404 of the Clean Water Act under which the U.S. Army Corps of Engineers regulates the discharge of
dredged and fill material, and any excavation activity associated with a dredge and fill project in waters
of the United States.
• Based on the information provided, a Department of the Army(DA)Permit will not be required
for work at this site. Although a DA Permit will not be required for the project, this does not eliminate
the requirement that other applicable federal, state, and local permits be obtained as needed.

Description: Open pit mining and mineral processing
There are no historical Building permits attached to this parcels .
1. A building permit shall be obtained prior to the change of use of any structure, or
construction of any new structures
2. A plan review is required for each building for which a building permit is required. Two
• complete sets of plans are required when applying for each permit. Include a Code Analysis
Data sheet provided by the Weld County Building Department with each Building permits
Submittal plans shall include a floor plan showing the specific uses of each area for the building.
The Occupancy Classification will be determined by Chapter 3 of the 2006 International Building
Code. The plans shall also include the design for fire separation and occupancy separation
walls, when required by Chapter 5 and 7 of the 2006 International Building Code. Fire Protection
shall conform to Chapter 9 and exiting requirements by Chapter 10.
3. Buildings shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 2006
International Building Code; 2006 International Mechanical Code; 2006 International Plumbing
Code; 2006 International Fuel Gas Code; and the 2008 National Electrical Code and Chapter 29
of the Weld County Code.

prior to issue of Building Permits,

Dear Ms. Martin:
We have reviewed the above referenced proposal for a mineral resource
development facility including open pit gravel mining and materials processing. Since
• the submitted material does not appear to qualify as a "subdivision" as defined in §30-
28-101(10)(a), C.R.S., pursuant to the State Engineer's March 4, 2005 memorandum to
county planning directors, this office will only perform a cursory review of the referral
information and provide comments. The comments will not address the adequacy of
the water supply plan for this development or the ability of the water supply plan to
satisfy any County regulations or requirements.
The applicant indicated that the mine operation will be conducted as a dry pit, by
dewatering the active area with dewatering trenches. Exposed ground water taken from
the pit will be used for dust suppression and possible material washing. Pursuant to
§37-90-137(11), C.R.S., exposed ground water due to gravel mining operations is
considered to be a well and a well permit must be obtained prior to the commencement
of mining activity. Since this proposed gravel pit "well" appropriates water tributary to
the over-appropriated South Platte River basin, an approved temporary substitute water
supply plan (SWSP) or a Division 1 Water Court approved plan for augmentation that
includes depletions associated with all uses of ground water, including evaporation,
would be required before a well permit could be issued.
In addition, as indicated in the submittal materials, reclamation plans for the site
call for a lined water storage reservoir. However, should reclamation plans alter and
ground water remains exposed in unlined ponds, then as indicated above, an approved
SWSP or a Division 1 Water Court approved plan for augmentation that includes

The Department of Planning Services reviewed the above referenced Use by Special Review application
materials and offers the following comments:
Per the application materials, the applicant is proposing a Site Specific Development Plan and a Special
Use Permit for Mineral Resource Development Facility including open pit mining and material processing
in the A (Agricultural)Zone District..
Staff reviewed the text associated with the application. The landscape treatment consists of overburden
berms and top soil berms placed at the perimeter of the property to screen the internal activities from
adjacent properties. From the discussion in the application it appears that a seed mix will be placed
thereby covering the ground plane. Staff strongly suggests that the applicant create visual interest on the
berms utilized for long term screening of the facility.
Staff reviewed the Extraction Plan for this application. Staff did not review the mining and excavation plan,
or any plans associated with the landscape treatment associated with this proposed application. From
• discussion in the application, all disturbed areas will be reclaimed and seeded with an unknown seed mix
for each phase as mining is completed. The applicant further states that evergreen and decidupus trees
will be planted along the perimeter of the mine for screening. The maps identified in the application text
were not presented for this review, hence, staff is requesting additional information on the existing and
proposed deciduous and evergreen trees, and the dryland seed mix covering the groundplane. The
discussion text is general and non-specific with no common, botanical or cultivar species noted.
The shape of the reservoir could be described as square at best. For the development of a wildlife habitat
area, the reservoir shall have an undulating shoreline with terraced shelves to accommodate a wide
variety of wildlife species. Further, the applicant shall contact the Colorado Division of Wildlife for direction
on how to provide adequate cover and a positive environment to accommodate the newly created habitat
area(s). Written evidence of the Colorado Division of Wildlife requirements and methods of implementing
said requirements shall be submitted to the DMG and this office. These comments shall be reflected in
the revised Reclamation and Landscape Plan.
Per the application materials, the ground plane will be planted in native and/or drought tolerant grasses.
Future correspondence shall identify the species of grass seed mix and whether the mix is to be drilled or
broadcast for installation. Future correspondence shall identify the erosion control devices including but
not limited to rip-rap and seeding that will be placed within and adjacent to this area. If plant material is
proposed, please identify the species and how this plant material will be installed.
The applicant shall submit an Improvements Agreement for Public and Private Road Maintenance for
review and approval by this office if so determined that one is needed by the Department of Public Works.

Environmental Health Services has reviewed this proposal for a Mineral Resource
Development facility including open pit gravel mining and materials processing. A scale
and scale house, crusher and portable processing plant will be associated with this site.
Portable toilets and bottled water may be utilized at the working face of the mine. An
individual sewage disposal system and a tap from the City of Greeley or an individual
well will be installed in conjunction with the operation of the scale house. Noise will be
restricted to the level allowed in the industrial zone district. This Department will require
a noise control plan that should include items such as berms, conveyors and shroud
covers. Dust will be controlled through the application of water (City of Greeley water
and ground water). Revegetation, conveyors, reducing vehicle speeds, compaction of

road surfaces, berms and covering or watering loaded haul trucks would also reduce
dust and should be included in a dust abatement plan.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit evidence of an Air Pollution Emission Notice
(A.P.E.N.) and Emissions Permit application from the Air Pollution Control
Division, Colorado Department of Health and Environment, if applicable.
2. In the event washing of vehicle will occur on site the applicant shall ensure that
any vehicle washing area(s) shall capture all effluent and prevent discharges
from the washing of vehicles in accordance with the Rules and Regulations of the
Water Quality Control Commission, and the Environmental Protection Agency.
Vehicle washing areas should be designated on the plat.
3. In the event that 1 or more acres are disturbed during the construction and
development of this site, the applicant shall obtain a stormwater discharge permit
from the Water Quality Control Division of the Colorado Department of Public

• Health and Environment. A copy of the permit application shall be submitted to
the Environmental Health Services, Weld County Department of Public Health &
Environment. Alternately, the applicant can provide evidence that they are not
subject to this requirement.
4. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
5. The applicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
Environment.
6. The applicant shall submit a noise control plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
•
Environment.
7. Submit documentation to the Environmental Health Services Division of the Weld
County Department of Public Health & Environment indicating that a permanent
water source is available.
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to the issuance of the Certificate of Occupancy for the
scale house:
1. An individual sewage disposal system is required for the proposed scale house
and shall be installed according to the Weld County Individual Sewage Disposal
Regulations.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.

• 2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved waste handling
plan.
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved dust abatement
plan at all times.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in 25-12-103 C.R.S., as amended. The facility shall
operate in accordance with the approved noise control plan.
7. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes for the scale house.
• 8. Adequate handwashing and toilet facilities shall be provided for all personnel
located at or entering the facility.
9. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
10.Portable toilets may be utilized on sites that are temporary locations of the
working face and where the portable processing equipment is located.
11.Bottled water shall be provided to employees at the temporary locations of the
working face and portable processing equipment at all times.
12.Any vehicle washing area(s) shall capture all effluent and prevent discharges
from drum washing and the washing of vehicles in accordance with the Rules
and Regulations of the Water Quality Control Commission, and the
Environmental Protection Agency.
13.The applicant shall remove, handle, and stockpile overburden, soil, sand and
gravel from the facility area in a manner that will prevent nuisance conditions.
14.All pesticides, fertilizer, and other potentially hazardous chemicals must be
stored and handled in a safe manner in accordance with product labeling and in

• a manner that minimizes the release of hazardous air pollutants (HAP's) and
volatile organic compounds (VOC's).
15.The applicant shall obtain a stormwater discharge permit from the Colorado
Department of Public Health & Environment, Water Quality Control Division, as
applicable.
16.The operation shall comply with all applicable rules and regulations of the
Colorado Division of Minerals and Geology.
17.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.
Additionally, please note the following:
1. This application is proposing a well as its source of water. The applicant should
be made aware that while they may be able to obtain a well permit from the Office
of the State Engineer, Division of Water Resources, the quantity of water
available for usage may be limited to specific uses, i.e. domestic use only, etc.
Also, the applicant should be made aware that groundwater may not meet all
drinking water standards as defined by the Colorado Department of Public Health
and Environment. We strongly encourage the applicant to test their drinking
water prior to consumption and periodically test it over time.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily
under the purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II,
Division 4, Section 23. Our comments and requirements are as follows:
COMMENTS:
A traffic study may be deemed necessary by the Department of Public Works. Please return all
redline copies with re-submittal as well.
REQUIREMENTS:
final Plat:
1. All drawings as well as the drainage report shall be stamped by a registered professional
engineer, licensed to practice in the state of Colorado.
2. The U.S. Army Corp of Engineers' floodplain and floodway shall be used instead of the FEMA
floodplain.
a. The datum for the topography appears to be different from the datum for the Army Corp
study (NGVD 29). Please adjust the datum to be consistent and show which datum was
used.
b. Please show BFE elevations and cross-sections from the Army Corp model.
c. A copy of the Corp's model may be obtained from the City of Greeley's Stormwater
Department.
3. Please include a copy of the mining permit from the State of Colorado Division of Reclamation,
Mining, and Safety.
4. Please obtain and submit a Flood Hazard Development Permit (FHDP) per Weld County Code
(Section 23-2-460). See attached application
a. The FHDP map should be consistent with the revised USR Extraction Map.
5. Please revise the proposed daily site trips. The amount initially proposed will not attain the
maximum desired 250,000 tons of material annually and does not account for oil/gas traffic,
deliveries, or the possibility of government trucks if those entities choose to obtain gravel from
your site.
6. All stockpiles on site shall be parallel to the floodplain flow and located at the furthest point
away from the Cache La Poudre River.
• 7. Please address and resolve all redlines on the USR Extraction Map, Drainage Basin Map, and
Questionnaire Responses prior to resubmitting for review.
8. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on
the property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling noxious weeds.
9. Please show proof that either a substitute supply plan or an augmentation plan has been
submitted to the Colorado Division of Water Resources for the proposed recharge ditch and
pond.
10.All terms on the Terracon soils report shall be defined and all redlines shall be resolved.
Offsite:
1. The applicant shall participate in the dust abatement program on Balsam Avenue.
a. This procedure shall follow the standards outlined in Weld County Code 8-6-100E.
b. A long term road maintenance agreement with both Exhibits A & B filled out shall be
required for Balsam Avenue. Collateral will be required for 100% of the estimated costs
on schedule A.
2. Please provide a profile and typical cross-section of haul roads per Weld County Code
Ordinance 2003-10.
Access:
1. The access road shall be paved either 300 feet in length or the entire length to the scale
house, whichever distance is shorter.
a. A private road maintenance agreement with both Exhibits A & B filled out shall be
required for this paving. Collateral will be required for 100% of the estimated costs on
schedule A.
2. The minimum turning radius for the main access shall be 40 feet per Weld County Code 8-2-
40.
3. If a drainage culvert is required under the access, a 15-inch corrugated metal pipe is the
41 County's minimum size requirement. If the applicant chooses to place a larger culvert, please
contact the Public Works Department to adequately size your culvert.
4. Please include a crossing easement with the oil/gas company if an additional access onto
Balsam Avenue is required.
Drainage:
1. Please show the discharge point of the pit dewatering stormwater as well as detailed plans on
how the water will be transported to the Cache La Poudre River.
2. Please show the locations of all existing drainage and irrigation features that are located on
site.
3. Please show any calculations for culverts, ditches, swales, etc.
4. An erosion control plan shall be developed for downstream properties and added to the
drainage report using best management practices.
5. Please include the soil hydrologic type in the drainage report for all soils located on the site.
6. All calculations on the design point locations shall be provided in the drainage report.
7. Please include a summary for the drainage report.
