RE: APPROVAL OF RECORDED EXEMPTION NO. 575 - CALVIN AND JUDITH
WERNER
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners at a public meeting held in the Chambers of the Board,
that the division into two parcels of land, as shown on the plat
known as Recorded Exemption No. 575, being the property of Calvin
and Judith Werner, described as part of the South 1/2 of Section
21, Township 10 North, Range 62 West of the 6th P.M. , Weld County,
Colorado, being more particularly described in the plat which
shall be provided by the applicants and known as Exhibit "A" ,
said plat to be recorded, does not come within the purview of the
definition of the terms, "subdivision" and "subdivided land" ,
pursuant to its authority under Section 30-28-101 (10) (d) , CRS
1973 , as amended.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Calvin and Judith Werner be, and hereby
is, exempt from the definitions of the terms, "subdivision" and
"subdivided land" .
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 27th day of
October, A.D. , 1982 .

Re: Recorded Exemption 575
Dear Commissioners:
The attached application and related items are in reference to a request
for a recorded exemption for Calvin and Judith Werner. The property is
described as the South 1/2 of Section 21, Township 10 North, Range 62 West
of the 6th P.M. , Weld County, Colorado. This property is located four and
one-half 1) miles southwest of Grover on Weld County Roads 77 and 114.
The property contains approximately 320 acres, more or less. The request
is to split the property into two parcels of 300 acres, more or less, and
20 acres, more or less. The applicant wishes to sell the larger parcel and
to keep the smaller parcel where the only improvements existing are for
their residence.
Based upon the information in the adopted policies in the County, the
Department of Planning Services staff recommends the request be approved
for the following reasons:
1. The request complies with Section 9-2C of the Weld County
Subdivision Regulations Submission Requirements.
2. The request complies with Section 9-2E of the Subdivision
Regulations as follows:
- The 320 acres, more or less, under consideration will
allow agricultural and related uses to be the predominant
uses. No reduction of agricultural land use for production
will occur. These facts support the proposal as being con-
sistent with the intent clause of the agricultural
district.

- The proposed use being compatible with existing and
surrounding land uses. The proposed use not being
inconsistent with efficient and orderly developments.
- The proposal being in compliance with Section 1-3 of the
Weld County Subdivision Regulations and the proposed
land division complying with the Weld County Comprehensive
Plan.
- A telephone conversation on October 20, 1982 with the
Division of Water Resources identifies that adequate water
service can be made available to both proposed parcels.
- A letter dated October 8, 1982 from the Weld County
Health Department indicates that both parcels will be
served by an adequate septic system.
- Both proposed parcels can be adequately served by Weld
County Roads 77 and 114.
- The proposal does not exist in an overlay district area.
- The proposed lots are not part of a recorded exemption
within the last five years.
- The proposed lots meet the minimum size requirements
for land division.

any rights-of-way or other easements as recorded by instruments of record
or as now existing on said described parcel of land.

Part of the South Half (S1) of Section 21, Township 10 North, Range 62 West
of the 6th P.M. , Weld County, Colorado being more particularly described
as follows:
Beginning at the Southwest Corner (SW Cor) of said Section 21 and
considering the West line of said Section 21 as bearing North 00°00'00"
East, with all other bearings contained herein relative thereto;
Thence North 00°00'00" East, along said West line, 692.60 feet;
Thence South 89°53'35" East, 1191.16 feet;
