings except as expressly set forth herein. 12. INCOME TAXES. COUNTY understands and agrees that COUNTY is responsible to withhold and pay, according to law, any federal, state and local income taxes owed by its employees. 13. UNEMPLOYMENT COMPENSATION. COUNTY understands and agrees that its employees and/or agents shall not be entitled to unemployment insurance benefits for work performed under this Agreement, unless unemployment compensation coverage is provided by COUNTY or by some entity other than JUDICIAL. 14. WORKERS' COMPENSATION. COUNTY understands and agrees that no workers' compensation insurance shall be obtained by JUDICIAL concerning COUNTY or the employees or agents of COUNTY. COUNTY shall comply with workers' compensation law concerning COUNTY and the employees and agents of COUNTY. 15. FRINGE BENEFITS. Because COUNTY is engaged in COUNTY'S own independent business, COUNTY'S employees are not eligible for, and shall not participate in, any employer pension, health, or other fringe benefit plan of JUDICIAL. 16. TERMINATION a. Cause/Default. JUDICIAL may terminate this Agreement, and the Grant Award, upon default by COUNTY, effective immediately upon receipt of notice or termination, or at any time thereafter in the discretion of JUDICIAL. "Default" is defined as the failure to fulfill in a timely and satisfactory manner any of the duties or obligations required under this Agreement. JUDICIAL may in its discretion permit the COUNTY a period of time to cure the default. b. For Loss of Funds. In the event that funding for any activity established by the contract is discontinued or decreased by the State, JUDICIAL may terminate the Agreement or reduce its scope without penalty effective immediately upon receipt of notice of such termination or reduction. In the event of such termination or reduction, the COUNTY will be compensated for the value of services actually performed, if any, prior to the effective date of the termination or reduction. 3 17. INSURANCE. The Parties understand and agree that both are "public entities"within the meaning of the Colorado Governmental Immunity Act, Section 24-10-101 et seq., as amended, C.R.S. (the "Act") and that to the extent required or permitted by the Act both Parties will at all times during the term of this Agreement maintain such liability insurance, by commercial policy or self-insurance, as is necessary to meet its liabilities under the Act. 18. CONFIDENTIALITY. In the event that COUNTY or the employees and/or agents of COUNTY obtain access to any confidential records or files of JUDICIAL in connection with this Agreement, or in connection with the performance of its obligations under this Agreement, the COUNTY and its employees and/or agents shall keep such records and information confidential and shall comply with all laws and regulations concerning the confidentiality of such records and information to the same extent as such laws and regulations apply to JUDICIAL. 19. COMPLIANCE WITH LAW. The Parties to this Agreement shall comply with the letter and spirit of all applicable federal, state and local laws and regulations related to performance under this Agreement, including but not limited to the Colorado Antidiscrimination Act of 1957, as amended, (Section 24-34-401 et seq., C.R.S.) and other applicable law respecting discrimination and unfair employment practices. 20. SEVERABILITY. If any provisions of this Agreement are held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired thereby to the extent permitted by law. 21. ENTIRE AGREEMENT. This Agreement constitutes the entire agreement and a complete integration of all understandings between COUNTY and JUDICIAL, and no modifications or amendments to this Agreement shall be valid unless in a signed writing. 22. NON-WAIVER. The failure of either Party to exercise any of its rights under this Agreement shall not be deemed to be a waiver of any other or subsequent rights. 23. CHOICE OF LAW; VENUE. JAIL MANUAL + rte' 1: .-4:4" _G y .+, DIRECTIVE NO: 2.2.13 EFFECTIVE DATE: April 1, 1999 TITLE: Court House Security REFERENCES: District Court Order, Judge William West, Div I, 94CV419 GUIDELINE Unless exempted, all persons entering the court house pass through the perimeter security screening. Entry to and exit from the court house is restricted to the south and east entrances. The north and west entrances are secured from outside access and are maintained as emergency fire exits with audible alarms. The security screening is intended to eliminate and control ferrous metal weapons and firearms entering the court house. The security staff are authorized to use detection, deterrence, and verbal instructions/commands. The sheriff's deputies provide further enforcement actions. DEFINITIONS: Code 4: A radio signal transmitted by personnel on scene at a"Code 5" to inform responding personnel no further assistance is required. Code 5: An emergency-in-progress radio signal resulting in armed response to the court house by sheriffs deputies. A "Code 5" signal is transmitted on the jail radio system by broadcasting "Code 5, (specific location in court house), (nature of emergency)." The person reporting an "Code 5" will provide updated information using the portable radio as circumstances allow. Weapons: 1) Firearms of any type; or, 2) Ballistic knife--any knife that has a blade which is forcefully projected from the handle by means of a spring-loaded device or explosive charge; or, 3) Blackjack, baton, club--means any billy, sand club, or other hand-operated striking weapon; or, 4) Knife--any dagger, dirk, knife or stiletto with a blade over three and one- half inches in length or any other dangerous instrument capable of cutting, stabbing, or tearing wounds including, but not limited to, marshal arts throwing stars, etc. 5) Explosives, explosive devices, including, but not limited to, timing devices with wiring, chemical compounds, or any chemical device which is not specifically designed or intended for lawful or legitimate use in the hands of its possessor; or, 6) Stun gun or chemical agent--any device capable of temporarily immobilizing a person by the infliction of an electrical charge or chemical agent including, but not limited to, CS or CN gas or oleoresin capsicum (pepper mace). Exception: Personal protection OC carried by Staff/Support personnel is not considered a weapon in this definition. Security Screening Staff: Persons assigned to follow court house security procedure and operate security screening equipment. Security screening staff will wear a uniform. Generally, security screening staff are employees of a private security agency and as such are not peace officers and have no law enforcement authority or responsibilities. Security Screening Point: Walk-through ferrous metal detector, hand-held ferrous metal detector, x-ray unit, portable radio on jail radio frequency, and security officer. Staff/Support: Judges, courthouse employees,District Attorney and Deputy District Attorneys, Public Defender's Office attorneys, Weld County Attorneys Office attorneys, Weld County Probation Officers, Weld County Buildings and Grounds employees and sheriffs deputies not in Section 2.2.13 July 31, 2008 Page 2 WELD COUNTY SHERIFF'S OFFICE PROCEDURES 3. Not on the list and unarmed: The individual is checked against the displayed, current photo-identification card issued by their respective agency. Once the identity is confirmed, the officer is directed to enter without passing through the security screening equipment. (Process as staff/support persons) 4. Not on the list and armed: Officers are registered on a log for armed peace officers. a. Officers are required to print their name and agency in the registration log. b. The screening officer countersigns the officer's entry, affixes the current date and time, and records the number of an "A" tag. c. An "A" tag is issued and prominently displayed on the armed individual. e. Peace Officers Entering Division VI: The officer presses the master control intercom at the controlled door adjacent to the automated metal detector in the Public Lobby. I. Master control informs the officer firearms are not authorized past that point. (1) Armed officer's are directed to pass through the wood lobby door into the Probation Department area and deposit the weapon the gun lockers in the back hallway just outside the secure perimeter. (2) If the front counter is not staffed to open the lobby door to the gun locker, the officer should be directed to use the lobby telephone, call master control, and obtain the electronic lock combination. ii. Master control allows professional and peace officer access through the controlled door. PROCEDURE II: Court House Exit Exempted, Staff/Support, General Public, Unarmed Peace Officers: Unrestricted exit. Section 2.2.13 July 31, 2008 Page 5 WELD COUNTY SHERIFF'S OFFICE PROCEDURES II. Not on the list and armed: The peace officer returns the issued "A" tag to the screening officer and signs the log book. A. The screening officer verifies the number on the "A" tag is the same tag issued, countersigns, affixes current date and time, and clears the officer to depart. B. Completed logs are provided to the jail manager at the close of each business day. PROCEDURE III- Court House Admission 1. Court clerks and Court Administrator control after hour access. Each report shall include a narrative description of: (I) project activities during the calendar quarter; (2)any reportable security incidents or threats'; (3)any significant problem areas that developed and how they were or will be resolved; and (4)the activities scheduled during the next reporting period. Report (attach additional pages if necessary) The Colorado Court Security Reference Guide defines a reportable threat or incident as,"Definition of a Threat "A security threat is an event that has the potential to cause,or has in fact caused, personal injury or property loss." Definitions of Reportable Threats The following are definitions of threats that shall be reported: A. Attempted or actual acts of violence to persons or property of the court; B. Verbal or written threats of future violence;and/or C. Conduct or patterns of conduct(inappropriate communication or actions)which cause concern about the possibility of future violence. Hello
