RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT #1472 - STEVE AND
JOJOMICHELLE POMEROY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated August 4, 2004, the Board approved Use by Special
Review Permit#1472 for a Kennel(60 dogs maximum)in the A(Agricultural)Zone District for Wes
Moser and Sons, Inc., do Noah's Bark/JoJo and Steve Pomeroy, on the following described real
estate, to-wit:
Lot A of Recorded Exemption #2574; being part of
the S1/2 NE1/4 of Section 33, Township 3 North,
Range 65 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board has received a request from Steve and JoJoMichelle Pomeroy,
12623 County Road 43, Hudson, Colorado 80642, to vacate said Use by Special Review
Permit#1472, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendations of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and, having
been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit#1472 be, and hereby is, vacated.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 27th day of October, A.D., 2008.

SUBJECT: Vacation of USR-1472
The Department of Planning Services has received the attached letter from Steve and Jojo
Michelle Pomeroy. Mr. and Mrs. Pomeroy have not completed the conditions of approval and
are requesting that USR-1472 for a kennel (60 dogs maximum) in the A (Agricultural) Zone
District be vacated.
Background information:
Legal Description: Lot A of RE-2574 being part of S2 NE4 of Section 33, Township 3 North,
Range 65 West of the 6th P.M., Weld County, Colorado
Location: West of and adjacent to County Road 43 and approximately '/2 mile south
of County Road 28.
USR-1472: USR-1471 was approved by the BOCC on August 2, 2004, for a kennel
(60 dogs maximum) in the A (Agricultural) Zone District

Dear Jacqueline Hatch.
Steve and I have chosen to relocate from Hudson and dose
Noah's Bark. The official close date with the State will be
October 31. 2008. Thank you and the entire board for all
the work you all have done for our UM approval. at this
time we would like to have the final approval removed from
