RESOLUTION
RE: APPROVAL OF SPECIAL USE PERMIT FOR A FUEL ALCOHOL PLANT FOR
DUANE BASHOR, ET AL. , GILL, COLORADO 80624
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado held a public hearing on the 22nd day of April, 1981
at the hour of 2 : 00 o'clock p.m. in the Chambers of the Board of
County Commissioners, for the purpose of hearing the application
of Duane Bashor, et al. , Gill, Colorado, for a Special Use Permit
for a fuel alcohol plant on the following described real estate,
to-wit:
Part of the Southwest Quarter of the South-
west Quarter of Section 16 , Township 6
North, Range 63 West of the 6th P.M. , Weld
County, Colorado
WHEREAS, the petitioners were present, and
WHEREAS, evidence was presented in support of the granting
of the Special Use Permit for a fuel alcohol plant on the above
described real estate, and
WHEREAS, Section 3. 3 (E) (2) of the Weld County Zoning Resolu-
tion authorizes such a use in an Agricultural Zone District upon
approval by the Board of County Commissioners, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado heard all of the testimony and statements of those pre-
sent, has studied the request of the petitioners and the recom-
mendations of the Weld County Planning Commission and all of the
exhibits and evidence presented in this matter, and having been
fully informed, is satisfied that the request for a Special Use
Permit for a fuel alcohol plant on the hereinabove described real
estate, conforms to the purposes of Section 3 . 3 (E) (2) of the Weld
County Zoning Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis-
sioners of Weld County, Colorado that the application of Duane
Bashor, et al. , for a Special Use Permit for a fuel alcohol plant

on the hereinabove described tract of land be, and hereby is,
granted subject to the following:
1. The Development Standards contained in the Special
Use Permit. (It should be noted that the first
sentence of Development Standard No. 8 has been
stricken by the Weld County Planning Commission
and Development Standard No. 8 should read as
follows : "No By-Product Distillers Grain shall
be stockpiled, or allowed to decompose or there-
fore create odor problems or unsanitary conditions. "
The Board of County Commissioners adopt said Devel-
opment Standard as stated herein. )
' 2. No building or electrical permits shall be issued
on the Special Use Permit area until the Develop-
ment Standards for the Special Use Permit have been
placed on the Special Use Permit Plat and said plat
has been delivered to the office of the Department
of Planning Services.
BE IT FURTHER RESOLVED by the Board of County Commissioners
of Weld County, Colorado that the reasons for approval contained
in the Weld County Planning Commission recommendations dated
March 3, 1981 be, and hereby are, adopted as the findings of fact
of the Board of County Commissioners in this matter.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 22nd day of
April, A.D. , 1981.

Be it Resolved by the Weld County Planning Cainission that the

be recommended (favorably) to the Board of County
Commissioners for the following reasons:
1. It is the opinion of the Planning Commission that with the design and
controls proposed in the operation, and the attached development
standards, potential adverse impacts on the surrounding environment
can be mitigated.

operation is in compliance with the provision of Section 3.3.E. (2)

Use Permit area until the attached Development Standards for the
Special Use Permit have been placed on the Special Use Plat and
said plat has been delivered to the office of the Department of

SUP 445:81:1
1. The uses permitted on the hereon described parcel shall be a commercial
fuel alcohol plant with a production capacity of 1,000,000 gallons
of ethanol per year and all other uses permitted by right in the
Agricultural Zone District. Structures and facilities shall be as
shown on the plat.
2. The Special Use Permit area shall be maintained in such a manner so as
to prevent soil erosion, fugitive dust, and the growth of noxious weeds.
3. Lagoons for wastewater retention shall be installed as per Rules and
Guidelines for Water Pollution Control at Livestock Confinement Areas
issued by the Colorado Department of Health, May 1968. The applicant
shall be responsible for any additional applicable directives or guide-
lines issued by the Colorado Department of Health, Water Pollution Control .
Division. There shall be no discharge of wastes into any streams, other
bodies of water, or adjacent drainage systems without obtaining a
National Pollution Discharge Elimination System Permit from the Colo-
rado Department of Health.
4. All accesses shall have the approval of the Weld County Engineering
Department. All accesses shall be constructed in accordance with the
recommendations and/or requirements of the Weld County Engineering
Department.
5. All phases of the operation shall comply with all County, State and
Federal Health Standards and Regulations pertaining to air quality,
water quality, noise emission, and sanitary disposal system. The
applicant shall obtain an Air Emission Permit through the Air pollution
Control Division, Colorado Department of Health, 4210 E. 11th Ave. , Denver
Colorado 80220. Odors from the ethanol manufacturing or lagoon areas
must not exceed the 15:1 dilution to threshold as specified in the
Colorado Air Quality Commission's Regulation No. 2.
6. Security fencing shall be in accordance with the Alcohol , Tobacco and
Firearms Bureau permit requirements . The owner/operator shall be
required to maintain a permit for production of alcohol with the
Alcohol , Tobacco and Firearms Bureau of the United States Government.
The owner/operator shall be responsible for complying with the conditions
and standards of the Federal permit.

7. Representatives or members of the Weld County Health Department, Weld
County Department of Planning Services Zoning Inspectors and/or Colorado
Department of Health shall be granted access to the site at any reasonable
time in order to insure the operations carried out on the site comply
with all applicable Weld County and State Health Regulations.
8. No By-Product Distiller Grain (stillage) shall be stored on the site for
longer than 48 hours unless stored in air-tight containers. No

By-Product Distillers Grain shall be stock piled , or allowed to de-
compose or therefore create odor problems or unsanitary conditions.
9. The foundation, septic system and cooling ponds shall be designed by
qualified personnel.
10. The Special Use Permit shall be limited to the plans shown hereon and
governed by the Development Standards stated above and all applicable
Weld County Regulations. Any material deviations from the plans and/or
Development Standards as shown or stated above shall require the approval
of an amendment to the Special Use Permit by the Planning Commission
and the Board of County Commissioners before such changes from the
plans and/or Development Standards shall be permitted. Any other
changes from the .plans and/or Development Standards shall be filed in the
office of the Department of Planning Services.
11. The property owner and/or operator of this operation shall be respons-
ible for complying with all of the above stated Development Standards.
Non-compliance with any of the above Development Standards may be
reason for revocation of the Special Use Permit by the Board of County
Commissioners.

The Galeton Fire District has not responded to the referral sent to them.

"I would observe that consistent with what Mr. Ehrlich has observed I 'm
relying heavily on the Staff recommendation from a scientific background
in this thing because I don't know anything about them or what could go
wrong, but under the circumstances that have been presented it seems
like it's appropriate."

Public Hearing to consider the comprehensive revision of the Weld County
Zoning Ordinance and Map. Tape 46 - side 1 (latter 1/3)
Allen Jost introduced into the record the legal notice published in the
Weld County Newspapers announcing the public hearing, the records of
meetings held during the last two years, copies of notices and names and
addresses of persons and organizations to whom information was sent, and
comments from residents received regarding the zoning revision.
There were several concerned residents who wanted to participate in the
meeting, they were:
Fred Witsell from Public Service Company who had some comments but
expressed overall satisfaction with the proposed revisions.
Kris Varrell who had a question to be answered later.
Bob White from the Briggsdale area who had some comments and suggested
ammendments as a result of the Weld County Charter.
Kathy Ley for the League of Women Voters spoke regarding their positive
reaction to the efforts made to revise the Weld County Zoning
Ordinance and Map, and thanked the staff for keeping them informed.
Ron Bernahard expressed his difficulites in obtaining the new book
containing the proposed revisions . He also asked the question about
exsisting uses and would they then become non-conforming uses. There
were some questions in regard to legal non-conforming use and about
intermittent use with cattle. Allen Jost responded. Later discussion
involved the number of cattle that could be on the property under the
proposed Zoning Ordinance without having to obtain a permit in
comparison to the existing ordinance.

Adolf Bohlander had some comments about zoning in regards to irrigation
ditches and irrigations facitliies . He was concerned about water and
preserving ditches and farming in the overall plan. Allen Jost responded
and there followed general discussion. Tom Honn elaborated on the same
subject. Mr. Bohlander had some additional comments regarding State
Laws and Regulations, and the Flood Plain ordinance that was adopted
• in April 1980 was also mentioned.
Manuel Pineda made some statements about preserving the farmers land.
He doesn't know if he wants it preserved or not. He was concerned about
not being able to change the zoning and the use, once it had been done.
The statement was made by Bob Ehrlich that the proposed ordinance is much
more liberal than the old one.

Jerry Jamison, who owns part of a 320 acre parcel in the southern part
of the county, and uses it as an auto wrecking area, had some concerns
about the change of their area from Industrial to Agricultural . One of
these concerns was the possibility of a change in the value of the
proterty. Allen Jost responded to his question.

Mr. Jamison said that the county could expect them to vigorously resist
the change.
Norman Brown, representing the Ag. Council , thinks a lot of the paper
can and should be eliminated. He also questioned the need for some of
the definitions. There were some comments on State Law in regard to
agricultural buildings not needing to have building permits . This was
discussed and clarified. Weld County building code does require the
permits even if the State doesn't. The Board of County Commissioners
are currently considering this issue. Mr. Brown also discussed the
possibility of setting a precedent for more changes outside municiple areas.
Allen Jost responded to Brown's comments.
John Hochmiller spoke regarding the same 320 acre parcel referred to
earlier in the hearing by Jerry Jamison. He had the question about
what is the comprehensive plan for that area. Allen Jost responded
to this and then elaborated on this issue, extensive discussion followed.
The problem with this , according to Mr. Hochmiller, is that the ground
is not compatable with farming; it's best use, is the salvage yard.
Mr. Otis stated he would like to take this question under advisement.

Mr. Hochmiller's concerns were again expressed and stressed the fact
that they really don't know what the long range plans will be.
Pat Endsley, who is also a member of the "320 club" spoke. She was
concerned about the uses allowed in the "I" zone. Allen Jost responded
and listed the uses allowed in the current I zone.
Ernie Ryberg also holds a lease on the same property. He had a letter
from Tom Honn which contradicted the proposed redistricting of the
property in question. Mr Otis pointed out that we don't want to make
- the rules as we go. He again stated he would like to consider this
issue in a work session. Request was made for another meeting.
Discussion followed. Mr. Otis will appoint two members of the
Planning Department staff along with the land owners in this area to
try to resolve this issue. Mr. Anson will meet with Tom Honn, and
Allen Jost to clarify for Mr. Hochmiller which uses are legally allowed
in the proposed zone district.

Heather Ryan, representing Flat Iron, expressed concern about redistricting
their property. It is felt by them that their property is not suitable
for agriculture. She relayed from Mike Hart, an employee of Flat Iron,
a request for a postponement on adoption. Mr. Kiefer asked whether the
problem could be worked out. She felt it could
Mr. Witsell , from Public Service Company, expressed some concern about
redistricting. He requested that major facilities of a public utility
be made uses allowed by permit in the I-3 district.
Thomas Rounds echoed the comments of the league of Women Voters in
commending the Planning Staff for doing a good job.
Kris Varrell had her question about zoning answered. It currently is
"I" . "I" is proposed to be redistricted to "I - 2" .
Bob Ehrlich made some comments regarding the proposed new zoning. He
stated that the new ordinance is better than the existing regulations .
The Chairman appointed Jack Holman and Wilber Wafel to work with the
Planning Staff to address some of the questions brought up during the
hearing.
MOTION: Bob Ehrlich moved this matter be continued until the next
regular meeting of the Planning Commission, which will be on February
• 17, 1981 , at 1 :30 p.m. Seconded by Jerry Kiefer. Passed with a
unanimous voice vote.

I hereby certify that pursuant to a notice dated March 16, 1981 and
duly published March 19 & April 9, 1981 in the Johnstown Breeze a public
hearing was held on a request for SPECIAL USE PERMIT FOR A FUEL
ALCOHOL PLANT by DUANE BASHOR, ET AL.
Mr. Honn reviewed the Planning Commission' s favorable recommendation
and proposed development standards.
Mr. William Schunter, professional engineer doing the work on the
plant, explained the facility and answered the Boards questions
concerning it. Mr. Schunter stated they have received their permit
from the Dept. of Alcohol, Tobacco & Firearms.
There was no one present in opposition to this request
Following discussion Commissioner Kirby made a motion to approve the
SUP with the recommended development standards. Commissioner Steinmark
seconded the motion and it carried unanimously.
Mr. Honn presented for the Boards consideration RE : 481. This request
is to split the property into parcels of 9 . 59 acres and 70 acres.
The Bashor Brothers have requested this exemption for financing
purposes on the fuel alcohol facility. The Planning staff recommends
this request be approved.
Commissioner Carlson made a motion to approve RE ' 481. Commissioner
Steinmark seconded the motion and it carried unanimously.

10. The Special Use Permit shall be limited to the plans shown hereon and
governed by the Development Standards stated above and all applicable
Weld County Regulations. Any material deviations from the plans and/or
Development Standards as shown or stated above shall require the approval
of an amendment to the Special Use Permit by the Planning Commission
and the Board of County Commissioners before such changes from the

Dear Commissioners :
The attached application, plat, and related items are in reference to a request
from Duane Bashor et al for a recorded exemption. The parcel of land on which
this request has been made is described as S? SWa Section 16, T6N, R63W of
the 6th. PM, Weld County, Colorado This property is located 11/2 miles east of
Barnesville. The property contains approximately 80 acres of Class I , II , III ,
& IV irrigated soils. The request is to split the property into parcels of
9.59 acres and 70.0 acres.
The Bashor Brothers have requested this exemption for financing purposes on a
planned fuel alcohol facility. The Bashor Brothers have applied for a special
use permit for the fuel alcohol facility.
Based upon the information submitted and the adopted policies in the County, the
the Department of Planning Services Staff recommends the request be approved for
the following reasons :
1. The proposed split conforms with Section 9-2 of the Weld County Subdivision
Regulations (intent clause of the recorded exemption procedure) , Section
3-3 A. of the Weld County Zoning Resolution (intent clause of the Agricultural
Zone District) , and the Weld County Comprehensive Plan in that the use will be
compatible with surrounding agricultural uses.
2. The request complies with the provisions of Section 9-4 A. of the Weld
County Subdivision Regulations.

Gentlemen:
We are requesting approval of a Recorded Exemption and Special Use
Permit for 9.59 acres in Section 16, T6N, R63W, two miles west of
Barnesville, to build and operate a fuel alcohol facility.
We will be deeding the land to a corporation, Farm Energy Systems, Inc. ,
and will be using technology developed by Anchor Steel and Supply, Inc. , of
Longmont, Colorado. William Schunter, Professional Engineer registered
in Colorado, #7433, will be doing the design work for this plant.
Associated Engineers, Inc. , of Greeley is doing our surveying and
assisting with the Special Use Permit work. On their map, dated
Jan. 1981 Project 20194G, they have laid out the general area of the plant.
Please note that we plan access to the plant from our feedlot road
which is immediately adjacent on the north. At a later time, we could
bring a road in from County Road 68; however we feel that the security
of the area would be better to use our existing roadway at this time.
Farm Energy Systems, Inc. will be operating the plant around the
clock with two persons per shift. One person on each shift will be the
lead operator and the other person will be designated as a helper. In
addition to this, we will have our bookkeeper and overall administration
which will include the officers of Farm Energy Systems, Inc. Bathroom
facilities will be provided and a septic system is planned. We already
have a domestic water tap available on the property.
Our visits to other operating plants around the country have
indicated that there is no offensive odor connected with this type of
operation. We also, of course, are planning a bio-gas unit to make methane
from manure which will actually cut down on the odor from the feedlot, since
the manure will be used on a continuous basis inside the anaerobic
digester.
The plant will utilize about 600 bushels of ground grain per a , or
4,200 per week and will be producing 1 ,500 gal . of fuel alcohols-This
activity will , therefore, require seven or eight trucks coming in pe?mot
week on a fairly routine basis.

Alcohol , especially in its pure form (anhydrous) is a fire hazard.
Precautions will be taken to keep the alcohol separated in the areas of
production and it will be stored in approved tanks at least 60 feet from
the buildings, inside a security fence. We will obtain an alcohol
production permit and will comply with the denaturing rules set up by the
ATF Department.
We have allowed a space on the property for a cooling water pond if
it is needed. However, we will be using an air-cooled condenser, rather
than the usual water-cooled type. This condenser, designed for 100,000
BTU per hour using 90° air, will allow us to reduce the usual cooling
water by at least 250 gallons per hour. Process water will come from our
well located at the feedlot.
At the present time, the dewatered stillage will be fed each day.
This will save considerable quantities of heat. The whole plant is
designed around the concept of energy savings.
We understand that these "on the farm" units are fairly new. The
technology is improving rapidly and, while we are planning a "gallon a
minute" plant to start with, we will want to increase our production as
we see our way clear to do so.
We have experienced enthusiasm and cooperation from everyone we have
contacted, including Mr. Amos Finch of AgLand at Eaton who has given us
a letter of intent to purchase all the alcohol we will be producing.

We have reviewed the special-use permit application for the Bashor
Fuel Alcohol Plant. The conditions that may affect the site are

may necessitate a special foundation design, an engineered septic
system, and an impermeable liner for the cooling pond.
We recommend that the foundation, septic system, and cooling pond
be designed by qualified personnel .

This is in answer to your request for soil anc: site information regarding
the construction of a fuel alcohol-biogas production plant with associated
structures, buildings, septic systems and cooling water pond, to be located
in the SASW4 of Section 16, Twp. 6N, Range 63W, Weld County, Colorado.
There are three soil types found in the proposed area: Otero sandy loam,
0 to 1 percent slope (50) ; Vona loam sand, 0 to 3 percent slope (72) ; and
Vona loamy sand, 3 to 5 percent slope (73) . All three soils exhibit slight
to no limitations for the construction of buildings or the installation of
septic tank filter fields. All three soils exhibit moderate to rapid perme-
ability which will require holding ponds to be sealed to decrease seepage
losses.
Otero sandy loam, 0 to 1 percent slope is considered to be prime farmland
if irrigated.
The proposed area is not a mud slide zone.

be found on sheet 10, "Barnesville Quadrangle".
