HomeMy WebLinkAbout20083385.tiff HEARING CERTIFICATION DOCKET NO. 2008-90 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1148 FOR CHANGE OF ZONE, CZ#1148, FROM THE A(AGRICULTURAL) ZONE DISTRICT TO THE 1-3 (INDUSTRIAL) ZONE DISTRICT - GLAZE INDUSTRIAL PROPERTIES, LLC A public hearing was conducted on December 31, 2008, at 10:00 a.m., with the following present: Commissioner William H. Jerke, Chair Commissioner Robert D. Masden, Pro-Tem Commissioner William F. Garcia Commissioner David E. Long Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Jennifer VanEgdom County Attorney, Bruce Barker Planning Department representative, Michelle Martin Health Department representative, Lauren Light Public Works representative, Don Dunker The following business was transacted: I hereby certify that pursuant to a notice dated October 27, 2008, and duly published October 31, 2008, in the Greeley Tribune, a public hearing was conducted to consider the request of Glaze Industrial Properties, LLC, for Change of Zone, CZ#1148, from the A(Agricultural) Zone District to the 1-3 (Industrial)Zone District. Bruce Barker, County Attorney, made this a matter of record. Michelle Martin, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. She stated the site is located south of County Road 8, and east of County Road 27; within an area which currently supports commercial and industrial development, and according to the 2007 Comprehensive Plan for the City of Fort Lupton, the site is located within an area which supports mixed uses. She confirmed the referral response from the City of Fort Lupton indicates no objections, and the property directly south of the site is zoned 1-3 (Industrial) and is currently being utilized for oil and gas support services. She indicated if the Change of Zone Application is approved by the Board, the applicant will be required to apply for a Site Plan Review for the business which is currently operating on the site. She gave a brief description of the uses of the surrounding properties and indicated the City of Fort Lupton has annexed property to the north and to the west. Ms. Martin indicated the referral received from the Department of Public Works indicates the site contains four accesses, and with the approval of the Department, the applicant has closed two of the accesses. She indicated County Road 8 is classified as a collector status road, requiring 80 feet of right-of-way at full buildout, County Road 27 is classified as a major arterial road, requiring 140 feet of right-of-way at full buildout, and both roads are maintained by the City of Fort Lupton. She stated sixteen referral agencies reviewed the request, and twelve responded favorably, or provided comments which have been addressed through the Conditions of Approval. Ms. Martin displayed photographs of the site and surrounding area, and in response to Commissioner Masden,she confirmed the property owned by Halliburton has not completed the 2008-3385 PL1994 �� PL &o, 6/ „co _ O9 HEARING CERTIFICATION - GLAZE INDUSTRIAL PROPERTIES, LLC (CZ#1148) PAGE 2 annexation process with the City of Fort Lupton. In response to Commissioner Rademacher, Ms. Martin indicated the site will not become an enclave as the City of Fort Lupton has not annexed the property to the south of the site. In response to Commissioner Garcia, Ms. Martin clarified the submittal and approval of a Site Plan Review for the business on the site will correct the current violation, and she confirmed the applicant has been working diligently to come into compliance. Further responding to Commissioner Rademacher, Ms. Martin reiterated the second referral provided by the City of Fort Lupton, dated August 28, 2008, indicates the City does not have any concerns. Don Dunker, Department of Public Works, stated County Road 27 is a paved road currently containing 60 feet of right-of-way, and requires 140 feet of right-of-way at full buildout. He stated the most recent traffic counts, taken in June, 2003, indicate approximately 3,470 vehicle trips per day north of the site. He further stated County Road 8 is a paved road, requiring 80 feet of right-of-way at full buildout, and the most recent traffic counts, taken in September, 2007, indicate approximately 968 vehicle trips per day, east of the of the site. He reiterated the City of Fort Lupton provides maintenance for both roads, and confirmed the applicant has closed one access on County Road 27, and one access on County Road 8, leaving one access open on each road. He indicated the use on the site will add approximately eight vehicle trips per day for employees, and a semi-truck will add approximately one or two roundtrips per month. He requested modification of Condition of Approval #2.E, to indicate a total of 40 feet of right-of-way from the edge of the existing right-of-way shall be delineated on the plat,and the Board concurred with the modification. Lauren Light, Department of Public Health and Environment, indicated the site contains a commercial well and a septic system handles the effluent flow. She confirmed the concerns regarding dust, wastes, and the septic system will be reviewed upon the submittal of the Site Plan Review application. She further confirmed the Department does not have any outstanding concerns with the Change of Zone application. Michael Glaze, applicant, indicated the main aerial photograph provided by staff was taken before he took possession of the property, and he confirmed he has since eliminated several buildings on the property through an approved demolition permit, as well as other junk which had accumulated on the property. He indicated the newer photographs presented by Ms. Martin depict the fence which has been installed to help screen the equipment on the site, and he confirmed he picked the location of the site for the operation of his small plumbing business. He stated the company owns six trucks, three of which are currently in operation, and a couple pieces of machinery are stored on the site. He clarified the employees leave the facility with company trucks in the morning hours, and generally do not return to the property until evening hours. No public testimony was offered concerning this matter. In response to Chair Jerke, Mr. Glaze indicated he has reviewed and concurs with the Conditions of Approval, as modified. Commissioner Masden moved to approve the request of Glaze Industrial Properties, LLC, for Change of Zone, CZ #1148, from the A (Agricultural) Zone District to the 1-3 (Industrial) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the 2008-3385 PL1994 HEARING CERTIFICATION - GLAZE INDUSTRIAL PROPERTIES, LLC (CZ#1148) PAGE 3 Conditions of Approval as entered into the record, and modified. His motion included the modification of Condition of Approval #2.E, to indicate a total of 40 feet of right-of-way from the edge of the existing right-of-way shall be delineated on the plat. The motion was seconded by Commissioner Rademacher, and it carried unanimously. There being no further discussion, the hearing was completed at 11:00 a.m. This Certification was approved on the 5th day of January, 2009.
