HomeMy WebLinkAbout20081020.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST KEVIN AND JEANIE COLEMAN FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Kevin and Jeanie Coleman,VI#0400129,are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 8th day of April, 2008, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS,Kevin and Jeanie Coleman,property owners,were present at said hearing,and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until July 8, 2008, to allow adequate time for the property owners to remove the business, or submit the appropriate permits to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. She said that she had received my letter. She said that they have been there (a long with the trucks) since 1978. I explained that I was not sure of the date for a Nonconforming Use, but I would check into it and let her know. She said that she had put a call into their attorney, but he had not called them back yet. I told her that I would do some checking and could hopefully bring it up to staff Friday morning. I would try to call her back Friday afternoon. She gave me her work number (587-2660). She owns the business so it is fine to call her there. 02/16/2005 Property Inspected Upon a visual inspection of the property, the following items were noted: 1 semi trailer& a few pallets out back. Property appeared well maintained. No pictures were taken during this inspection. 09/11/2007 Phone Call Jeanie called (970)587-2011 or 970-587-2660 (daytime number). She said they had just received my letter and were confused. I explained that the last documentation I could find notified them that I had been unable to locate any NCU paperwork (that they claim to have sent in). She said that we had spoken on the phone and that I had advised her that I would call her if I couldn"t find them. I explained that I did not remember that conversation. She asked if that meant she had to dig through all her paperwork and re-find everything. I explained that if they still wanted to attempt to qualify as a NCU than yes. She said she would try to find everything and fax it into me. I explained that until she receives an actual CLOSE letter from me and a paper that states they actually qualify for a NCU (with a number on it), the violation will remain open. She said okay. 01/28/2008 Phone Call Kevin Coleman (970-371-0185) called. He asked what my letter was talking about. I explained that some time ago, his wife submitted a Nonconforming Use application. Jacqueline Hatch (Planner) processed the application and deemed that it did not meet the minimum requirements for a Nonconforming Use. I explained that she sent him a letter explaining this information. He stated that he never received a letter from her. I stated that I would re-send the letter tomorrow morning. He asked what that meant for him. I explained that he could either apply for a Use by Special Review permit (in order to keep more than 1 Commercial Vehicle -would require 2 public hearings) or he could apply for a Zoning Permit for a Commercial Vehicle for 1 Commercial Vehicle (no public hearing unless we receive 30% in opposition).
