The Weld County Public Works Department has reviewed this proposal; this project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS:
The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state highways.
Please contact Gloria Hice-Idler at the Greeley office to verify the access permit or for any additional
requirements that may be needed to obtain or upgrade the permit. The access is from State Highway 66.
CDOT's most current average daily traffic count (ADT) reflects 6,800 vehicles taken in a 24-hour period in
2006 on State Highway 66 near WCR 13 close to this location.
SEQUIREMENTS:
Storm Water Drainage: The storm water drainage will be handled by a retention pond and settling pond
located at the south end of the feeding facility. The retention pond and settling will be maintained and operated
in accordance with the Colorado Confined Animal Feeding Patrolled Regulation.
Please provide a stamped and signed by a registered P.E. licensed to practice in the state of Colorado,
Grading Plan and Erosion Control Plan for this USR.
Show and explain how the Floodplain berm functions, remember no fill is allowed within the floodway, a Flood
Hazard Permit will be required include this permit number on the plans.
Wetlands encountered within any grading portion of the project shall require the Army Corps of Engineers be
contacted at 303.979.4120 Littleton, CO and for the Corps to decide if a 404 permit is required.
Circulation: All feed alleys shall be surfaced with gravel and shall be graded to prevent drainage problems.
There appears to be adequate parking and circulation throughout the milking parlor and office building.
Right-of-Way: The applicant shall indicate on the plat drawing the existing and/or future right-of-way for State
Highway 66.

The Weld County Department of Public Health and Environment has reviewed this application.
We have also discussed the application with the applicant's consultant, AgPro. Representatives
of AgPro have indicated that the applicant intends to apply to the Water Quality Control Division
of the Colorado Department of Public Health & Environment for a discharge permit for the
facility. Therefore,our referral comments will reflect this fact.
We recommend approval of the proposed dairy with the following recommendations:
The Department recommends the following requirement be met prior to allowing the plat to be
recorded:
• 1. Provide evidence that a Standard Operating Procedure for sludge and manure removal
(cleaning of impoundments to maintain capacity)has been submitted for approval to the
Colorado Water Quality Control Division required by Colorado Water Quality Control
Commission Regulation Number 81 [81.5 (3)].
2. Demonstrate that wastewater impoundments meet required setbacks to water wells and
groundwater required by Colorado Water Quality Control Commission Regulation
Number 81. [81.5 (6)].
3. Provide evidence that a CAFO Colorado Discharge Permit has been applied obtained
from the Colorado Water Quality Control Division.
The Department recommends the following requirements be incorporated into the permit as
development standards:
1. The facility shall operate in compliance with Colorado Water Quality Control
Commission Regulation Number 81.
2. The facility shall maintain CAFO Colorado Discharge Permit coverage and operate in
compliance with Colorado Water Quality Control Commission Regulation Number 61.
There shall be no discharge of manure or process wastewater into surface water from the
production area, except as provided in the facilities CAFO Colorado Discharge Permit.

3. Manure and process wastewater shall be applied at agronomic rates and in accordance
with the Nutrient Management Plan or Manure&Wastewater Management Plan. There
shall be no discharge from land application areas except for agricultural stormwater.
4. The facility shall be operated and maintained in a manner to prevent nuisance conditions
and operate in accordance with their approved Management Plan for Nuisance Control.
5. The facility shall control fugitive dust on this site and be operated and maintained in a
manner to prevent nuisance conditions. The facility shall be operated in accordance, at
all times,with their current approved Management Plan for Nuisance Control.
6. The facility shall be operated in a manner to control pests. The facility shall be operated
in accordance, at all times,with their current approved Management Plan for Nuisance
Control. Additional control measures shall be implemented at the request of the Weld
County Department of Public Health and Environment in the event that rodents(which
can be determined to be associated with the facility) are in such a number to be
considered a nuisance condition.
7. The facility shall be operated in a manner to control flies. The facility shall be operated
in accordance, at all times,with their current approved Management Plan for Nuisance
• Control. Additional fly control measures shall be implemented at the request of the Weld
County Department of Public Health and Environment in the event that flies(which can
be determined to be associated with the facility)are in such a number to be considered a
nuisance condition. Additional controls shall also be implemented in the event the Weld
County Department of Public Health and Environment receives a significant number of
fly(associated with facility)complaints, and in the judgment of the Weld County Health
Officer,there exists a fly condition requiring abatement.
8. The facility shall be operated in a manner to control odors. The facility shall be operated
in accordance,at all times,with their current approved Management Plan for Nuisance
Control. Odors detected off site shall not equal or exceed the level of fifteen-to-one
dilution threshold, as measured using methods set forth in Regulation 2 of the Colorado
Air Pollution Control Regulations. Additional controls shall be implemented at the
request of the Weld County Department of Public Health and Environment in the event
odor levels detected off site of the facility meet or exceed the level of fifteen-to-one
dilution threshold, or in the judgment of the Weld County Health Officer,there exists an
odor condition requiring abatement.
9. The applicant shall remove,handle, and stockpile manure from the livestock area in a
manner that will prevent nuisance conditions. Manure piles shall not be allowed to exist
or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant
runoff. The surface beneath the manure storage areas shall be of materials which are
protective of State waters. These areas shall be constructed to minimize seepage or
percolation of manure contaminated water. In no event shall the facility impact or

degrade waters of the State in violation of Colorado Water Quality Control Commission
Regulation Number 81.
10. Any Individual Sewage Disposal System(I.S.D.S.)on the property shall be permitted,
installed, maintained and operated in compliance with Weld County I.S.D.S. Regulations.
11. The facility shall operate in compliance with applicable Colorado Air Quality Control
Commission Regulations. There shall be no open burning except"agricultural open
burning"as defined by Colorado Air Quality Control Commission's Regulation 9.
12. There shall be no permanent disposal of solid wastes,as defined in the Regulations
Pertaining to Solid Waste Disposal Sites and Facilities (6 CCR 1007-2), at this site.
13. The facility shall adhere to the maximum permissible noise levels allowed in the Light
Industrial Zone as delineated in Section 25-12-103 C.R.S, as amended.
14. Waste materials,not specifically addressed by other development standards, shall be
handled, stored, and disposed in a manner that controls fugitive dust,blowing debris,and
other potential nuisance conditions.
• 15. If required, a stormwater discharge permit shall be obtained from the Colorado Water
Quality Control Division for construction activities.
16. Any domestic wastewater treatment works shall comply with Colorado Water Quality
Control Act, specifically, the facility shall comply with the July 31, 2007, Compliance
Advisory from the Colorado Department of Public Health and Environment concerning
the sewage disposal requirements for the mobile homes on the property. Any final
resolution to the Advisory must take into consideration the sewage disposal requirements
for the new office.

On behalf of the Town of Mead,I am responding to the above captioned development
referral. I have reviewed the materials submitted by Weld County and have comment and
observations concerning this proposal.
As stated in the USR application,the applicants are proposing to reduce the number of animal
units maintained as part of the dairy(4000 to 3000)and increase pasture area. Also,as per our
discussion,there are no new residential units,no intent to extend St Vrain Sanitation District
services,or expand new uses of this property through the requested USR
Based on the application and discussion,the Town has no objections to this request,However,
• if the applicant modifies the current application,or,proposes new land uses now or in the
future,the Town requests such applications be submitted to Mead for review and processing.
Also,if the applicants consider figure plans for additional housing,the Town requests they
annex into Mead.

Case#USR-1625. The proposal reduces the existing 4,000 animal dairy to 3,000 animals. They
will remove 3 milking parlors, associated pens, animal shelters, a feed mill, office, and associated
waste/storm water ponds.
Prime Farmland:
Land is currently an operating dairy. Land was listed as prime if irrigated.
• Water Quality:
The operation currently is in compliance with the floodplain standards and water quality
standards.
Noxious Weed Control:
Noxious weed control plan should be developed with the Weld County Weed Department
on the area that is going to be reclaimed into pasture.
Soils Limitations:
The Aquolls soil is subject to flooding. This condition has been met with the floodplain
compliance standards. The Tassel and Wiley soils are limited due to soft bedrock on the slope
and shrink swell soils.

This referral does not appear to qualify as a"subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to
county planning directors, this office will only perform a cursory review of the referral information and
provide comments. The comments do not address the adequacy of the water supply plan for this
project or the ability of the water supply plan to satisfy any County regulations or requirements. In
• addition,the comments provided herein cannot be used to guarantee a viable water supply
plan or infrastructure, the issuance of a well permit, or the physical availability of water.
According to the referral information the operation will be served by the Central Weld County
Water District ("District"). Our office has no comments regarding the District's ability to serve the
commercial operation.

Dear Mr. McCormick:
I have reviewed information provided by Weld County Department of Planning Services regarding the
above referenced site located south of and adjacent to State Highway 66 and west of County Road 17 in
Weld County, Case Number USR-1625.
• Weld County participates in the National Flood Insurance Program(NFIP). A review of the designated
floodplains for Weld County indicates that Special Flood Hazard Areas (SFHA)have been identified and
exist in the vicinity of the project site. As such, the applicant is reminded that ANY work performed in an
SFHA requires the issuance of a Floodplain Development Permit (FDP) from Weld County prior to the
beginning of construction.
The Colorado Water Conservation Board (CWCB) is the state agency tasked with floodplain management
coordination and flood mitigation assistance. As such, the CWCB acts as a liaison between FEMA and
local communities in assisting the local communities implement and maintain their local floodplain
management regulations. Therefore, the CWCB fully supports Weld County's decisions in this matter.
Furthermore, additional information should be submitted by the applicant to the County to show that the
proposed activities along the St. Vrain River meet the minimum requirements set forth by FEMA.
Although the CWCB is not authorized to take action against violations, the CWCB is obligated to report
the violations to FEMA and other agencies with the authority to act.

The Water Quality Control Division (Division)has performed a cursory review of Weld County's Site
Specific Development Plan and Use by Special Review(USR) Application and Questionnaire submitted for
Aurora Dairy Corporation and their facility located at 7388 Highway 66, Platteville, Colorado. The
application was received by the Division on September 14, 2007.
In general, the Division's authority is for the review and approval of public drinking water and wastewater
systems. As such, on July 31, 2007,the Division issued a Compliance Advisory to Aurora Dairy
Corporation regarding operation of a domestic wastewater treatment facility at their Platteville facility
without site and design approval or a discharge permit, which are violations of the Colorado Water Quality
Control Act. The Compliance Advisory stated that the facility must be brought into compliance with the
Colorado Water Quality Control Act by June 1, 2008. As of the date of this letter,there has been no
response from Aurora Dairy Corporation to the July 31, 2007-dated Compliance Advisory. If an escalated
enforcement response is deemed necessary, a Notice of Violation/Cease and Desist Order that may include
the assessment of penalties may be issued. A copy of the Compliance Advisory is attached to this letter. In
addition, an assessment is currently underway to determine if the facility is a public water system as defined
by the Colorado Primary Drinking Water Regulations. The Division's findings as to whether the facility is a
public water system or not will be sent to you upon completion of the assessment.
The Division's Environmental Agriculture Program (Program) also performed a cursory review of the
submitted information and had the following comments.

• The Program noted that the facility (dairy) is defined as a Large Concentrated Animal Feeding
Operation(Large CAFO). As such, the dairy is subject to compliance with the CAFO ground water
protection provisions in Regulation No. 81 ("Animal Feeding Operations Control Regulation"). The
dairy must be in compliance with these provisions whether or not it holds a discharge permit from the
Program. The dairy's USR application does not appear to address the CAFO ground water protection
requirements, including the requirement that wastewater storage ponds not exceed a seepage rate of
1x10-6 cm/sec.
• As a Large CAFO, the dairy also is subject to state surface water protection requirements. The
Program notes that the dairy has not been issued a discharge permit and, as a result, cannot discharge
pollutants from its production area to waters of the U.S. (per the Colorado Water Quality Control
Act).
• The Program has been informed by the Weld County Department of Public Health and Environment
that the dairy will be applying for a CAFO discharge permit. As a result, instead of reviewing the
USR application for surface water protection provisions, the Program will review the dairy's
compliance with the permit application requirements specified in Section 61.17 of Regulation No. 61
("Colorado Discharge Permit System Regulations") upon receiving the permit application.
Please note that this letter does not address any other requirements that may be associated with the
•onstruction or permitting of this facility. Please contact the Permits Section at (303) 692-3510 with

Dear Mr. Placke:
The Division met with Thomas Haren with AGPROfessionals, LLC on May 7, 2007 at the Weld County
Environmental Health Offices to discuss the septic systems on the Aurora Dairy property. At that meeting,
Mr. Haren was informed that the current wastewater situation at the Aurora Dairy facility meets the
definition of a Domestic Wastewater Treatment Wastewater Works and needs to obtain site location,design
approval,and a discharge permit from the Colorado Department of Public Health and Environment, Water
Quality Control Division.
The Aurora Dairy Group has been operating a Domestic Wastewater Treatment facility(a number of septic
systems)serving the Aurora Dairy Group facility located at 7228 Hwy 66 in Platteville,Colorado without
site and design approval or a discharge permit. The purpose of this letter is to notify Aurora Dairy Group
that on the basis of this information,the Water Quality Control Division(the"Division")finds that the
Aurora Dairy Group is in violation of the Colorado Water Quality Controi Act(the"Act"), § 25-8-702(1),
C.R.S., which states :
"No person shall commence the construction of any domestic wastewater treatment works or
the enlargement of the capacity of an existing domestic wastewater treatment works, unless the
site location and the design for the construction have been approved by the division."
and§ 25-8-501, C.R.S. which states in part that:
"No person shall discharge any pollutant into any state water from a point source without first
having obtained a permit from the division for such discharge, and no person shall discharge into a
ditch or man-made conveyance for the purpose of evading the requirement to obtain a permit under
this article... "

Failure to comply with the Act could result in formal action, including the imposition of civil penalties.
Section 25-8-608,C.R.S., establishes that any person who violates any provision of the Act or of any permit
issued under the Act,or any control regulation promulgated pursuant to the Act, shall be subject to a civil
penalty of up to$10,000 per violation for each day during which such violation occurs.
At the meeting held on May 7,2007 with Mr. Haren the Division requested legal contact information for the
Aurora Dairy Group. Another letter was send to Mr. Haren on June 21,2007 requesting a legal contact for
the Aurora Dairy;however as of the date of this letter no response has been received.
As conveyed to Mr. Haren in the June 21,2007 letter the Division is willing to provide one year for Aurora
Dairy Group to bring these septic systems into compliance starting on June 1,2007. Due to the delays in
providing the requested information the Aurora Dairy Group will need to take action in less than one year to
meet the compliance advisory deadline. This facility must be brought into compliance with the Water
Quality Control Act by June 1,2008.
In Mr. F laren's letter dated June 12,2007 to Trevor Juricek at Weld County,two options were indentified,
both of which that would occur within one year:
1. Connect mobile homes to the existing collection system line from the St. Vrain Sanitation District
and abandon the septic systems,or
2. Reduce the number of mobile homes on the property to meet the horizontal setback distances
found in Water Quality Control Division WQSA Policy#6.
igh Either option would be acceptable;however the Division is committed to resolving this issue by the June 1,

The issuance of this Compliance Advisory does not limit or preclude the Division from pursuing its
enforcement options concerning the above violation(s). The Division is currently evaluating the facts
associated with the above-described violation(s),and if an escalated enforcement response is deemed
necessary,you may be issued a Notice of Violation/Cease and Desist Order that may include the assessment
of penalties.
