RE: DENIAL OF CHANGE OF ZONE FROM I-3 (INDUSTRIAL DISTRICT) TO
A (AGRICULTURAL DISTRICT) FOR THE WELD COUNTY PLANNING
COMMISSION - JOHN WILLARD
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, a public hearing was held on the 7th day of July,
1982 , at 2 : 00 o'clock p.m. for the purpose of hearing the application
of the Weld County Planning Commission - John Willard, 915 10th
Street, Greeley, Colorado 80631 , requesting a Change of Zone from
I-3 (Industrial District) to A (Agricultural) for the following
described parcel of land, to-wit:
Beginning at the Northeast Corner of Section 34 , Township 1
North, Range 66 West of the 6th P. M. , thence south 30 feet
to the true point of beginning; thence south 1 ,200 feet;
thence West 600 feet; thence north 1,200 feet; thence East
600 feet, more or less to a true point of beginning, lying in
the Northeast Quarter (NE 1/4) of the Northeast Quarter (NE 1/4)
of Section 34, Township 1 North, Range 66 West of the 6th
P. M. , Weld County, Colorado, containing 16 . 527 acres , more
or less.
WHEREAS , the petitioner was present, and
WHEREAS, Section 21. 6 . 2 of the Weld County Zoning Ordinance
provides standards for review of such a Change of Zone, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County Planning
Commission, and
WHEREAS, the petitioner has failed to show that the existing
zoning was faulty, and
WHEREAS , the Board of County Commissioners hereby finds that
the petitioner has not met his burden of proof in fulfilling the
requirements of the Weld County Zoning Ordinance for a Change of
Zone.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis-
sioners of Weld County, Colorado that the petition of the Weld
County Planning Commission - John Willard - for a Change of Zone
from I-3 (Industrial District) to A (Agricultural District) on the
above-described tract of land be, and hereby is, denied.

The following business was transacted:
I hereby certify that pursuant to a notice dated May 24, 1982, duly
published June 3, 1982 and June 24, 1982 in the LaSalle Leader, a public hearing
was held on the request of the Weld County Planning Commission, John Willard,
for a Change of Zone, from I-3 (Industrial) to A (Agriculture) . The Planning
Commission recommended that this request be denied. John Willard reminded the
Board that he did not make this request and that he would prefer that the zone
remain Industrial rather than Agriculture. Mr. Willard stated that he would
like to have the road upgraded, but that he does not object to the congestion on
said road. Mr. Willard anticipated that no more dust would blow from his property
any more than it does from the county road adjacent to the property. After the
Board discussed the property, it's zoning, and the reasons, Commissioner C.
Carlson made a motion to deny the Change of Zone request because the applicant
has not met his burden of proof in fulfilling the requirements of the Weld County
Zoning Ordinance. The applicant failed to show that the existing zoning was
faulty. Commissioner N. Carlson seconded the motion and it carried by the
following vote: Commissioners C. Carlson, N. Carlson and Kirby voted yea,
Commissioner Steinmark voted nay and Chairman Martin abstained because he is
related to the landowner, Mr. Willard. There was no one present who objected
to the request. Commissioner C. Carlson stated that the facility on this property
is a packing house and that it is in a perfect spot and believes that it should
be zoned Industrial.

This development was permitted as an industrial development to allow an agri-
business to permit the agri-business use by Special Review in the Agricultural
District. This permits the County a more specific site and use review, discourages
the possibility of non-agribusiness uses occuring in an area intended for agri-
businesses, and results in better consistency with the County's growth plan
policies.
The Weld County Planning -Commission recommendation is conditional upon the

The requested Use by Special Review is in compliance with the Weld County Zoning
Ordinance, Section 24.3. 1 as follows:
- The proposal is consistent with the Weld County Comprehensive Plan
which promotes agriculture and agribusiness uses throughout the County
and suggests that agri-businesses can occur in rural areas.
- The proposal is consistent with the Agricultural Zone District which
is intended to provide a location for agricultural and related activities
as well as for Uses for Special Review.
- Agri-business uses will be compatible with existing and future uses
for this area which are presently agricultural in nature and will
continue to be such according to the Comprehensive Plan.
- No overlay districts affect the site.
- The Use by Special Review site is presently developed and as such
affects land not in production.
- The neighborhood and County's health, safety and welfare is protected
by the attached standards for development, as well as compliance with
the Comprehensive Plan.
The Department of Planning Services staff recommendation is conditional upon the
following:
1. The attached development standards being adopted for the request; and
2. The standards being made a part of the County Commissioner's Resolution
for approval.
DEVELOPMENT STANDARDS
USR-506:82:21
1. The uses permitted shall be a meat packing and slaughter plant
operation.
2. Additional buildings necessary to facilitate the meat packing and
slaughter plant operation can be permitted on the site in conformance
with the Agricultural District Bulk Requirements and these Development
Standards.
3. Access to the Use by Special Review area shall be as shown hereon.
All accesses shall have the approval of the Weld County Engineering
Department. All accesses shall be constructed in accordance with
the recommendations and/or requirements of the Weld County Engineering
Department.
4. The Use by Special Review shall be limited to the plans shown
hereon and governed by the Development Standards stated above and
all applicable Weld County Regulations. Any material deviations
from the plans and/or Development Standards as shown or stated
above shall require the approval of an amendment to the Use by
Special Review by the Planning Commission and the Board of County
Commissioners before such changes from the plans and/or Development
Standards shall be permitted. Any other changes from the plans
and/or Development Standards shall be filed in the office of the
Department of Planning Services.
5. The property owner and/or operator of this operation shall be
responsible for complying with all of the above stated Development
Standards. Noncompliance with any of the above stated Development
Standards shall be reason for revocation of the Use by Special
Review Permit by the Board of County Commissioners.

Weld County Planning Commission (Willard)
I. This case was continued from the May 4, 1982, Planninc Commission
in order to allow the Planning Commission members an opportunity to
survey the site.
II. At this time the staff has additional information to present.
III. The Change of Zone from "A" (Agriculture) to "I-3" (Industrial) was
initially granted to allow for a custom meat processing plant. At
the time the application was approved the Use by Special Review
mechanism was not available. The appropriate application for this
operation would be a Use by Special Revies.
IV. It is the opinion of the Department of Planning Services staff that
the rezoning request to "A" (Agricultural) is appropriate and is
consistent with the basic goals and policies of the Weld County
Comprehensive Plan.
With respect to industrial devekopment:
Within Chapter 1, Introduction of the Plan under Section A. ,
Nature of the Plan, it is stated on Page 2 that:
"Further urban development and growth will inevitably
occur throughout Weld County. This Comprehensive Plan
-outlines a course of action which assures urban growth in
accordance with the concepts and desires of each existing
municipality. At the same time, urban development will
take place with a minimum of impact on the environment
and with a maximum of economy in providing; public utilities
and services. The net result is a controlled expansion
of our existing municipalities into well planned, coherent
communities that blend into and complement the surrounding
agricultural environment."
More specifically, the Comprehensive Plan addresses Industrial
development in Chapter Three, Resource Management Policies, Section
B, Urban Development, states on Page 62 that:
"Industrial development, like commercial development, is
encouraged to locate in one of the existing municipalities
where such a facility can be accomodated according to a
local comprehensive plan."
V. Other facts that are important to this Change of Zone proposal are:
1. The subject site is 21 miles from Birghton's future industrial
area.
2. The Planning staff at the city of Brighton was contacted and
they recommended that this area be changed back to agriculture.
Denial of this request would not support Brighton's Growth and
Development Policy Plan, and thus would not support the Weld
County Comprehensive Plan.

3. The Department of Planning Services staff feels that conditions
have not changed in this area to warrant industrial development
zoning.
a. No other development has occured on the subject
property or in the general vicinity that could be
considered industrial in nature.
b. Since industrial uses have not occurred on the
subject property or surrounding area the Department
of Planning Services staff does not feel that any
uses or rights would be removed if the zoning were
changed to "A" (Agriculture) District.
c. The operation could continue as is with a Use by
Special Review Permit classification in the "A"
District.
d. The applicant would also like to point out that
under the current Weld County Zoning Ordinance this
area could be used for any agricultural business
under the provisions of Section 31.4 describing
special uses permitted in the Agricultural Zone
District.
4. Further, the County would not lose or gain any tax base by
approving this application because the use is taxed and not
the zoning.
