HomeMy WebLinkAbout20082249.tiff HEARING CERTIFICATION DOCKET NO. 2008-50 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1655 FOR A HOME BUSINESS (BULLET CASING BUSINESS) IN THE A (AGRICULTURAL) ZONE DISTRICT- GERALD AND BEVERLY EWING A public hearing was conducted on August 20, 2008, at 10:00 a.m., with the following present: Commissioner William H. Jerke, Chair Commissioner Robert D. Masden, Pro-Tem Commissioner William F. Garcia Commissioner David E. Long Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Cyndy Giauque Planning Department representative, Chris Gathman Health Department representative, none present Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated July 7, 2008, and duly published July 11, 2008, in the Greeley Tribune,a public hearing was conducted to consider the request of Gerald and Beverly Ewing for a Site Specific Development Plan and Use by Special Review Permit#1655 for a Home Business (bullet casing business) in the A(Agricultural) Zone District. Cyndy Giauque, Assistant County Attorney, made this a matter of record. Chris Gathman, Department of Planning Services, presented a brief summary of the proposal, entered the favorable recommendation of the Planning Commission into the record as written, and gave a brief description of the location of the site. He stated the applicant is operating a bullet casing business from an existing outbuilding, and the application materials indicate there will be one truck and one trailer which may be stored outside, with the potential for a couple of UPS deliveries per month, and all other operations will be conducted within the residence as a home business. In response to Chair Jerke, Mr. Gathman stated this is a commercial venture, not just the production of bullet shells for personal use. Responding to Commissioner Rademacher, Mr. Gathman stated the applicant owns the 80-acre parcel. In response to Commissioner Masden, Mr. Gathman stated Condition of Approval #4.A addresses the requirement for a federal firearms license prior to operation, so the operation will be regulated at both the local and federal levels. Mr. Gathman displayed photographs of the site and surrounding area, and responding to Commissioner Rademacher, he stated the nearest residence is one-quarter of a mile away. Donald Carroll, Department of Public Works, stated the property is accessed from County Road 100,with County Road 17 approximately three-quarters of a mile to the east. He stated there is an existing access with a recycled asphalt driveway, the house is approximately one-quarter of a mile from the road, there is adequate off-street parking available, this will be a family operation with minimal deliveries, and the Department of Public Works is requiring that historical drainage flows be maintained. He further stated County Road 100 has an average daily traffic count of approximately 1,000 vehicles, and the site is not within a flood zone. 2008-2249 PL1973 HEARING CERTIFICATION - GERALD AND BEVERLY EWING (USR #1655) PAGE 2 Chair Jerke requested the Board members pay specific attention to the Conditions of Approval submitted by the Department of Public Health and Environment,since a Department representative is not available to make a presentation. Gerald Ewing, applicant, stated he provides materials for various individuals who use the supplies for hunting or hobby interests. He stated most of the business is generated at gun shows or through his web site, and he is not anticipating customers coming to the site. In response to Chair Jerke, Mr. Ewing stated he only provides shell casings, and there will be no gun powder on the site, other than his own personal supply. Responding to Commissioner Garcia, Mr. Ewing stated the bullet casing machine melts 40 pounds of lead and produces 2,500 bullets per hour. He stated the size and noise produced are similar to a standard washing machine, and it is housed indoors, far from any neighboring properties. He further stated the hours of operation are listed from 7:00 a.m., to 10:00 p.m.; however, there is the possibility that the time may fluctuate, since this is not a daily occupation. Chair Jerke proposed striking the hours of operation to better reflect the type of operation and allow for early deliveries or later production. No public testimony was offered concerning this matter. In response to Chair Jerke, Mr. Ewing stated he has reviewed,and concurs with,the Conditions of Approval and Development Standards. Commissioner Rademacher proposed deleting Development Standard #6, and the Board concurred. Commissioner Long stated he has reviewed the health-related language and he feels all of the items have been adequately addressed. Commissioner Long moved to approve the request of Gerald and Beverly Ewing for a Site Specific Development Plan and Use by Special Review Permit#1655 for a Home Business (bullet casing business)in the A(Agricultural)Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record, with the deletion of Development Standard#6. The motion was seconded by Commissioner Rademacher,and it carried unanimously.
