A RESOLUTION CREATING LOCAL IMPROVEMENT DISTRICT
No. 1981-2 IN THE COUNTY OF WELD, COLORADO ORDERING
THE CONSTRUCTION AND INSTALLATION THEREIN OF GRAVEL
AND ASPHALT PAVING ON ELMORE ROAD: PROVIDING FOR
PAYMENT FOR SAID IMPROVEMENTS : AND PROVIDING FOR
OTHER DETAILS IN CONNECTION WITH THE DISTRICT.
In re. WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado Statutes and Weld County Home Rule

Charter, is vested with the authority of administering the affairs

WHEREAS, the Board of County Commissioners of Weld County,
Ezi Colorado, pursuant to the laws of the State of Colorado , hereby
finds and determines that there exists a necessity for the creation
c of a local improvement district within Weld County to be designated

as Local Improvement District No . 1981-2 and the construction and

�. q installation therein of gravel and asphalt paving; and

u WHEREAS, Notice of a public hearing concerning the
creation of the district and the construction and installation of
the improvements therein has been given by publication in one
issue of the Johnstown Breeze, a newspaper of general circulation
in the County, not less than thirty (30) days prior to the date of
the hearing and in addition, notice was delivered or mailed by
certified mail to each property owner to be assessed for the cost
of improvements and included within the proposed district not less
than ten (10) days prior to the hearing; and
WHEREAS, at the time and place set forth in the notice,
the Board of County Commissioners met in open session for the
purpose of hearing any objections or protests that might be made
against the proposed district or the improvements to be constructed
or installed; and
WHEREAS, the Board of County Commissioners considered
all such protests and objections and has determined to proceed
with the creation of the district and the construction of the
improvements;

g. , BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado :
Section 1 . Creation of District. That a local improve-
ment district for the construction and installation of gravel and
asphalt paving together with any necessary incidentals as herein-
after described is hereby created and established in accordance
with the laws of the State of Colorado and shall be known and
designated as "Local Improvement District No. 1981-2" . All co; L proceedings heretofore taken and adopted in connection with the

District are hereby ratified, approved and affirmed. The pur-
pose to create said district was properly initiated by a petition
from a majority of the property owners located along Elmore Road.
S Section 2 . Approval of Engineering Plans . That the
engineer 's reports together with all the details, specifications ,

estimates , maps , and schedules thereto attached or appended are
ai
hereby approved and adopted.
Section 3 . Boundary of District. The extent of the
district to be assessed for the cost of the improvements in the
area to be included within the boundary of the district shall
include the area described as follows: THAT PORTION OF THE NORTH-
WEST QUARTER OF SECTION 30 , TOWNSHIP 3 NORTH, RANGE 68 WEST OF THE
6TH P.M. WELD COUNTY, COLORADO DESCRIBED AS FOLLOWS : BEGINNING AT
THE NORTHEAST CORNER OF THE NORTHWEST QUARTER OF SECTION 30 -THENCE
ALONG THE EAST LINE OF SAID NORTHWEST, QUARTER SOUTH 0 29 ' WEST
2623. 45 ' ; THENCE ALONG THE SOUTH LINE OF SAID NORTHWEST QUARTER
SOUTH 89 49 ' WEST, 637. 81 ' TO A POINT: THENCE NORTH 0 29 ' EAST
2625 . 49 ' TO A POINT ON THE NORTH LINE OF SAID SECTION, THENCE ALONG
SAID NORTH LINE OF SECTION 30 , THENCE EAST 637 . 80 ' TO THE POINT OF
BEGINNING.
Section 4 . Description of Improvements . The kind of
improvements and the streets to be improved are as follows :
Addition of gravel to existing road base and paving
one-half mile of Elmore Road with two inches of asphalt.
Section 5 . Improvements Authorized. The construction
and installation of the improvements in and for the district as
shown by the plans , specifications , and maps thereof prepared by
the engineer and approved by the Board of County Commissioners

of Weld County and now on file in the office of the Weld County
so Clerk and Recorder, be and the same is hereby authorized and
ordered the materials to be used in the construction of said
improvements to be in accordance with such maps, plans , and
3 specifications .

Section 6 . Cost of Improvements. The probable total
cost of the improvements is approximately $28 , 772. 00 . The
probable cost of such improvements shall not exceed the cost of
$10. 00 per lineal frontage foot. It is anticipated that Weld
`' = County will not pay any part of the cost of the improvements

Road. The method of assessment of cost shall be in accordance
with the number of front feet a property owner has lying along

z the improved portion of Elmore Road.
Section 7 . Payment of Assessments . The assessments
Z will be due and payable without demand within thirty (30) days
from and after the publication of the resolution assessing the
whole cost of said improvements against the real property in the
district. In the event any owner of real estate shall fail to
pay the whole of such assessment against his or her property
within said thirty (30) days , then the whole cost of the improve-
ments so assessed against such property shall be payable in twenty
(20) equal annual installments of principal plus interest. The
first of said installments of assessments shall be due and payable
at such time as will be indicated in the assessing resolution and
the remainder of annual installments of assessment and interest
shall be due and payable successively on the same day in each year
thereafter until all are paid in full . The rate of interest to
be paid on unpaid and deferred installments will be established
by resolution to be adopted by the Board of County Commissioners
at a later date.
Section 8 . General Benefits . The Board of County
Commissioners hereby finds and determines that the improvements

proposed to be constructed and installed will confer a special
co benefit upon the property within the district and a general bene-

fit upon the County as a whole.
Section 9 . Repealer. All resolutions or parts thereof
in conflict herewith are herewith repealed.
The above and foregoing resolution was , on motion duly

made and seconded, adopted by the following vote on the 19th day
