HomeMy WebLinkAbout20081693.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST DONALD AND SHERRI TRETTER FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,Donald and Sherri Tretter,ZCV#0800063,are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 17th day of June, 2008, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Donald and Sherri Tretter were not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until August 17, 2008, to allow adequate time for the property owners to completely screen the noncommercial junkyard from all adjacent properties and public rights-of-way, and to remove all remaining tires to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. While fencing has been started, we need to received evidence that the vehicles all belong to the current property owner. No pictures were taken during this inspection. 04/29/2008 Phone Call Donald Tretter called. He stated that he has been telling them that the vehicles needed to be removed. He hopes to have it done pretty quickly. 05/16/2008 Phone Call Don Tretter called. He said he believes they are about 1/2 done. He said he thinks there are like 25 vehicles left. I advised him that I would be sending him a letter scheduling this case for a Violation Hearing on June 17th, but if the property were brought into compliance before that, the hearing would be cancelled. I told him that he would need to call me to schedule an actual on-site inspection so I could verify any remaining vehicles as belonging to him.
